First Reading November 16, 1995 Item #30 . ·Voi. 5038PAGE .55 Second Reading 36411. file Amt R•tUfft '• Ed Bucy R-0-W • December 7, 1995 Item #23 ORDINANCE NO. 9860 AN ORDINANCE ABANDONING AND CLOSING PORTIONS OF A DRAINAGE EASEMENT LOCATED IN SECTION 13, BLOCK E-2, LUBBOCK COUNTY, TEXAS, AND .MORE PARTICULARLY DESCRIBED IN THE BODY OF 1HIS ORDINANCE; UIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; ·PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that those portions of the drainage easement as ,hereinafter described in the body of this Ordinance are no longer needed for public use and it would be in the public interest to close, vacate and abandon the same; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT those portions of the drainage easement as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for easement purposes and for public use, and being more particularly described as follows: METES AND BOUNDS DESCRIPTIONS of a portion of a 20 foot drainage easement to be closed and abandoned, located in Section 13, Block E-2, Lubbock, Lubbock County, Texas, as recorded in Volume 1985, Page 447 of the Deed Records of Lubbock County, Texas, being further described as follows: BEGINNING at a point which bears N. 00°01'50" W., a distance of 806.00 feet and S. 89°58'10" W., a distance of 423.24 feet from the Southeast comer of the Northeast quarter of Section 13, Block E-2, Lubbock, Lubbock County, Texas; THENCE S. 89°58'10" W., a distance of216.76 feet to a point; THENCE N. 00°01'10" E., a distance of20.00 feet to a point; THENCE N. 89°58'50" E., a distance of233.56 feet to a point; THENCE S. 40° W., a distance of 26.12 feet to the POINT OF BEGINNING. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of ' this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this 1 : Ordinance shall not be affected t:hereby. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
