HomeMy WebLinkAboutOrdinance - 5814-1970 - Zone Change - Case 1429A, Two Tracts, Section 4, Blk E, Lbk Co. - 01/28/1970/ KJ:sw ORDINANC.B NO. 5814 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 5412 OF THE CITY OF LUBBOC}{ COVERING ZONE CASE NO. 1429A WHICH COVERED TWO TRACT OF LAND OUT OF SECTION 4, BLOCK E.t LlJBBOCK COUNTY., TEXAS~ BY AMENDING THE CONDITION MADE A PART THEREOF GOVERNING BUILDING SET BACK LINES; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUB- LICATION. WHEREAS, the City Council finds that after all notices have been given and hearings held as provided by law, that it is in the best interest of the citizens of the City of Lubbock to make the change in the zoning law as hereinafter set forth; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Zoning Ordinance No. 5412 of the City of Lubbock BE and is hereby amended so that condition No. 2 made a part thereof shall read as follows: "2. That a 40f building set back line shall be observed from 70th Street on both the North and the South side of such street~ EXCEPT, however, a 15r building set back line shall be ob- served from 70th Street, on the South side of such street, for a distance of 1801 from University Avenue. As to the unplatted portion of this property, the building set back line from 7oth Street shall be observed for a distance of 150 t from University Avenue at such time as this property is platted. Such building set back lines shall be as shown on the site plan including this amendment. 11 SECTION 2. THAT the remaining conditions stated in Ordinance No. 5412 hall remain in full force and effect. SECTION 3. Should any section, paragraph, sentence clause, phrase or ord of this Ordinance be declared unconstitutional or invalid for any reason, the emainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause pub- ication of the descriptive caption of this Ordinance as an a]ernative method pro- 'ded by law. Fred O. (This distance shall be 150 feet when the property is platted.) If zone chang~ is approved, pass ordinance on first reading. ZONE CASE NO. 1429B -This application is~ request to delete a setback along 70th Street as imposed by the original zoning; specifically, it applies to a proposed service station at the Southeast corner of 70th Street and University Avenue. The Planning and Zoning Commission has recommended that the original setback requirement of 40 feet be modified, for the ser':'ice station site only, so as to require only a 15 foot setback from 70th Street. The original 40 foot setback line from 70th Street was established as a part of the original zone case which was strongly opposed by residents of the area, the 70 foot setback was established to provide some relief from the commercial activities along 70th Street, which is the entrance to the residential area to the East. While the setback on the service station affects only a small portion of the property it will have the effect of reducing visibility on the approach to the University Avenue intersection from the East,· I •
