First Reading April 27, 1995 Item #10 13820 ~· ARd Return To ; ·td Bucy R-0-W Second Reaclj.~ May 11; 1995'~~~ Item /16 ' -tR 4865ract158 ORDINANCE NO. 9795 AN ORDINANCE ABANDONING AND CLOSING PORTIONS OF A 15 FOOT ALLEY LOCATED IN BLOCK 50, ROBERTS AND McWHORTER ADDITION TO TilE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council flnds that the alley portions as hereinafter described in the body of this Ordinance are no longer needed for alley purposes and for public use; and WHEREAS, the City Council fmds it would be in the public interest to close, vacate and abandon the same for alley purposes and for public use; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the alley portions as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for alley purposes and for public use, and being more particularly described as follows: METES AND BOUNDS DESCRIPTION of a 15 foot alley to be abandoned and closed located in Block 50, Roberts & McWhorter Addition to the City of Lubbock, Lubbock County, Texas, being further described as follows: BEGINNING at a 3/811 rod found in the North right-of-way line of 1st Street and the Southwest comer of this alley, being the original Southeast comer of Lot 3, Judy Jane Addition, said rod bears East a distance of 5.00 feet from the original Southwest comer of Block 50, Roberts & McWhorter Addition; THENCE North, along the East line of Judy Jane Addition, at a distance of 250.00 feet pass a point for the common comer of Lots 2 and 3, Judy Jane Addition, at a distance of 300.00 feet pass a 3/8" iron rod found at the common comer of Lots 1 and 2, Judy Jane Addition, and continuing for a total distance of 600.00 feet to a point in the South right-of-way .line of Auburn Street for the Northeast comer of Lot 1, Judy Jane Addition and the Northwest comer of this alley; THENCE East, along the South right-of-way line of Auburn Street, a distance of 15.00 feet to a point for the Northeast comer of this alley; THENCE South, a distance of 600.00 feet to a 3/4" iron pipe found in the North right-of-way line of 1st Street at the Southeast comer of this alley; THENCE West, along the North right-of-way line of 1st Street, a distance of 15.00 feet to the POINT OF BEGINNING. .. .. .. ~ ~ i -~.., ·:.:;:.~:.---- <' SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
