First Reading May 11, 1995 Item 1114 1.4442 File Anc:l Return To Ed Bucy R-0-W Second Reading May 25, 1995 Item /17 ORDINANCE NO. 9806 ----- AN ORDINANCE ABANDONING AND CLOSING PORTIONS OF A TRANS- MISSION ELECTRIC LINE EASEMENT LOCATED IN SECTIONS 15 & 78, BLOCK A, LUBBOCK, LUBBOCK COUNTY, TEXAS, AND RECORDED IN VOLUME 158, PAGE 592 OF THE DEED RECORDS OF LUBBOCK· COUNTY, TEXAS, AND MORE P ARTICU- LARL Y DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the easement portions as hereinafter described in I the body of this Ordinance are no longer needed for easement purposes and for public use and it would be in the public interest to close, vacate and abandon the same for purposes and for public use; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the easement portions as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for easement purposes and for public use, and being more particularly described as follows: TRACT! METES AND BOUNDS DESCRIPTION of an 18.535 acre tract located in Section 78, Block A, and Section 15, Block A, Lubbock, Lubbock County, Texas, being further described as follows: BEGINNING at a 112" iron rod with cap set in the West right-of-way line of North Texas A venue and the North right-of-way line of Tulane Street for the Southeast comer of this tract, which bearsS. 89°58' E., a distance of2200.44 feet and S. 00°07' W., a distance of338.14 feet from the Northwest comer Section 15, Block A, Lubbock, Lubbock County, Texas; THENCE N. 70°55' W., along the said North right-of-way line of Tulane Street, a distance of 817.91 feet to a 112" iron rod with cap set in the North right-of-way line of Loop 289 for a point of intersection; THENCE Northwesterly, along the said North right-of-way line of Loop 289, around a curve to the left, said curve having a radius of 3014.93 feet, at a distance of 204.19 feet pass a 112" iron rod with cap set in the North line of Section 15, Block A, and the South line of Section 78, Block A, said curve having a central angle of07°54'06", tangent lengths of208.22 feet, and a chord distance of 415.46 feet to a 112" iron rod with cap set in the East right-of-way line of North Avenue "M" for the Southwest comer of this tract; . . -.· . VOL 4870PAGE 66 THENCE N. 00°07' E., along the said East right-of-way line of North Avenue "M'', a distance of 495.65 feet to a 1/2" iron rod with cap set in the South right-of- way line of Wabash Street for the Northwest comer of this tract; THENCE S. 89°58' E., along the said South right-of-way line of Wabash Street, a distance of 1167.94 feet to a 112" iron rod with cap set in the West right-of-way line ofNorth Texas Avenue for the Northeast comer of.this tract; THENCE S. 00°07' W., along the said West right-of-way line of North Texas Avenue, at a distance of 555.55 feet pass a 112" iron rod with cap set in the South line of Section 78, Block A, and in the North line of Section 15, Block A, continuing for a total distance of893.69 feet to the POINT OF BEGINNING. TRACT2 METES AND BOUNDS DESCRIPTION of a 1.136 acre tract located in Section 15, Block A, Lubbock, Lubbock County, Texas, being further described as follows: BEGINNING at a railroad spike set in the South right-of-way line of Tulane Street for the most Easterly comer of this tract, which bears South a distance of 479.38 feet and East a distance of 2437.28 feet from the Northwest comer of Section 15, Block A, Lubbock, Lubbock County, Texas; THENCE S. 27°37' W., along the West line of Lot 3, Windswept Addition, a distance of 159.72 feet to a 112" iron rod found in the North right-of-way line of Loop 289 at the most Southerly comer of this tract; THENCE N. 56°10' W., along the said North right-of-way line of Loop 289, a distance of 477.40 feet to a 3/4" iron pipe found at a point of curvature; THENCE Northwesterly, around a curve to the left, said curve having a radius of 3014.93 feet, a central angle of 03°01'16", tangent lengths of 79.51 feet, and a chord distance of 158.96 feet to a 112" rod with cap set in the South right-of-way line of Tulane Street for the most Westerly comer of this tract; THENCE S. 70°55' E., along the said South right-of-way line of Tulane Street, a distance of640.10 feet to the POINT OF BEGINNING. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. -2- .
