FROM AN "R-lf' TO AN "R-311 ZONING DISTRl T:. SUBJECT TO CONDITIONS. WHEREAS# the proposed change in zoning districts as hereinafter made has been duly presented to the Zoning and Planning Commission for its recommendation which was received by the City Council and after due consideration, the City Counc · finds that making the proposed change as hereinafter set out will be in the public interest; and, WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 20 of Ordinance No. 1695 as well as notices pro- vided by Article lOllf, Vernonts Annotated Civil Statutes, amended in 1961., and notice was duly published in the Lubbock Morning Avalanche Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment~ and the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in th manner hereinafter set forth in the body of this Ordinance and this Ordinance havin been introduced prior to first reading hereof; NOW., THEREFORE._ BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: ZONE CASE NO~ 1332-A Change a tract of land out of Section 4, Block E-2, Lubbock County, Texas, from an "R-1" to an 11R-3" Zoning District, said tract being described by metes and bounds as follows: BEGINNING at a point 60~ south and 401 west of the NE Corner of Section 4, Block E-21 Lubbock County, Texas; THENCE S. 801. 9 4t :1:-to a point; THENCE W. 645t i' to a point; THENCE N. 801. 94t ±to a point; THENCE E. 645' ±to the PLACE OF BEGINNING. SAVE and except, however, a 20Qt x 20ot tract at the NE corner of the described property; SUBJECT TO THE FOLLOWING CONDITIONS: 1. That development be limited to apartments only. 2. That a minimum of 1500 square feet of lot area and 1 1/2 paved off- street parking spaces be provided for each apartment unit. 3. That driveway openings shall be limited to two on Slide Road and two on 4th St. 4. That a st solid permanent type screening fence shall be erected and permanently maintained along the south and west property lines, includin the cul-de-sac on 6th Street. No openings shall be allowed. 5. A 61· masonry fence shall be erected and permanently maintained along the south and west sides of the 200r x 200t tract, under separate owner- ship in the NE Corner. 6. The user of the property herein shall place garbage and refuse in adequate City approved 11Dumpmaster11 type containers at such locations as may be specified by the Department of Sanitati~n and shall permit access to sanitation trucks for the removal of such refuse. SECTION 2. THAT from and after passage and effective date of this Ordinanc ~ said lots, tracts and parcels of land described in Section 1 hereof shall be changed to the zoning district indicated and the Official Map is amended in accordance here with.
