HomeMy WebLinkAboutOrdinance - 9792-1995 - Amending Chapter 29 Rear Yard In Regard To Garage Setback - 03/23/1995First Reading March 23, 1995 Item #26 Second.Reading April 13, 1995 Item #9 ORDINANCE NO. 9792 AN ORDINANCE AMENDING CHAPTER 29 OF THE CODE OF ORDINANCES, CITY OF LUBBOCK, TEXAS ENTITLED "ZONING", BY AMENDING THE DEFINITION OF "REAR YARD" IN REGARD TO GARAGE SETBACKS IN SECTION 29-7(f)(2) ENTilLED "R-1 SINGLE-FAMILY DISTRICr', SECTION 29-8(f)(2), ENTITLED "R-2 TWO-FAMILY DISTRICr', AND SECTION 29-24(2)(e) ENTITLED "SPECIFIC USE DISTRICT (TOWNHOUSE/GARDEN HOME) R-1 DISTRICT"; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Cooocil and, after due consideration, the City Cooocil finds that due to changed I conditions, it would be expedient and in the interest of the public health, safety and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 29-29 of the Code of Ordinances, City of Lubbock, Texas, as well as notices provided by Section 211.006(a), Texas Local Government Code, and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Cooocil on such proposed amendment, and the public hearing according to said notice was duly held in the City Cooocil Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Cooocil determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 29-7(f)(2) of the Code of Ordinances of the City of Lubbock, Texas, is hereby amended to read as follows: (2) Rear yard. The minimum rear yard shall be fifteen (15) feet except that a one-story wing or extension may be built to within five (5) feet of the rear lot line. However, if access to a garage or one-story carport is from an alley or access easement, the minimum setback shall be twenty (20) feet from garages, or five (5) feet for one-story carports not having solid side walls. Setback shall be measured from the property line if from an alley and/or from the easement line if from an access easement. SECTION 2. THAT Section 29-8(f)(2) of the Code of Ordinances of the City of Lubbock, Texas, is hereby amended to read as follows: (2) Rear yard. THAT Section 29-24(2)e of the Code of Ordinances, City of Lubbock, Texas, is hereby amended to read as follows: e. Rear yard. The minimum rear yard shall be five (5) feet for any one-story structure, and fifteen ( 15) feet for any two-story structure. However, if access to a garage or one-story carport is from an alley or access easement, the minimum setback shall be twenty (20) feet for garages, or five (5) feet for one-story carports not having solid side walls. Setback shall be measured from the property line if from an alley and/or from the easement line if from an access easement. SECTION 4. THAT should any section, paragraph, sentence, clause, phrase, or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 5. THAT the City Secretary is hereby authorized and directed to cause publication of the description caption of this Ordinance as an alternative method of publication provided by law.
