HomeMy WebLinkAboutOrdinance - 5823-1970 - Code Of Ordinance Amendment To Chapter 19 By Adding 20, 20.1, 20.2, 20.3. - 02/12/1970u - ORDJNANCE NO. 5823 ------ AN ORDINANCE AMENDJNG CHAPTER 19 OF THE CODE OF ORDlNAN- CES OF THE CITY OF LUBBOCK, TEXAS, BY ADDING THERETO SECTION 19- 20 ENTITLED "SODOMY" AND PROVIDING FOR AN OFFENSE OF SODOMY;BY ADDlNG THERETO SECTION 19-20.1 ENTITLED 11PUBLIC SOLICITATION FOR CONSENSUAL SODOMY" AND PROVIDING FOR AN OFFENSE OF PUBLIC SO- LICITATION FOR PURPOSES OF CONSENSUAL SODOMY; BY ADDING THERETO SECTION 19-20. 2 ENTITLED 11PUBLIC PLACE" AND DEFINING SAME; BY ADDING THERETO SECTION 19-20. 3 PROVIDING ' A PENALTY: PROVIDING FO PUBLICATION AND DECLARING AN EMERGENCY. WHEREAS, the City Council finds that the need to provide for prevention of offenses stated hereinbelow constitutes an emergency; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Chapter 19 of the Code of Ordinances of the City of Lubbock, Texas, BE and is hereby amended by adding thereto Sections 19-20, 19-20, 1, 19-20. 2, and 19-20. 3, which shall hereafter read as follows: 11sec. 19-20. Sodomy Whosoever, in a Public Place, has carnal copulation in an opening of the body, except sexual parts, with another human being, or whosoever shall use his mouth on the sexual parts of another human being for the purpose of having carnal copulation shall be guilty of sodomy, which is hereby declared to be illegal and a misdemeanor, Se. 19-20. 1, Public Solicitation for Consensual Sodomy Whosoever shall, in any Public Place, solicit another to engage in the act of sodomy as defined in this Chapter shall be guilty of public solicitation for consensual sodomy. Sec. 19-20. 2. Public Place Public Place for purposes of Sec, 19-20 and Sec. 19-20. 1, means any place where the conduct may reasonably be expected to be viewed by others. Sec. 19-20. 3. Penalty Any person who violates any provisions of this Ordinance shall be deemed guilty of a misdemeanor, and upon con- viction, shall be punished by a fine not less that $100. 00 not to exceed $200. 00, Each separate violation shall be treated as a separate offense. V SECTION 2. Should any section, paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be effected thereby. SECTION 3. The City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this ordinance, together with the penalty provision as an alternative method of publication as provided by law. SECTION 4. THAT the need to provide for prevention of the offenses stated herein creates a necessity to declare this an emergency measure and the rule providing that proposed Ordinances be presented at two (2) separate meetings is disposed with and this Ordinance is hereby declared to be an emergency measure to take effect from and after its passage.
