HomeMy WebLinkAboutOrdinance - 5831-1970 - Speed Limit Change-Ave L And Ave H - 02/26/1970GSL:sw ORDINANCE NO. 5831 AN ORDINANCE AUTHORIZING THE ALTERING AND CHANGING OF THE PRIMA FACIE SPEED LIMIT FOR ALL VEHICLES ON THE FOLLOWING STREETS IN THE CORPORATE LIMITS OF THE CITY OF LUBBOCK, LUBBOC COUNTY~ TEXAS, TO-WIT: A 35 MPH SPEED ZONE ON BOTH SIDES OF A VENUE L BETWEEN 34TH STREET AND 50TH STREET: AND A 40 MPH SPEED ZONE ON BOTH SIDES OF A VENUE H BETWEEN 34TH STREET AND THE TRAFFIC CIRCLE {SOUTH}: AUTHORIZING THE PLACING OF SPEED LIMIT SIGNS; PRESCRIBING A PENALTY; PROVIDING FOR PUBLICATION; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING THAT STREETS OR HIGHWAYS NOT SPECIFICALLY SET FORTH HEREIN SHALL NOT BE AFFECTED BY THE PROVISIONS HEREOF AND THAT THIS ORDINAN SHALL BE CUMULATIVE OF ALL OTHER PRIMA FACIE SPEED LIMIT OR- DINANCES EXCEPT THOSE WITH WHICH IT SPECIFICALLY CONFLICTS; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the governing bp-dy of the City of Lubbock. as authorized by Article 6701d, Section 169(b) Vernon's Texas Civil Statutes, finds that certain prima facie speed limits on certain highways are different from what is reason- able or safe and should be altered as hereinafter set forth, NOW THEREFORE; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. The prima facie speed limit established by Article 6701d, Section 166 (a)(l)--Vernon's Texas Civil Statutes is altere-d and changed for all vehicles on the following designated highways or streets in the corporate limits of the City of Lubbock, Lubbock County, Texas: A 35 MPH Speed Zone on both sides of Avenue L between 34th Street and 50th Street. A 40 MPH Speed Zone on both sides of Avenue H between 34th Street and the Traffic Circle (South). SECTION 2. The City Manager is authorized and directed to cause the placing of signs so as to clearly define the limits of the prima facie areas set out in this Ordinance. SECTION 3. Any person, firm, or corporation violating the prima facie speed limit established by this Ordinance shall upon conviction be fined any sum not to exceed TWO HUNDRED ($200. 00) DOLLARS. SECTION 4. The City Secretary is authorized and directed to cause the publication of the descriptive caption of this Ordinance together with the penalty as an alternative method of publication as provided by law. -==~-~.J'':-U-.=====--======--------=---====--========---------=---===---t--•~ ~· ... SECTION 5. That all ordinances or parts of ordinances conflicting with the preceding sections hereof shall not be affected by the provisions hereof, and this Ordinance shall be cumulative of all other prima facie speed limit ordinances except those with which it specifically conflicts. SECTION 6. That all highways or streets not specifically set forth in the preceding sections hereof shall not be affected by the pro:visions hereof, and this Ordinance shall be cumulative of all other prima facie speed limit ordinance except those with which it specifically conflicts. SECTION 7. Should any section, paragraph, sentence, clause, phrase, o word of this Ordinance be declared unconstitutional or invalid for any reason the remainder of this Ordinance shall not be affected thereby. SECTION 8. This Ordinance shall become effective ten (10) days after the date of its last publication. AND IT IS SO ORDERED.
