ORDINANCE NO. 5821
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 AND THE
OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWIN
CHANGE: ZONE CASE NO. 1643: CHANGE TRACT A1 TRACT B AND TRACT

RESPECTIVELY; SUBJECT TO CONDITIONS; PROVIDING A SAVINGS:CLAUSE
AND PROVIDING FOR PUBLICATION.
WHEREAS. the proposed change in zoning districts as hereinafter made
has been duly presented to the Zoning and Planning Commission for its recom-
mendation, which was received by the City Council and after due consideration,
the City Council finds that making the proposed change as hereinafter set out
will be in the public interest; and,
WHEREAS, all conditions precedent required by law for a valid amend-
ment to the Zoning Ordinance and Map have been fully com plied with, as well
as giving notices in compliance with Section 20 of Ordinance No. 1695 as well as
notices provided by Article lOllf, Vernon rs Annotated Civil Statutes, amended
in 19 61, and notice was duly published in the Lubbock Morning Avalanche
Journal more than fifteen (15) days prior to the date of the public hearing before
the City Council on such proposed amendment, and the public hearing according
to said notice was duly held in the City Council Room on the second floor of the
City Hall, Lubbock, Texas, at which time persons appeared in support of the
proposal; and, after said hearing, it was by the City Council determined that
it would be in the public interest, due to changed conditions, that the Zoning
Ordinance and the Zoning Map be amended in the manner hereinafter set forth
in the body of this Ordinance and this Ordinance having been introduced prior to
first reading hereof; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map of th
City of Lubbock BE and are hereby amended as follows, to-wit:
ZONE CASE NO. 1643
The following tracts of land, all situated within Melonie
Park South Addition, City of Lubbock, Lubbock County,
Texas, and shown on a preliminary plat thereof, are hereby
changed from "R-1 11 Single Family District, to the use
dis,trict and zone classification shown below, subject to
conditions:
A. Tract A -change from 11R-111 to "C-311 General
Retail District.
B. Tract B -change from "R-1 11 to "A-1" First
Apartment District,

C. Tract D .-change from "R-111 to "C-2"
Local Retail District.
SUBJECT TO CONDITIONS:
1. That 3 square foot of paved off-street parking area
be provided for each square foot of total building area.
2. That a 6 foot high permanent-type solid screening
fence of wooden or masonry construction be erected and
permanently maintained along the South Property Line
of Tract D. Said fence shall be erected prior to or con-
currently with the first building permit on Tract D. The
fence shall be sloped or slanted from a point 25 feet from
Indiana Avenue to a height of 2 1/2 feet at Indiana Avenue.
3. That a 43 foot building setback line from Indiana Avenue
and Loop 289 be observed on Tract D.
4. That a 60 foot building setback line from all adjacent
streets be observed on Tract A,, except as to service stations
on said tract, a 30 foot setback shall be observed.
SECTION 2. THAT from and after passage and effective date of this
Ordinance, said lots, tracts and parcels of land described in Section 1 hereof
shall be changed to the zoning district indicated and the Official Map is amended
in accordance herewith.
SECTION 3. Should any section, paragraph, sentence clause. phrase or
word of this Ordinance be declared unconstitutional or invalid for any reason,
the remainder of this Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary is hereby authorized to cause pub-
lication of the descriptive caption of this Ordinance as an alternative method pro
vided by law.
