TEXAS; P~OVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING 1! 1 FOR PUBLfCATION. WH~REAS, the proposed changes in zoning as hereinafter made have been duly' presented t the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that due to changed: conditio;j, • t would be expedient and in the interest of the public health, safety and general! welfare to ake those proposed changes in zoning; and REAS, all conditions precedent required by law for a valid amendment to the Zoning Orr· ce and Map have been fully complied with, including giving notices in compliance 'th Section 29-29 of the Code of Ordinances, City of Lubbock, Texas, and the notices pro ded by the Texas Local Government Code §211.007 (Vernon, 1990), and notice was, duly published in the Lubbock A valanche-Jouroal more than fifteen (15) days prior to the date of the public h aring before the City Council on the proposed amendment, and the public hearing according to said notice, was duly held in the City Council Chamber of the Municipal Building, • Lubbock, T xas, at which time persons appeared in support of the proposal; and, after said • hearing, it as determined by the City Council that it would be in the public interest, due to changed co ditions, that the Zoning Ordinance and the Zoning Map be amended in the manner , hereinafter . t forth in the body of this Ordinance and this Ordinance having been introduced , prior to first ~eading hereof; NOW THEREFORE: BE IT ORD~ED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: I ZONE CASE NO. 2764 SEC~ON 1. THAT Ordinance No. 7084 and the Official Zoning Map are amended as follows: · A cJnge of zoning under the provisions of Section 29-24(c)(2) of the Code of Ordinances of the City of Lubbock from R-1 to R-1 Specific Use for garden hom~s on a tract out of Section 27, Block E-2, City of Lubbock, Lubbock County, Tex~, located West of Albany Avenue between 69th and 72nd Streets, and being furth¢r described as follows: I ME'f'k.s AND BOUNDS DESCRIPTION for the plat limits of Lots 199-223, Re~gton Park Addition to the City of Lubbock, Lubbock County, Texas, being furth~r described as follows: BEG Gat a 112" rod with cap set in the West right-of-way line of Albany Aven e which bears N. 89°54' W., a distance of 1289.40 feet and S. 00°01'30" W., a distance of986.50 feet from the Northeast comer of Section 27, Block E-2, Lubb ck, Lubbock County, Texas; I' i I TIIENCE Southwesterly, along the West right-of-way line of Albany Avenue, M~~d a curve to the left, said curve having a radius of 334.70 feet, a central angle of 35°25'55", tangent lengths of 106.92 feet and a chord distance of 203.70 feet ~o a 1/2" rod with cap found; I rntcE S. 89°58'30" E., a distance of30.00 feet to a 3/8" rod found; THENCE S. 00°01'30" W., at 1.30 feet pass the Northwest comer of the plat limits of Ranch Acres Addition to the City of Lubbock, continuing for a total distance of 1265.93 feet to a railroad spike found in the North right-of-way line of 73r~ Street; -rJNCE N. 89°54' W., along said North right-of-way line, a distance of 26.00 feet fo a 1/2" rod found at a point of intersection; I TIIENCE Southwesterly, along said North right-of-way line, around a curve to the tight, said curve having a radius of 15.00 feet, a central angle of 90°, tangent lengtlls of 15.00 feet and a chord distance of21.21 feet to a 1/2" rod with cap set for a: point of tangency; I THENCE N. 89°54' W., along said North right-of-way line, a distance of 4.00 feet to a 112" rod with cap set for a point of intersection; THENcE Northeasterly around a curve to the left, said curve having a radius of 15.00 feet, a central angle of90°04'30", tangent lengths of 15.02 feet and a chord distahce of 21.23 feet to a 1/2" rod with cap set for a point of tangency; I THENCE N. 00°01'30" E., a distance of215.01 feet to a 1/2" rod with cap set; i THENCE N. 44°56'15" W., a distance of 14.15 feet to a 1/2" rod with cap set; ! THE~'CE N. 89°54' W., a distance of 121.73 feet to a 1/2" rod with cap set; THENCE N. 00°06' E., a distance of 1235.00 feet to a 1/2" rod with cap set; THEkCE S. 89°54' E., a distance of 192.10 feet to the POINT OF BEGINNING. I SECTION 2. THAT the granting of this specific use zoning is hereby made subject to compliance to all provisions of Zoning Ordinance No. 7084, as amended, including particularly, but not limited to, Section 29-24 of the Codified Zoning Ordinance, which provides that a Building PeQ:nit shall be applied for and secured within thirty (30) months of the effective date of the zone change or all undeveloped property shall automatically revert back to the previous zoning class~fication, which in this case is the R-1 zone district; and if such reversion occurs, the Director of Planning is directed to remove from the Zoning Map the legend indicating such specific use.j The Specific Use authorized by this Ordinance is permitted under provision of Section 29-24(c)(2) of Codified Zoning Ordinance No. 7084 on the property described as a tract out of Sectiof 27, Block E-2, City of Lubbock, Lubbock County, Texas. SECTION 3. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fme not to exceed Two Thousand and Noll 00 Dollars ($2,000.00) as provided i Section 29-31 of the Zoning Ordinance of the City of Lubbock. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not bel affected thereby. I SEdTION 5. THAT the City Secretary is hereby authorized to cause publication of the descriptive paption of this Ordinance as an alternative method provided by law. I AND IT IS so ORDERED.
