AN ORDINANCE ALTERING AND ESTABLISHING THE PRIMA FACIE
SPEED LIMIT FOR VEHICULAR TRAFFIC IN ALLEYS, AS THAT WORD IS DE INE
IN SECTION 18.1., CODE OF ORDINANCES., CITY OF LUBBOCK, TEXAS,. WIT
THE CORPORATE LIMITS OF THE CITY OF LUBBOCK AT FIFTEEN MILES
PER HOUR; PRESCRIBIN"G A PENALTY; PROVIDING FOR PUBLICATION; DE.,.
CLARIN'G AN EMERGENCY; PROVIDING FOR THE EFFECTIVE DATE OF THI
ORDINANCE; AND PROVIDING THAT THIS ORDINANCE BE CODIFIED AS SEC ION
18.;.82. 2 OF THE CODE OF ORDINANCES., CITY OF LUBBOCK, TEXAS.'
WHEREAS,. the governing body of the City O'f:,I:.,ubbock, upon the basis of
an engineering and traffic investigation, finds it necessary to alter the prima
facie speed limits established by Article 6701d, Section 166 ('a) 1,. Vernon1s
Annotated Texas Statutes as amended, Acts 1963,. 58th Legislature, Page 455,.
Chapter 181, in and upon all "a.lilleys11 within the corporate limits of the City of
Lubbock; and
WHEREAS, it is necessary to the immediate preservation of the public
health and safety to provide for the immediate enactment of such measure con ..
stituting an emergency; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1,.' THAT the term "abley11 as used in ttis ordinance shall be
the same as the word is defined in Section 18. 11 Code of Ordinances.. City of
Lubbock, Texas, and that being 11any street as defined in this section having no
regular or official name other than tall.ey1 of twenty feet or less in width. "
SECTION 2. THAT the prima facie speed limit established by Artic:le
6701d, Section 166{a) 1, Vernon•s Annotated Texas Statutes as amended, Acts
1963, 58th Legislature, Page 455, chapter 181, of vemi;::les driven upon the
public "alleys" within the corporate limits of the City of Lubbock is hereby
altered, and from and after the effective date of this ordinance, shall be fifteen
miles per hour.
SECTION 3. THAT any speed in excess of the limit specified by this
ordinance shall be prima facie evidence that the speed is not reasonable or
prudent and that it is unlawful and any person violating the prima facie speed
limit established by this ordinance shall be fined not more than $2 00. 00.
SECTION 4. That the City Secretary is hereby authorized and directed
cause publication of the descriptive caption of this ordinance together with the
penalty provision,. as an alternative method of publication as provided by law.
SECTION s;· That the enactment of this Ordinance being necessary to th
public safety, and welfare because of the heavy flow of vehicular traffic upon
"alleys11 within the City of Lubbock at excessive rates of speed is hereby declar d
to be an emergency measure creating a public necessity that the rule providing
that proposed ordinances be presented at two separate meetin.gs be dispensed wit
and this Ordinance is declared to be an Emergency Measure to take effect from
and after the date of its second publication.
SECTION 6. That this Ordinance shall be codified and included in the
Code of Ordinances~ City of Lubbock6 Texas1 as Section 18..,82. 2.
AND IT IS SO ORDERED.
