WEEN QUIRT AVENUE, SOUTHEAST DRIVE AND SLATON ROAD FROM 11M-l11 0 11M ... 211 ZONING DISTRICT; CHANGE TRACTS OF LAND SITUATED IN SEC- ION 3, BLO CKS, LUBBOCK COUNTY, TEXAS FROM "R-111 TO 11M-l" ZONING !STRICT: PROVIDING A SAVINGS CLAUSE AND PROVIDING F OR PUBLICATION WHEREAS, the proposed change in zoning districts as hereinafter made has een duly presented to the Zoning and Planning Commission for its recommendatio hich was received by the City Council and, after due consideration, the City ouncil finds that making the proposed change as hereinafter set out will be in the ublic interest; and, WHEREAS, all conditions precedent required by law for a valid amendment to he Zoning Ordinance and Map have been fully complied with, as well as giving otices in compliance with Section 20 of Ordinance No. 1695 as well as notices pro- ided by Article 1011£, Vernon's Annotated Civil Statutes, amended in 1961, and otice was duly published in the Lubbock Morning Avalanche Journal more than fif ... een {15) days prior to the date of the public hearing before the City Council on such reposed amendment, and the public hearing according to said notice was duly held the City Council Room on the second floor of the City Hall, Lubbock, Texas at hich time persons appeared in support of the proposal; and, after said hearing, it as by the City Council determined that it would be in the public interest, due to hanged conditions, that the Zoning Ordinance and the Zoning Map be am.ended in he manner hereinafter set forth in the body of this Ordinance and this Ordinance aving been introduced prior to first reading hereof; NOW THEREFORE: E IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: • SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map of the City of Lubbock BE and the same are hereby amended as follows, to--wit: A. /B. I: c. D. The use district and zone classification of the following tract of land is hereby changed from uM-111 to "M-2" zoning district: A tract of land situated bet ween North Avenue T and North Avenue U and Harvard Street and Marshall Street; The East 150 feet of Lots 3 and 3A, Gifford Hill Addition and a tract of land 300 feet East-West by 244. 82 feet North ... South at the Southwest corner of Marshall Street and North Avenue U. The use district and zone classification of the following tract of land is hereby changed from "M-211 to "M-1" zoning district: BEGINNING at a point at the Northeast corner of Lot lJ Block 3~ Burlington Industrial Addition No. 2, City of Lubbock, Lubbock County, Texas; THENCE North 588. 92 feet; THENCE West 295 feet; THENCE North 984. 75 feet; THENCE West 575. 7 feet; THENCE North 55 feet; THENCE West 215. 17 feet; THENCE South 136 feet; THENCE West 300 feet; THENCE South 558.1 feet; THENCE West 524. 42 feet; THENCE South 909. 57 feet; THENCE East 1707. 8 feet to the PLACE OF BEGINNING • The use district and zone classification of the following tract of land is hereby changed from 11M-l 11 to "M-211 zoning district: BEGINNING at the intersection of Loop 289 and Quirt Avenue; THENCE North along the East ROW line of Quirt Avenue to a poin1 even with the South line of East 58th Street; THENCE East 1046 feet; THENCE South to a point even with the South line of East 66th Street; THENCE East 8213. 68 feet to a point in the ROW line of Southeast Drive; THENCE Southeast along the westernmost side of Southeast Drive to a point in the West ROW line of Peach Avenue; THENCE South to the North ROW line of Slaton Road; THENCE Northwesterly along Slaton Road to the PLACE OF BEGINNING. 2 E. The use district and zone classification of the following tracts of lan are hereby changed from "R-11' to "M ... 1" zoning district: All that certain tract of land situated in Section 3, Block S, South of Slaton Road, which is presently zoned "R ... 111 ; plus a 150 foot strip of land extending South from said Section 3, Block S, Lubbock Coun , Texas. SECTION 2. THAT from and after passage and effective date of this Ordi- ance, said lots, tracts and parcels of land described in Section 1 hereof shall be hanged to the zoning district indicated and the Official Map is amended in ccordance herewith. SECTION 3. Should any section, paragraph, sentence, clause, phrase, or ord of this Ordinance be declared unconstitutional or invalid for any reason, the emainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publica ion of the descriptive caption of this Ordinance as an alternative method provided y law.
