FROM AN "R-111 TO A 11C-211 ZONING DISTRICT SUBJECT TO CONDITIONS. WHEREAS~ the proposed change in zoning districts as· hereinafter made ha been duly presented to the Zoning and Planning Commission for its recommendatio .. which was received by the City Council and after due consideration, the City Coun 1 finds that making the proposed change as hereinafter set out will be in the public interest; and, WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 20 of Ordinance No. 1695 as well as notices pr vided by Article 1011f, Vernonrs Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was dul held in the City Council Room on the second floor of the City Hall, Lubbock, Texa • at which time persons appeared in support of the proposal; and, after said hearing it was by the City Council determined that it would be in the public interest, due t changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced in final written form prior to first reading hereof: NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and the same are hereby amended as follows. to ... wit: ZONE CASE NO. 1391 Change the following described tracts of land from an "R-1 11 to a "C-211 Zoning District: TRACT I. BEGINNING at the Northwest corner of Section 12, Block E~2 and proceeding south along the West boundary line of Section 12, Block E .... 2, a distance of 1320. 00 feet to a point, said point being the beginning point for the description of Tract 1; THENCE South along the West boundary line of Section 12, Block E-2 a distance of 69. 8 0 feet to a point; THENCE East a distance of 60. 00 feet to a point of curvature; THENCE Southeasterly along a curve to the right with a radius of 215. 00 feet~ an interior angle of 340 17t 22"~ and a curve length of 316. 00 feet to a point; THENCE Southeasterly along the north right-of-way line of Loop 289 a distance of 418. 75 feet to a point; THENCE North a distance of 326. 61 feet to a point on the north boundary line of the South 1 I 2 of the Northwest 1/4 of Section 12, Block E ... 2; THENCE West a distance of 670. 00 feet to a point on the West boundary line of Section 12 .. Block E ... z which is the BEGINNING POINT. TRACT II.' -BEGINNING at the NW Corner of Section 12 .. Block E ... 2 .. Lubbock County .. Texas .. and proceeding south·along the west boundary line of Section 12, Block E-2, a distance of 22271 to a point~ said point being the beginning point for description ci Tract 2; THENCE South along the west boundary line of Section 12, Block E .. 2 .. a distance of 409.77 feet to a point which is the SW Corner of the NW 1/4 of Section 12, Block E ... 2; THENCE East along the 1/2 section line of Section 12~ Block E-2 a distance of 9551 to a point; THENCE North a distance of 680. 35 feet to a point on the south ROW line of Loop 289; THENCE West along the south ROW line of Loop 289 to a point which is 8001 east of the West boundary line of Section 12, Block E-2; THENCE Southwesterly along the soutll ROW line of Loop 289 a distance of 549. 1 t to a point of curvature; THENCE SOUTHWESTERLY along to the left a curve to the left with a radius of 215', interior angle of 84° 17 1 2211, and a curve length of 316. 20 feet to a point; THENCE West a distance of 6 01 to a point on the west boundary line of Section 12, Block E-2, which is the BEGINNING POINT. Provided however, that both tracts shall be subject to the following conditions: 1. Building height shall not exceed one story. 2. Where hereafter required that visual screening shall be provided on any tract of land described in this section it shall be accomplished by a permanent seven foot solid visual screening wall or fence to be constructed prior to or concurrently with the first unit of any building construction on such tract of land. 3. One pylon type sign on each respective tract of land shall be permitte provided such sign is set back a minimum of 60 feet from the street property line and does not exceed 45 feet in height and 640 sqe1are feet in area. All •other signs shall be restricted to those permitted in the "C-211 District. 4. Sidewalks of minimum _6 foot wi.dth shall be constructed along all co~v·oo~u property lines except in those areas where ornamental screen plantin may hereafter be required in relation to each tract of land hereinafter described. 5. Driveways for ingress and egress shall be approved by the City Tr Engineer under the terms of the Ordinance regulating construction of driveways. 6. All utility service to the property shall be approved by the Director of Public Works and where required easements shall be granted for utilities including garbage collections service. 7. Lighting of the property area shall be shielded and/ or directed to pre vent glare on adjacent residentially used areas. Provided further that Tract I shall be subject .t6 the following additional condition : 1. Minimum building se\):>acks as follows: 13 01 from Indiana Avenue 1301 from Loop 289 I I I I 4. Screening Fence: A fJ r solid permanent type screening fence shall be erected and permanently maintained 12' west of and parallel to the east property line along Hartford Avenue except t hat at the street intersection, the fence shall be angled diagonally from street to stree between points measuring 25' in each direction from the intersection corner .. which angled fence shall be sloped from a height of 6' to a height of 2 '. Provided further, that Tract 2 shall be subject to the following additional conditi 1. Minimum building setbacks as follows: 13 01 from Indiana Avenue 1301 from Loop 289 50' from east property line or ROW line of adjacent street 381 from south property line except that where a service station may be built on the property it may be constructed to within 431 of the street property line with such setback re- quirement to include pumps, canopies and pylon or freestanding signs in addition to the main building. 2. Maximum building area shall be 134, 702 square feet based on a 3:1 parking ratio;;_. 3. Landscaping: Ornamental screen planting shall b e installed and main tained along the east 121 of the property adjacent to the street extendi g from the south property line to a point 1301 from Loop 289. 4. Screening fence: A 6' solid permanent type screening fence shall be erected and permanently maintained along the south property line and also along a line parallel to and 12' from the east property line along the street ROW to a point within 13 O' of Loop 289. SECTION 2. THAT from and after passage and effective date of this Ord nance said lots, tracts and parcels of land described in Section 1 hereof shall be changed to the zoning district indicated and the Official Map is amended in accor ... ance herewith.
