Second Reading July 27, 1995 Item #21 49 ; i VOL 331'ACE ~88 ORDINANCE NO. 9794 AN ORDINANCE ABANDONING AND CLOSING PORTIONS OF 86TH STREET AND BOSTON BOULEVARD LOCATED IN SECTION 13, BLOCK E-2, LUBBOCK, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the street portions as hereinafter described in the body of this Ordinance are no longer needed for street purposes and for public use; and WHEREAS, the City Council fmds it would be in the public interest to close, vacate and abandon the same for street purposes and for public use; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the street portions as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for street purposes and for public use, and being more particularly described as follows: METES AND BOUNDS DESCRIPTION of portions of 86th Street and Boston Boulevard to be closed, located in Section 13, Block E-2, Lubbock, Lubbock County, Texas, and being further described as follows: BEGINNING at W' iron rod with cap which bearsS. 00°01 '50" E. a distance of 1240.00 feet and S. 89°58'10" W. a distance of 60.00 feet from the Northeast comer of Section 13, Block E-2, Lubbock, Lubbock County, Texas; THENCE Northwesterly around a curve to the left, said curve having a radius of 15.00 feet, a central angle of90°, tangent lengths of 15.00 feet, and a chord distance of 21.21 feet to a W' iron rod with cap located at a point of tangency; THENCE S. 89°58'10" W. a distance of700.00 feet to a W' iron rod with cap located at a point of curvature; THENCE Southwesterly around a curve to the left, said curve having a radius of 15.00 feet, a central angle of90°, tangent lengths of 15.00 feet, and a chord distance of21.21 feet to a W' iron rod with cap located at a point of tangency; THENCE S. 00°01 '50" E. a distance of 150.00 feet to a Yl" iron rod with cap; THENCE S. 89°58' 1 0" W. a distance of 40.00 feet to a Yl" iron rod with cap; THENCE Westerly around a curve to the left, said curve having a radius of 15.00 feet, a central angle of 180°, a chord bearing of S. 89°58'10" W., and a chord distance of 30.00 feet to a Yl" iron rod with cap; THENCE S. 89°58'10" W. a distance of 40.00 feet to a W' iron rod with cap; THENCE Northwesterly around a curve to the left, said curve having a radius of 15.00 feet, a central angle of90°, tangent lengths of 15.00 feet, and a chord distance of 21.21 feet to a W' iron rod with cap; II I THENCE N. 00°01 '50" W. a distance of 60.00 feet to a W' iron rod with cap; THENCE Northeasterly around a curve to the left, said curve having a radius of 15.00 feet, a central angle of90°, tangent lengths of 15.00 feet, and a chord distance of 21.21 feet to a W' iron rod with cap located at a point of tangency; THENCE N. 00°01 '50" W. a distance of200.00 feet to a W' iron rod with cap· located at a point of curvature; THENCE Northwesterly around a curve to the left, said curve having a radius .of 63.82 feet, a central angle of 45°, tangent lengths of26.44 feet, and a chord distance of 48.85 feet to a W' iron rod with cap located at a point of tangency; THENCE N. 45°01 '50" W. a distance of 474.41 feet to a ¥2" iron rod with cap located at a point of curvature; THENCE Northwesterly around a curve to the left, said curve having a radius of 15.00 feet, a central angle of 45°00'02", tangent lengths of 6.21 feet, and a chord distance of 11.48 feet to a W' iron rod with cap; THENCE N. 01°39'31" E. a distance of 40.02 feet; THENCE N. 89°58'08 E. a distance of69.55 feet to a railroad spike; THENCE Southeasterly around a curve to the left, said curve having a radius of 156.57 feet, a central angle of32°04'40", tangent lengths of 45.01 feet, and a chord distance of 86.52 feet to a W' iron rod with cap located at a point of tangency; THENCE S. 45°01 '50" E. a distance of 380.14 feet to a W' iron rod with cap located at a point of curvature; THENCE Southeasterly around a curve to the right, said curve having a radius of 113.82 feet, a central angle of 45°, tangent lengths of 47.15 feet, and a chord distance of 87.11 feet to a point of tangency; THENCE S. 00°01 '50" E. a distance of90.00 feet; THENCE N. 89°58'10" E. a distance of60.00 feet; THENCE Northeasterly around a curve to the right, said curve having a radius of 15.00 feet, a central angle of 90°, tangent lengths of 15.00 feet, and a chord distance of 21.21 feet to a point of tangency; THENCE N. 89°58'10" E. a distance of700.00 feet to a point of curvature; THENCE Southeasterly around a curve to the right, said curve having a radius of 15.00 feet, a central angle of90°, tangent lengths of 15.00 feet, and a chord distance of 21.21 feet to a point of tangency; THENCE S. 00°01 '50" a distance of 50.00 feet to the POINT OF BEGINNING. -2- .... • • VOL4933PAC£ \90 SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its fmal passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
