LUBBOCK COUNTY~ TEXAS~ FROM AN "R-2" TO A uC-3" 'ZONING DISTRICT.· (SAID PROPERTY IS LOCATED ON THE EAST SIDE OF AVENUE QAT 23RD STREET.) SUBJECT TO CONDITIONS. WHEREA~ the p~oposed change in zoning districts as hereinafter made has been duly presented to the Zoning and Planning Commission for its recommendatio l, which was received by the City Council and after due consideration., the City Coun- cil finds that making the proposed change as hereinafter set out will be in the pub- lic interest; and .. WHEREAS,. allk onditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giviri.g notices in compliance with Section 20 of Ordinance No. 1695 as well as notices provided by Article 101lf, Vernonilis Annotated Citvil Statutes,. amended in 1961,. and notice was duly published in the Lubbock Morning Avalanche Journall more than fifteen (15} days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Z<...:jfing Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced in final written form prior to filrst reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY £F LUBBOCK: SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and the same are hereby amended as follow~~ to-wit: ZONE CASE NO,. 990 Change Lots 14,. 15 and 16, Block 15 (except the West 25 feet of Lot 14) and Lots 12 and 13,. Block 16, {except the West 25 feet of Lot 13}~ McCrummen Second Addition to the City of Lubbock~ Lubbock, County~ Texas,. from an "R-211 to a 11 C-3" zoning dis- trict. (Said property is loc;1ted on the East side of Avenue Qat 23rd Street .. ) SUBJECT TO THE FOLLOWING CONDITIONS: A. The following regulations shall apply to Lots Fourteen (14). Fifteen (15) and Sixteen (16) {except the West 25 feet of Lot 14, which has been designated for street purposes) in Block i Fifteen ( 15}.. Me Crumm en Second Addition to the City of Lubbock.a Lubbock County, Texas. II 1. That Lot 14 ·((except the West 25 feet) and Lot 15 be used for business purposes withtthe present improvements there- on. This property shall be used for any purpose permitted in a "C-3" zone,. except those specifically prohibited here- inbelow, so long as no new improvements are added thereto. 2. That at such time as any additional improvements or new improvements are placed on the property herein first des- cribed in Section 1# then conformance with the following requirements must be had: a. That the lots, as above described which are abutting be developed as a ·unit with a 20-foot set-back and frontage on Avenue QJ' and that sufficient off-street parking be provided as hereafter set out. b. That a permanent screening wall or fence of 6 feet in height be constructed and maintained along the East property line in conformance with zoning regulations. c. That an off-street parking lot be constructed with a minimum ratio of one parking space for each 400 square feet of gross floor area in the building if an office building is constructed on the property; if retail use is made of the propertyJI then an off-street parking lot of sufficient size to maintain a three to one ratio in parking area to building area be constructed. The following regulations shall apply to Lots Twelve ( 12) and Thirteen ( 13) {except the West 25 feet of Lot 13, which has been designated for street purposes) in Block Sixteen (16)~ McCrummen Second Addition to the City of Lubbock. Lubbock County" Texas. 1. That at such time as this property is improved for use# Tract No. 2 be considered as one lot and be developed as a unit with a 20-foot set-back and frontage on Avenue Q. This will conform to the set-back requirements on the property across the alley south where the Bluebonnet Pickup Station is. 2. That at such time as this property is improved for use, a permanent screening wall or fence a minimum of 6 feet in height be constructed along the east property line in conformance with existing zoning regulations. THAT from and after passage and effective date of this Ordi- nance, said lots, tracts and parcels of land described in Section 1 hereof shall be changed to the zoning district indicated and the Official Map is amended in accord ance herewj.th.
