1 , \ v AN ORDINANCE AMENDING ZONING ORDINANCE NO., 1695 AND THE r OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING
CHANGE: ZONE CASE NO. 1382: CHANGE A TRACT OF LAND BETWEEN
FLINT AND GARY AVENUES~ BORDERED ON THE NORTH BY. 35TH STREET
AND ON. THE SOUTH BY 36TH STREET., CITY OF LUBBOCK.., LUBBOCK
COUNTY~ TEXAS; THE NORTH 1/2 FROM AN "R ... 211 TO AN "R ... 311 ZONING
DISTRICT AND THE SOUTH 1/2 FROM AN "R"l" TO AN "R ... 211 ZONING
DISTRICT; SUBJECT TO CONDITIONS:
WHEREAS., the proposed change in zoning districts as hereinafter made
has been duly presented to the Zoning and Planning Commission for its recom ...
mendation, which was received by the City Council and after due consideration,
the City Council finds that making the proposed change as hereinafter set out
will be in the public interest; and.,
WHEREAS . .a all cbnditions precedent required by law for a valid amend ....
ment to the Zoning Ordinance and Map have been fully complied with, as well as
giving notices in compliance with Section 20 of Ordinance No. 1695 as well as
notices provided by Article lOllf, Vernonts Annotated Civil Statutes, amended
in 1961, and notice was duly published in the Lubbock Morning Avalanche Journal
more than fifteen (15) days prior to the date of the public hearing before the City
Council '()n such proposed amendment, and the public hearing according to said
notice was duly held in the City Council Room on the second floor of the Cit-y Hall,
Lubbock, Texas, at which time persons appeared in support of :the proposal; and ..
after said hearing,, it was by the City Council determined that it would be in the
public interest, due to changed conditions, that the Zoning Ordinance and the
Zoning Map be amended in the manner hereinafter set forth in the body of this
Ordinance and this Ordinance having been introduced in final written form prior
to first reading hereof; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE
and the same are hereby amended as follows., to ... wit:
ZONE CASE NO~· 1382
Change a tract of land between Flint and Gary Avenues bordered
on the Nortp by 35th Street and on the South by 36th Street., City
of Lubbock, Lubbock County~ Texas, as follows:
(a} The North 1/2 of said tract from an "R ... 2" Zoning District
to an "R ... 3" Zoning District.
(b) The South 1/2 of said tract from an "R ... l 11 Zoning District
to an "R -211 Zoning District.
SUBJECT TO THE FOLLOWING CONDITIONS:
1. That a 20t east ... west alley be dedicated tilru tile center of
the property to line up with the existing alleys at each end.
2. That tile R-3 development be limited to apartments only with
a minimum of 1500 square feet of lot area and 1 1/2 paved
off ... street parking spaces for each apartment unit.
SECTION 2. THAT from and after passage and effective date of this
Ordinance said lots, tracts and parcels of land described in Section 1 hereof
shall be changed to the zoning districts indicated and tile Official Map is amended
in accordance herewitil.
AND IT IS SO ORDERED;
