WHEREAS, the City Council finds that the as hereinafter descnoed in the body of this Ordinance is no longer needed for public use and it would be in the public interest to close, vacate and abandon the same; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the as hereinafter descnoed shall BE and the same is hereby closed, vacated and abandoned for easement purposes and for public use, such easement being more particularly descn"bed as follows: METES AND BOUNDS DESCRIPTION of a portion of a 20 foot alley to be closed, located in Block 1, Perkins Subdivision ofBlocks 17, 18, 19, 20 and 21, Roberts and McWhorter Addition to the City of Lubbock, Lubbock County, Texas, according to the map, plat and/or dedication deed thereof recorded m Volume 101, Page 376 of the Deed Records of Lubbock County, Texas, being further described as follows: BEGINNING at ~" iron rod found at the Southeast comer of Lot 8, Block 1, Perkins Subdivision ofBlocks 17, 18, 19, 20 and 21, Roberts and McWhorter Addition to the City of Lubbock, Lubbock County, Texas; THENCE South a distance of 20.00 feet to a %" iron rod with cap found at the Northeast comer ofLot 17, Block 1, Perkins Subdivision; THENCE West, along the South line of a 20.00 foot alley, a distance of534.30 feet to a point in the East right-of-way line of University Avenue from whence a cross cut on concrete bears South, a distance of 127.50 feet; THENCE North, along the East right-of-way line of University Avenue, a distance of20.00 feet to a point from whence a set concrete nail bears North a distance of 105.35 feet; THENCE East, along the North line of a 20 foot alley, a distance of534.30 feet to the POINT OF BEGINNING. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City ofLubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. voL 5116rAcE194 SECTION 3. THAT should any section, paraP.pb, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or mvalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City ofLubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
