AN ORDINANCE AM;ENDING ZONING ORDINANCE NO. 1695 AND
THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE
FOLLOWING CHANGE: ZONE CASE NO. 1431: CHANGE LOTS 1 THRU
12~ BLOCK 58; LOTS 13 THRU 15~ BLOCK 59; T .o'J.'S 9 THRU 12~ BLOCK
60, OVERTON ADDITION, CITY OF LUBBOC~ LUBBOCK COUNTY,
TEXAS41 FROM AN uR ... 211TO AN "R-3" ZONING DISTRICT. SUBJECT TO
CONDITIONS.
WHEREAS, the proposed change in zoning districts as hereinafter
made has been duly presented to the Zoning and Planning Commission for
its recommendation, which was received by the City Council and after due
consideratio~ the City Council finds that making the proposed change
as hereinafter set out will be in the public interest; and,
WHEREAS, all conditions precedent required by law for a valid
amendment to the Zoning Ordinance and Map have been fully complied
with~ as well as giving notices in c ompliance with Section 20 of Ordinance
No. 1695 as well as notices provided by Article lOllf~ Vernon's Annotated
Civil Statutes, amended in 1961~ and notice was dul.y published in the
I.,rubbock Morning Avalanche Journal more than fifteen (15) days prior to
the date of the public hearing before the City Council on such proposed
amendment, and the public hearing according to said notice was dul.y
held in the City Council Room on the second floor of the City Hall, Lub-
bock, Texas, at which time persons appeared in support of the proposal;
and, after said hearin& it was by the City Council determined that it
would be in the public interest, due to changed conditions, that the
Zoning Ordinance and the Zoning Map be amended in the manner herein""
after set forth in the body of this Ordinance and this Ordinance having
been introduced prior to first readi ng hereof; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. .TIIAT Ordinance No. 1695 and the official Zoning
Map BE and the same are hereby amended as follows, to-wit:
ZONE CASE NO. 1431
Change Lots 1 thru 12, Block 58; Lots 13 thru 15, Block 59;
Lots 9 thru 12, Block 60, Overton Additio~ C ity of Lubbock,
Lubbock County,, Texas from an 11R-2'~ to an 11R-311 Zoning
Distric t,
SUBJECT TO TilE FOLLOWING CONDITIONS:
l. That de:velopment be limited to apartments only.
2. That a minimum of lOOOsquare feet of lot area be pro-
vided for each apartment unit.
3. That 11/2 paved off ... street parking spaces be provided
for each one bedroom apartment unit and that two s uch
parking spaces be provided for each unit with two or
more bedrooms.
4. Developer shall.,at no cost to the city., provide lateral sewer
connections to the nearest trunk line which is determined by the
City Engineer to have adequate capacity to serve existing and
projected future users.
SECTION 2. THAT from and after passage and ef:rective date of this
Ordinance said lots., tracts and parcels and l and described in Section 1 hereof
shall be changed to the zoning district indicated and the Official Map is
amended in accordance herewith.
AND IT IS SO ORDERED
