Home My WebLink AboutOrdinance - 9856-1995 - Zone Case 2164-F Zoning Change From A-1 To A-2 Zoning On A Tract Out Section 13 - 11/09/1995First Reading November 9, 1995 Item 139 Second Reading November 16, 1995 Item #27 ORDINANCE NO. 9856 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CAE NO. 2164-F; A ZONING CHANGE FROM A-1 TO A-2 ZONING ON A TRACT 0 OF SECTION 13, BLOCK E-2, LUBBOCK, TEXAS; SUBJECT TO CONDITIO S; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND· PROVIDIN FOR PUBLICATION. REAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the-City Council found that due to changed conditions, t would be expedient and in the interest of the public health, safety and general welfare to e those proposed changes in zoning; and REAS, all conditions precedent required by law for a valid amendment to the Zoning Or inance and Map have been fully complied with, including giving notices in compliance 'th Section 29-29 of the Code of Ordinances, City of Lubbock, Texas, and the notices prov ded by the Texas Local Government Code §211.007 (V emon, 1990), and notice was duly publis din the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public h acing before the City Council on such proposed amendment, and the public hearing according said notice, was held in the City Council Chamber of the Municipal Building, Lubbock, T xas, at which time persons appeared in support of the proposal; and after said hearing, it by the City Council determined that it would be in the public interest, due to changed co ditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter et forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: D BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 2164-F SEC ON 1. THAT Ordinance No. 7084 and the Official Zoning Map are amended as follows: A c ange of zoning under the provisions of Section 29-29 of the Code of Ordi ces of the City of Lubbock from A-1 to A-2 zoning district on a tract out f Section 13, Block E-2, City of Lubbock, Lubbock County, Texas, loca d South of 86th Street and East of Boston Avenue, subject to conditions and eing further described as follows: ME ES AND BOUNDS DESCRIPTION of a 3.63 acre tract of land located in S tion 13, Block E-2, Lubbock, Lubbock County, Texas, being further desc 'bed as follows: INNING at the Northwest comer of this tract which bears S. 00°01'50" distance of 1350.00 feet and S. 89°58'10" W., a distance of 790.00 feet the Northeast comer of Section 13, Block E-2, Lubbock, Lubbock ty, Texas; I THENCE N. 89°58'10" E., a distance of 330.00 feet to a point for the Northeast corner of this tract; THENCE S. 00°01 '50" E., a distance of 478.59 feet to a point for the Southeast corner of this tract; THENCE S. 89°58' 1 0" W., a distance of 341.34 feet to a poi· t of intersection for the Southwest corner of this tract; I THENCE Northeasterly around a curve to the left, said curv having a radius of 71.00 feet, a central angle of 32°50' 14", tangent lengths of 0.92 feet, and a chord distance of 40.14 feet to a point of tangency; THENCE N. 00°01 "50" W., a distance of 440.09 feet to the POINT OF BEGINNING. THAT violation of any provisions of this O~dinance shall be deemed a misdemeanor punishable by a fme not to exceed Two Thousand and No/1 00 Dollars ($2,000.00) as provided in Section 29-31 of the Zoning Ordinance of the City of~ubbock. SECTION 3. THAT should any paragraph, sentence, cla~se, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. 1 1 SECTION 4.
