AN ORDINANCE AMENDING ZONING ORDINANCE NO •. 1695 AND THE
OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING
CHANGE: ZONE CASE NO,. 1408: CHANGE CONDITIONS IMPOSED BY ORDI-
NANCE NO,., 4139 ON LOT 82. DRURY PARK ADDITION SO AS TO ALLOW SERw
VICE STATIONS TO BE BUILT WITHOUT A SETBACK FROM QUAKER AVENUE ..
WHEREAS,. the proposed change in zoning districts as hereinafter made
has been duly presented to the Zoning and Planning Commission for its recom-
mendation,. which was received by the City Council and after due consideration.,
the City Council finds that making the proposed change as hereinafter set out will
be in the public interest; and.,
WHEREAS. all conditions precedent required by law for a valid amend-
ment to the Zoning Ordinance and Map have been fully complied with, as well as
giving notices in compliance with Section 20 of-Ordinance No. 1695 as well as
notices provided by Article 101 lf., Vernonts Annotated Civil Statutes., amended in
1961., and notice was du!y published in the Lubbock Morning Avalanche Journal
more than fifteen {15) days prior to the date of the public hearing before the City
Council on such proposed amendment,. and the public hearing according to said
notice was duly held in the City Council Room on the second floor of the City Hall_.
Lubbock, Texas., at which time persons appeared in support of the proposal; and.,
after said hearing_. it was by the City Council determined that it would be in the
public interest., due to changed conditions., that the Zoning Ordinance and the
Zoning Map be amended in the manner hereinafter set forth in the body of this
Ordinance and this Ordinance having been introduced in final written form prior
to first reading hereof; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE
and the same are hereby amended as follows., to-wit:
ZONE CASE NO. 1408
Condition (1)., subsection 8B of Section 1 of Zoning Ordinance 4139., inso-
far as the same is applicable t o Lot 82., Drury Park Addition is hereby
amended to read as follows:
"(1) Minimum building setbacks as follows:
13ot from 50th Street
7or from Quaker Avenue_. except that a service station may be
constructed without a building setback.,
38t from Peoria Avenue
33t from the alley along the south property line. 11
Provided., however., this change in condition does not amend this
condition insofar as it is applicable to property other than is des-
cribed herein nor does this ordinance release Lot 82., Drury Park
Addition from the effect of other conditions imposed by Ordinance 4139.

SECTION 2. THAT from and after passage and effective date of this
Ordinance said lots~ tracts and parcels of land described in Section 1 hereof shall
be changed to the zoning district indicated and the Official Map is amended in
accordance he re with.
AND IT IS SO ORDERED.
