I First Reading January 12, 1995 Item f/10 Second Reading· March 23, 1995 Item 117 FUe And Return To U lucy R-0-W ORDINANCE NO. 9771 ----- AN ORDINANCE ABANDONING AND CLOSING TWO PORTIONS OF A DRAINAGE EASEMENT AND ONE PORTION OF AN OVERFLOW EASEMENT LOCATED IN TRACT A, TREASURE ISLAND ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF TillS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that those portions of the drainage easement and overflow easement as hereinafter described in the body of this Ordinance are no longer needed for public use and it would be in the public interest to close, vacate and abandon the same; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION I. THAT those portions of the drainage easment and overflow easement as hereinafter described in three tracts shall BE and the same are hereby closed, vacated and abandoned for easement purposes and for public use, and being more particularly described as follows: TRACT I METES AND BOUNDS DESCRIPTION of a 30 foot drainage easement located in Tract A, Treasure Island Addition to the City of Lubbock, Lubbock County, Texas, being 15 feet either side of the following described centerline; BEGINNING at a point which bears East, a distance of 60.00 feet and South a distance of 823.30 feet from the Northwest comer of Section 4, Block E-2, Lubbock, Lubbock County, Texas; THENCE S. 86°30' E., a distance of 60.00 feet to a point of curvature; THENCE Northeasterly around a curve to the left, said curve having a radius of 165.50 feet, a central angle of 20°33' and tangent lengths of 30.00 feet; THENCE N. 72°57' E., a distance of 122.60 feet to a point of curvature; THENCE Northeasterly around a curve to the left, said curve having a radius of 83.20 feet, a central angle of 39°39' and tangent lengths of 30.00 feet; THENCE N. 33°18' E., a distance of 57.10 feet to a point of curvature; Wt4823PAG£ 84 THENCE Northeasterly around a curve to the left, said curve having a radius of265.20 feet, a central angle of 31 °25' and tangent lengths of 75.00 feet; THENCE N. 01 °53' E., a distance of 59.00 feet to a point for the end of the centerline. TBACT2 METES AND BOUNDS DESCRIPTION of a 30 foot drainage easement located in Tract A, Treasure Island Addition to the City of Lubbock, Lubbock County, Texas, being 15 feet either side of the follo\Ving described centerline; BEGINNING at a point which bears East, a distance of 1,019.80 feet and South a distance of 1,008.00 feet from the Northwest comer of Section 4, Block E-2, Lubbock, Lubbock County, Texas; THENCE Northwesterly around a curve to the right, said curve having a radius of 41.50 feet, a central angle of 39°41' and tangent lengths of 15.00 feet; THENCE N. 02°47' E., a distance of 40.60 feet to a point of curvature; THENCE Northeasterly around a curve to the right, said curve having a radius of 101.90 feet, a central angle of 18°24' and tangent lengths of 16.50 feet to a point of reverse curvature; THENCE Northwesterly around a curve to the left, said curve having a radius of 160.00 feet, a central angle of 41 °44' and tangent lengths of 61.00 feet to a point for the end of this centerline. TRACT3 METES AND BOUNDS DESCRIPTION of a 30 foot overflow easement located in Tract A, Treasure Island Addition to the City of Lubbock, Lubbock County, Texas, being 15 feet either side ofthe following described centerline; BEGINNING at a point which bears East, a distance of 1,099.50 feet and South a distance of 60.00 feet from the Northwest comer of Section 4, Block E-2, Lubbock, Lubbock County, Texas; THENCE Southwesterly around a curve to the right, said curve having a radius of 98.00 feet, a central angle of 29°44' and tangent lengths of 26.00 feet; THENCES. 39°41' W., a distance of 47.40 feet to a point of curvature; THENCE Southwesterly around a curve to the left, said curve having a radius of 52.40 feet, a central angle of 28°53' and tangent lengths of 13.50 feet; -2- TIIENCE S. 1 0°48' W., a distance of 54.60 feet to a point of curvature; TIIENCE Southeasterly around a curve to the left, said curve having a radius of89.20 feet, a central angle of25°17' and tangent lengths of20.00 feet to a point for the end of the centerline. I SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
