HomeMy WebLinkAboutOrdinance - 9957-1996 - Amending Chapter 23 Establish Rates Special Waste Requiring Special Handeling - 12/12/1996First Reading Item 1J32 December 12, 1996 SecondiReading Item 111 Decembir 19, 1996 ORDINANCE NO. 9957 AN ORDINANCE AMENDING CHAPTER 23 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO ESTABUSlllNG RATES FOR SPECIAL WASTE REQUIRING SPECIAL HANDLING BY THE CITY OF LUBBOCK LANDFILL; PROVIDING A PENALTY; PROVIDING A SA VINOS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, increasing regulation in the disposal of waste requires the City of Lubbock Solid Waste Department to give special handling and treatment to many types of special waste, such as contaminated foodstuffs and materials containing asbestos, which results in increased operating expenses to handle such special wastes; and WHEREAS, the City Council of the City ofLubbock, Texas, deems it to be in the best interest of the health, safety and welfare of the citizens of the City ofLubbock to make the following amendment to Chapter 23 of the Code of Ordinances of the City of Lubbock; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 23-1 of the Code of Ordinances of the City ofLubbock, Texas, is hereby amended by adding thereto the following definitions: Contaminated foodstuffs: Contaminated foods, other than those contained in normal household waste that because ofits quantity or biological properties requires special handling and disposal to protect human health or the environment. Asbestos containing waste: Any waste containing non-friable asbestos, either in whole or in part. SECTION 2. THAT Subsection 23-2l(b) of the Code of Ordinances of the City of Lubbock, Texas, is hereby amended by adding the following language thereto: Contaminated foodstuffs and asbestos containing wastes are considered special wastes and must be discharged, dumped or unloaded at the designated city landfill or at such other place as may be designated by the Solid Waste Department. Persons desiring to dump contaminated foodstuffs and/or asbestos contain wastes at the city landfill shall pay an additional charge per ton of waste dumped of fifty dollars ($50.00) plus any applicable surcharge for waste generated outside of the City of Lubbock. SECTION 3. THAT violation of any provision of this ordinance shall be deemed a misdemeanor punishable as provided by Section 1-4 of the Code of Ordinances of the City of Lubbock, Texas. I SECTION 4. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 5. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method of publication provided by law.
