I AN o1ruiNANCE AMENDING SECTIONS 27-18 AND 27-20 OF THE CODE OF
ORDINANCfS OF THE CITY OF LUBBOCK, TEXAS, Willi REGARD TO ISSUANCE OF
A CHAUFFEUR'S LICENSE BY 1HE CITY OF LUBBOCK; PROVIDING A PENALTY;
PROVIDIN9 A SAVINGS CLApSE; AND PROVIDING FOR PUBLICATION.
WHEREAS, the Texas Department of Public Safety has interpreted its policy with regard ,
1 to computer *cess to criminal histories to preclude the City of Lubbock Police Department from I accessing criminal histories for purposes other than criminal justice; and
. WHEbAs, the City Council of the City of Lubbock deems it to be in the best interest of
I the health, safety and welfare of the citizens of the City of Lubbock to amend the Code of

Ordinances o.r the City of Lubbock to reflect such changes in policy interpretation by the Texas
Department of Public Safety; NOW THEREFORE:
l i BE IT ORD~D BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:

SECtiON 1. THAT Section 27-18 of the Code of Ordinances, City of Lubbock, Texas, is
hereby amenaed to read as follows:
Sec. J7-18. State license, criminal history records information.

I No person shall be issued a city chauffeur's license unless he first produces a
valid/chauffeur's license issued to him by the State of Texas and a criminal history
recoras information check issued by the Texas Department of Public Safety to the I applifant within thirty (30) days prior to the date of the application.
11 S~ON 2. TIIA T Section 27-20 of the Code of Ordinances, City of Lubbock, Texas, is II hereby ame~ded to read as follows:
j Sec. ~7-20. Fingerprint check. I . ' I . The fingerprints of each applicant for a city chauffeur's license under this

article shall be checked through local police records and the applicant shall furni~h to the police department a copy of the criminal history record check issued
by ~e Texas Department of Public Safety required by section 27-18 of this article.
I SEC~ ON 3. Violation of any provision of this Ordinance shall be deemed a
misdemeanor punishable by a fine not to exceed five hundred dollars ($500.00).
SEC~ ON 4. TIIA T should any paragraph, section, sentence, phrase, clause or word of
this .ordina.tlce be declared unconstitutional or invalid for any reason, the remainder of this
Ordinance spall not be affected thereby. ·

SEC'jriON 5. THAT the City Secretary is hereby authorized and directed to cause ·
publication ~f the descriptive caption of this Ordinance as an alternative method of publication
provided by !law.
