AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF
LUBBOCK BY AMENDING SECTIONS 19-27 AND 19-30 OF CHAPTER 19 THERE ..
OF PROVIDING FOR RATING OF MOTION PICTURES; PROVIDING A SAVINGS
CLAUSE; PROVIDING FOR PUBLICATION AND DECLARING AN EMERGENCY,
WHEREAS, the Motion Picture Association of America has reviewed its syste
of rating movies after a year1s trial period, and
WHEREAS, such review has prompted a revision of one category with such
revision to become effective March 1, 1970; and
WHEREAS, the City Council finds that a need to maintain consistency between
the Ordinances of the City of Lubbock and the rating system of the MPAA which ha
heretofore been adopted, constitutes an emergency, NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1, THAT the Code of Ordinances of the City of Lubbock BE and is
hereby amended so that Section 19 ... 27 thereof shall read as follows:
"Section 19 ... 2 7.. The ratings to be given to motion pictures exhibited in th
City of Lubbock are:
"G" suggested for general audiences.
"GP" -parental guidance suggested. (Henceforth, the rating "M"
shall be replaced by and when used herein shall be interprete
as meaning 11GP").
"R" restricted -persons under 17 not admitted unless a~om ..
panied by parent or adult guardian.
11X" -persons under 18 not admitted. 11
SECTION 2. THAT the Code of Ordinances of the City of Lubbock BE and is
hereby amended so that sub-sections (7) and (9) of sub-section (a) of Section 19-30
shall read as follows:
11(7) To sell or give any person under 1 7 a ticket to any film rated 11R",
which ticket is used by ; such person under 17 to gain admittance to
view such rated film. The parent or adult guardian of a person
under 17 must purchase the ticket for admission to view any film
rated 11R 11 ,
(9) To permit any person under 17 to view the exhibition of any film
rated "R'\ unless such person under 17 is accompanied by a paren
or adult guardian. 11
SECTION 3. THAT the Code of Ordinances of the City of Lubbock BE and is
hereby amended so that sub-section (c) of Section 19-30 shall read as follows:
"(c) It shall be unlawful for any person under 17:
(1) To give his age falsely as seventeen (17) years of age or over
for the purpose of gaining admission to an exhibition of a film
rated 11R 11•
(2) To remain in the viewing room of any theater where a film
rated "R" is being exhibited, unless such person under 17 is
accompanied by a parent or adult guardian.
(3) To state falsely that a person is his parent or adult guardian fo
the purpose of gaining admittance to the exhibition of a film
rated 11R 11• 11
SECTION 4. THAT the Code of Ordinances of the City of Lubbock BE and is
hereby amended so that sub-section (3) of sub-section (d) of Section 19-30 shall
read as follows:
11(3) To make any false statement for the purpose of enabling any person
under 1 7 to gain admittance to the exhibition of a film rated "R 11

SECTION 5. Should any paragraph, sentence, clause, phrase or word of this
Ordinance be declared unconstitutional or invalid for any reason, the remainder of
his Ordinance shall not be affected thereby.
SECTION 6. THAT the City Secretary is hereby authorized to cause publica ...
ion of the descriptive caption of this Ordinance as an alternative method provided
y law.
SECTION 7. THAT an emergency exists as shown in the preamble to this
Ordinance and the enactment of this Ordinance is declared to be an emergency
easure thereby creating a public necessity that the rule requiring proposed
rdinances to be presented at two (2) separate Council meetings be dispensed with
nd this Ordinance shall be effective from the date of its passage.
