In General CHAPI'ER 11-A ELECTRICAL CODE Article I o This Code shall be known and may be cited as "The Electrical Code of the City of Lubbock." Section 11A-1o Scope of this Code. All electrical work installed within the City of Lubbock shall be installed in conformity with the provisions of this Code and it is hereby declared to be un- lawful for any person, firm or corporation to install any electrical work in viola- tion of the provisions of this Code. Section 11A-2 o Administration The administration and enforcement of the provisions of this Code shall be vested in the City Electrical Inspector, who will be under the admi nistrative super- vision of the Building Inspector of the City of Lubbock. · ' .... . ' Section 11A-3o Definitions • 4 ... For the purposes of this Code the following words and terms shall, unless the context otherwise indicates, be construed as having the following meaning: Boardo The term "board" shall mean the City Board of Electrical Examinerso Cityo The term "City" shall mean the City of Lubbooko Codeo The term "Code" shall mean the 11Electrical Code of the City of Lubbock," unless specifically limited to any other electrical oodeo Direct supervision. The term "direct supervision" shall be construed to mean supervision of work by a supervisor, who shall be either a licensed journeyman electrician or a licensed master electrician, who shall be actually present at the job site or installation at all times any electrical work is in progresso The words "job site" as used in this paragraph shall mean the specific premises des- cribed in the electrical permit under which the electrical work is being performed. Electrical work. The term "electrical work" as used in this Code meanss (1) All wiring, circuits, fixtures, appurtenances and appliances for a supply of electrical power, for all personal, domestic, and commercial purposes in and about buildings or other structures where persons live, work or assemble; all wiring, circuits, fixtures, appurtenances and appliances outside such buildings or structure connecting the building with the source of electricity, (2) the installation, re- pair, and maintenance of all wiring, circuits, fixtures, appurtenances and applicances in and about builings or structures where persons live, work or assemble, for a supply of electricity; and (3) all other activities, installations or measures in- cidential to the distribution of electrical energy which are covered, regulated or in any fashion controlled by the specific sections of this Code. Electrical maintenance worko The term "electrical maintenance work" shall be construed to mean the keeping in safe repair any and all electrical installations, apparatus and equipment within a building, or in or on the premises where a main- tenance electrician is regularly employed on a permanent basis, for which work a permit is not required under the terms and provisions of thi• Code, but does not include the installation of new and/or additional electrical work. Inspector. The term "inspector" shall mean the City Electrical Inspector and hie duly authorized deputies of the Building Inspection Departmento Journeyman electrician. The terlll "jcurne;yll&ll electrician" shall be construed to mean a.tzy person who has received a "Certificate of Qualification of Journeyman Electrician11 and a license from the City in accordance with the provisions of this Code. Journeyman sign electrician. be construed to mean any person who of Journeyman Sign Electrician" and provisions of this Code. The term. "journeyman sign electrician" shall has received a "Certificate of Qualification a license from the City in accordance with the Maintenance electriciano The term "maintenance electrician11 aball be construed to mean any person who has received a "Maintenance Electrician License" from the City in accordance with the provisions of this Codeo -2 .. Master Electrician. The term 11ma.ster electrician" shall be construed to mean an;y person who has received a "Certificate of Qualification of Master Electrician" and a license from the City in accordance with the provisions of this Code. Master sign electrician. The term "master sign electrician" shall be construed to mean acy-person who has received a "Certificate of Qualification of Master Sign Electrician" and a license from the City in accordance with the provisions of this Code. N.B.F.U. The term "N.B.F.U.11 shall mean the National :Board of Fire Under- writers. N.E.C. The term "N.E.C.11 shall mean the 1965 Edition of the National Electrical Code compiled by the National Board of Fire Underwriters. Section 11!-4. City assumes no liability for,defective electrical work. This Code shall not be construed to relieve from or lessen the responsibility of ~ person owning, _operating, controlling or installing any electrical wiring connections, fixtures, appliances, apparatus, ma.chiner,r, equipment, or work, inside or outside, overhead or underground in the City, for damages to a.n,y person injured by defects therein nor shall the City be held as assuming any liability by reason of the inspection authorized by this Code or certificate or permit issued as pro- vided for and regulated. Section 11A-5. Standards Adopted. The following Codee and Standards are hereby adopted as the governing standard for electrical installations within the corporate limits of the City except where b.y specific requirements of this Code, different requirements ·are specifically adopted, a copy of each being attached hereto and incorporated herein b.f reference. A oopy of each of said following described Codes and Standards shall be filed with the City Secretary and a oopy of each maintained in the offices of the Building and Electrical Inspectors of the City, all of such copies to be open to public inspection during business hours of the offices where they are maintained: (1) 1965 Edition, National Electrical Code {NEPA No. 70), as adopted by the National Fire Protection Association. (2) June, 1956 Edition of the Standards of the National Board of Fire Under- writers for Dr,y Cleaning Plants, NBFU No. 32o (3) October~ 1950 Edition of Standards of the National Board of Fire Under- writers for SprQY Finishing using Flammable Material, NBFU Noo 33. (4) ~' 1955 Edition, Fire Safety Standard for Existing K~ing, Convalescent and Old Age Homes, as prepared b,y the National Fire Protection Assocication, NFPA No. 101Bo (5) July, 1959 Edition, Standards of the National Board of Fire Underwriters for the use of Flammable Anesthetics, NBFU No. 56o Section 11A-6. Licenses Required. It shall be unlawful for ~ person to engage in or carr,y on directly or in- directly, or to advertise or to hold himself out as engaging in, or carrying on, -3- . . the business or to perform any act as a master electrician or master sign eleotrioi or a jour.n~ electrician or journeyman sign electrician, or maintenance electric as herein defined within this Code without first obtaining a license as a master electrician or master sign electrician or journeyman electrician or journeyman sign electrician or maintenance electrician as the case may be and as provided for in th Codeo Section 11A=7o ExeffiPt!ons and Exceptions to License Requirementso (a) The provisions of this Code shall not apply to electrical work consistin of transmission, distribution, communication, streetlight, or traffic control wirin used in the generation, distribution and rendition of service to the public whioh is installed by or for, and owned or maintained by a public utility, telephone, tel An applicant for the position of Electrical Inspector or Deputy Electrical Inspector shall be required to take the masterva written examination given by the Board of Electrical Examiners, unless otherwise waived, and if, upon his examina- tion. he makes a grade of 70%, the Board may then certifY the competency of the applicant to the City Managero Section 11A-11o City Electrical Inepectorvs Deputieso The Electrical Inspector may carry out such of hie duties and responsibilities through his deputi es as may be necessary from time to time to insure the prompt enforcement of this Codeo Section 11A-12o ~ity Electrical InsEector-Deputies -Conflict of Interesto No person appointed as Electrioal Inspector, nor any of his deputies, shall be an employee of or have any pecuniary interest in any firm or association engaged in any phase of the electrical businesso Section 11A-13o Badge o£ Identifioationo The Electrical Inspector and his deputies shall be issued identification badges which they shall have in their possession at all times when engaged in the enforcement of this Codeo Such badges shall be shown upon the request of any per- eon present at the job siteo Section 11A-14o City Electrical Inspecto~~-Additional Dutieso In addition to the enforcement of the provisions of this Code, the City Electrioal Inspector shall collect and account for the fees and deposits fixed and provided for herein9 issue permits and certificates, make inspections and per- form such other aots and duties as are specified in this Codeo Section 11A-15o V!?lation -Notificationo When the Electrical Inspector observes or if it comes to his attention that any electrical work is installed contrar.v to or in violation of the provisions of this Code it shall be his duty to immediately notify the responsible master eleotrioiant master sign electrician or the owner or occupant of the premises to immediately correct such installation or cease work on the entire installation until the viola- tion is correctedo Section 11A-16o Improperly installed_or defective equipment. In the event ~ part of any electrical equipment in or about any building in the City of Lubbock has been inst alled and connected in violation of the provisions of this Codet or in the e~ent the use of such in dangerous to human life or property, it shall be the duty of t he Electrical I nspector to notify in writing the owner or tenant of the building to cease usi ng electrical current in such equipmento The written notice herein required shal l state the reasons therefor and shall state a reasonable time, not to exceed t en (1 0) days from the date o£ notice, in which to have the defect in wiring or such equipment repaired. If the defects in wiring or equipment shall not have been repaired at t he expiration of the time provided in such notice the City Electrical Inspector is authorized and directed to disconnect or cause to be disconnected such defective wiring or equipment from the source o£ supply. When under the provisions of this Code it is neoeesar,y to disconnect the -5- •. supply of electrical current to the premises the Electrical Inspector shall cause an order in writing to be issued to the electrical utility or company supplying such power, and upon receipt of such notice t he supplier of electrical energy shall forth- with comply with the order. Section 11A-17o Interpret a tion of CodeJ ApEeal s from Decisions of Interpretationo (a) It shall be the duty of the Electri cal Inspector to interpret the pro- visions of this Code and of t he applicabl e electrical codes, requirements and standards therein included or adopted hereby, as may be necessary t o administer and enforce the provisions hereof and expedite the business of all electrical construction pro- jectso (b) Any person or persons, jointly or severally, who may be aggrieved by the interpretation given by the Electrical Inspector in the enforcement of this Code may appeal from such decision of the City Electrical Inspector to an "Interim Committee" composed of the Chairman or Vice Chairman of the :Soard of Electrical Examiners, one mast er electrician and one other voting member. When an appeal is filed for action of the "Interim Committee" it shall render an unanimous decision within twenty-four (24) working hours from time an appeal is filed. The decision of the "Interim Committee" shall be f i nal and binding on all parties unless within twelve (12) working hours from time the decision is made by the "Interim Committee" an appeal if filed for a determination of the question by the entire Board of Electrical Examinerso When an appeal is made to the entire :Board of Electrical Examiners the question shall be determined at its next regular session, and all questions on appeal shall have priority over any other matters pending before such :Boardo Under the provisions of this section an appeal to either "Interim Committee" or Board of Electrical Examiners shall be made b,y set ting out in writing the question to be determined together with the reason or reasons supporting the appellant~s interpretation of the provision which i s in controversyo An appeal ie deemed to be filed when delivered to the Electrical Inspector at his office in the City Hall, who shall be required to promptly note thereon the time and date of receipt of such appealo An appeal ~ be made by the City Electrical Inspector from any decision of the "Int erim Committee" and same shall be made in writing, a copy of which shall be deli vered to the individual raising the question, and shall have noted on such copy the time and date of deliver,y whioh will consitiute the time of the appeal made by the City Electrical Inspeotoro Section 11A-18. Premises involved in a fire-reinstatement of electrical service. Where, in the opinion of the Chief of the Fire Department or Fire Marhsall, a fire originated due to faulty electrical wiring, overloading of eleotrioal equipment, or overloading lines or equipment, or any unauthorized electrical installation, it shall be the duty of the Fire Chief and the Fire Marshall to have the premises involved fully inspected by the Electrical Inspector. Where such or place to which the public is general~ admitted, or anT apartment house, hotel, motor or tourist court, or any building used as suoh, and an7 room, division or compartment of such place, or any building under construction, for the purpose of inspecting any electrical wiring, connections, fixtures, appliances, apparatus, machiner.y or workt and it shall be unlawful to hinder, impede, obstruct or exclude the Electrical Inspector or ~ of his deputies when attempting to enter or enter- ing any such place or division, room or compartment thereof for such purpse, or to conceal any electrical wiring, connection, fixtures, apparatus, appliance, machinar.y or work contained in any such building~ room or place or any compartment thereof. Article II. Board of Electrical Examiners Section 11!-20. Board of Electrical Examiners Created. The administration of the appeal and licensing provisions of this Code shall be vested in a Board, to be known as the "City of Lubbock Board of Electrical Examiners. 11 Section 11A-21. Membership. The Board of Electrical Examiners shall consist of ten (10) members. The following persons shall serve as ex officio members of the Board during the terms of their respective offices, but they shall not be entitled to a vote& The City t Eleotrioal Inspector, the superintendent of Municipal Power and Light, or his assistant, and the division superintendent of the Southwestern Public Service Company of the division in which the City is located, or his assistant, whose ~ointment has been approved by such company. The remaining seven members shall be appointed b,y the City Council, and they shall include two licensed and active master electricians, one lioeneed and active journeyman electrician, one electrical engineer not actively engaged in the electrical contracting business, one general contractor, one residential contractor, and one 1~ not actively engaged in any construction business. These seven members shall hold their offioe for a term of three (3) years or until their successors are appointed, except that the pre- sent Board shall continue for the term for which each member was appointed or until his successor is appointed. The Chairman shall be elected by the voting members of the Board. Section 11!-22. Vacancies and Removelo If, for a.ey reason any of the members of the Board of Electrical Examiners shall be unable to act, or shall resign from their respective positions, or shall be removed for any cause, then the City Council shall appoint a successor or suc- cessors who shall fill out the unexpired term, or until respective auocessors shall be appointedo Any appointed member of the Board may be re.moved as a member with cause b,y a 4/5's vote of the City Counoilo Section 11A-2'o QuOrum. Any four of the seven voting members of the Board of Electrical Examiners shall oonsitiute a quorum for the transaction of all business before the Board exoept where a greater number is specifically requi red by other provisions of this Code. Seotion 11A-24. Secretary. -7- The Electrical Inspector shall act as the Secretary of the Board of Electrical Examiners and shall keep a full record of the prooeedinga of the Board. Section 11A-25. Supplieso The City shall provide the Board of Electrical Examiners with proper books of record, blank forms, stationery and supplies, proper and adequate for the conduct of its business. Seotion11A-2~ Duties of the City Electrical Inspector. As Secretary to the Board of Electrical Examiners of the City of Lubbock it shall be the duty of the Electrical Inspector to cooperate with the Board of Electrical Examiners and to comply immediately with all reasonable requests of such Board. It shall be the further duty of the Electrical Inspector in his capacity as Secretary of the Board, when and to the extent requested by the Board of Elec- trical Examiners, to keep all examination procedures and forms up-to-date with the provisions of this Code, together with all opinions construing the provision• of this Code as may be rendered by the Board of Electrical Examiners. The City Elec- trical Inspector shall to the extent requested by the Board of Electrical Examiners compile and maintain an adequate supply of questions for possible adoption by the Board of Electrical Examiners for use in the examination for each class of electricians• license. It shall be his duty to prepare or cause to be prepared suoh blueprints as may be requested b.1 the Board of Electrical Examiners for use i.n the examination to be given applicants for each class of electricians' license. Section 11A-27. City Electrical Inspector shall noti!Y Board of Code Violations. It shall be the duty of the Electrical Inspector to notif.y the Board of Elec- trical Examiners of all violations of this Code, and to maintain a list of all euoh violations for consideration by the Board when any application for examination or license renewal is before them. The Electrical Inspector may also include his recommendation as to what action should be taken by the Board upon their considera- tion of any violation. Section 11A-28. License issuance and renewal. It shall be the duty of the Electrical Inspector to issue such licenses and renewal of such licenses approved b.1 the Board of Electrical Examiners or as auth- orized under this Code without Board approval. Section 11A-29. The Board of Electrical Examiners --Rules and Policies. The Board of Electrical Examiners is hereby authorized, empowered, and directed to adopt such policies and promulgate such rules and regulations, not inconsistent with this Code, as it may find necessary to expedite the enforcement and administration of suoh duties as are herein delegated to said Board of Elec- trical Examiners. All policies, rules and regulations which shall be adopted b.y said Board of Electrical Examiners shall be reduced to writing and kept in book form in the office of the Electrical Inspector and open to the public at all rea- sonable times. All master electricians and master sign electricians currently licensed under this Code and any other Code adopted prior hereto shall be notified in writing of such rules and regulationeo Section 11A-,O. Interpreting the Codeo The Board of Electrical Examiners is hereb,y authorized, empowered and directed when a quss.tia.n. .arises as to the meaning of the Code, a:ny word.;. clause or sentence of this Code bJ p%Cper appeal to interpret the same. When a question arising by appeal and acted upon b,y the Board of Electrical Examiners shall be by a majority of the Board hearing such appeal and such decision shall be reduced to writing and kept and maintained in a separate book in the office of the Electrical Inspector, and shall remain ap.en to the public and available to the public. at .. a.ll reasonable times. An3 decision int.erpreting any work, clause or sentence of the e.od.e shall be final and binding on all persons, unless or until modified or revoked by the Board Each electrician licensed under this Code affected by the decision of the Board shall be sent a copy of such decision. Any decision which substantially changes or modifies or altere an existing Board decision, or which will prohibit or substantially alter procedures or practices or wiring methods or equipment, theretofore followed or used b,y such licensees in the City shall not become effective until ten (10) days after notice of such decision has been mailed to each licensee affected; provided, however, such licensee may if be so desires follow such hew d&cision prior to the date it becomes subject to general enforcement. It is further provided that this provision shall never be interpreted as authorizing the Board of Electrical Examiners to add to, change or modf!y ~ provisions of this Code, and any changes to be made in the provisions of this Code must be accomplished by ordinance only. The Board of Electrical Examiners is hereb,y empowered to adopt rules and regulations not inconsistent with thts Code for the examination and re-examination of applicants for license for master electrician, journeyman eleotr~oian, master sign electrician, journeyman sign electrician, and maintenance electrician, and to provide proper forme to be filled out b.y each applicant. The Board shall fix the reasonable times for the examination of applicants and will specif.y place and time the examination shall be heldo In the event applicant fails the examination it shall be the duty of the Board to point out to applicant wherein he is deficient, and to render all reasonable assistance within the Boardts power to overcome such deficiency, provided, however, this provision shall never be construed as requiring the Board to re~iew 'specifio questions of a particular examination. Section 11!-32. Examination Procedures. The Board of Electrical Examihers shall prescribe the form and length of the examination for all classes of electricians' license. The subject matter of such examination ahall test the applicant as to his knowledge of any or all types of electrical installation, his practical knowledge of electricity and diagrams of any and all types of installations, and his familiarity and understanding of the National Electrical Code of the National Board of Fire Underwriters and the elec- trical ordinances of the City of Lubbooko The weight to be given each question or part of each euoh examination shall be fixed by the Board so as to total 100% for a perfect score. A minimum grade of 7o; is required for passing. Section 11A-33. Re-examination procedures. Each time an applicant for any class of license is re-examined, he must submit a new and complete application to the Board to be approved or disapproved ~n accordance with the examination provedures, and pay all application fees as -9- provided for q, original applicationse If an applicant fails the test, he ~ apply for a re-examination immediately and, if approved, he may take the next regularly scheduled exam. If the applicant fai'ls the second examination he lll8¥ apply for re- examination at his discretion, but he shall not be re-examined before the second regularly scheduled examination thereaftero If the applicant fails the third exam- ination, he must appear in person before the Board to show cause why he should be re-examined. Section 11A-34. Grounds for rejection of all classes of applioantso Applications for any type examination may be rejected by the Board upon a finding of any of the following: (1) That the application contains any false or misleading statements. When an application has been rejected for containing a false or misleading statement knowingly submitted by the applicant no new application shall be considered for such individual for a period of one year. (2) That the applicant fails or refuses to provide any information requested on the application form by the Board. (3) That the applicant has had his license revoked or suspended and that the period of such suspension or revocation has not yet expired. (4) That the applicant bas failed to pass a prior examination and that the period of time required by this Code between examinations has not yet expiredo (5) That the applicant does not possess the qualifications required for the type of license for which he desires examinationo (6) That the applicant within the twelve month period prior to application while operating or working within the corporate limits of the City had willfully failed to comply with provisions of this Code or had failed to correct improper electrical installation. Section 11A-35. Revocation, suspension of license --Procedure. The Board of Electrical Examiners is hereby authorized and empowered to revoke or suspend a license of any electrician for proper cause as hereinafter provided. No license shall be suspended for a period exceeding six (6) months. A suspension br revocation of a license shall be only after written charges have been filed and a hearing has been held as hereinafter provided. All charges shall be in writing and filed with the Board of Electrical Exam- iners and a oopy of the charges along with a notice of such hearing shall be served on the licensee by the Board acting through its secretary at least ten (10) days prior to suoh hearingo The licensee may appear in person or by an attorney and shall have an opportunity to be heard. No license or permit shall be reissued until the person holding the revoked license shall apply and successfully qualif.y for a new license as hereinafter set forth in thia Code. -10- Section 11A-36. Grounds for revocation or suspension of license. One or more of the following shall constitute proper cause for revocation or suspension of any olass of eleotrioal licenset ( 1) (2) (3) (4) ( 5) (6) (7) (8) The failure or refusal b.Y an electrician after due notice from the Elec- trical Inspector to correct defective electrical work or any work in- stalled in violation of this Code or a.rJ:1 work which failed to co.mply with the requirements of the Code. The furnishing of false or incorreot information in an application for examination or application for renewal of license within the last two calendar years. Failure or refusal to furnish information sought by the Board on any Board investigation either on examination or a renewal application for examination or where such information concerns a probable violation of this Code or relates to an electricianst ability, training, experience or performance as an electrioiano In order to insure full disclosure to the Board by an electrician as to past aots which may constitute a violation of this Code no information furnished by the electrician upon written request of the Board concerning any act of the electrician shall ever be subject to the penal provisions of this Code, but such information ~ form a basis for revocation of license or rejection of an application for the renewal of a license. To knowingly cause or allow wiring to be covered prior to an inspection b.1 the City Electrical Inspector. Any conviction for violation of the provisions of this Code except those contained in Article V within this Code and the provisions of technical publications adopted and made a part of this Codeo The conviction for any cri.me invol ving moral turpitude rendered by a court of competent juri sdiction. Continued disregard of the requirements of the Article entitled 11 Spec- ifioations" and under this Code all of the provisions of those publica- tions adopted and made a part of this Codeo When it is repeatedly oalled to the attention of the Board of Electrical Examiners that an electricia.n•e conduct and/or quality of work proves he is incompetent to further perform in a satisfactory manner the work authorized under his license. Section 11A-,7o Refusal to renew lioenseo The Board ~ after hearing with notice thereof to the applicant, refuse to renew any class of electrical license and may require such applicant for renewal to make application for examination for such license, upon a finding of any of the following: ( 1) (2) That the Applicant for renewal is guilty of any act or acts for which his license could be suspended or revokedo That the applicant has failed to comply with the renewal procedures pro- vided for his class of license b.y this Code. · -11- (3) (4) That the applicant has failed t o pay any fee required by this Code. That the applicant, if a holder of that class of license for which a bond is required, has failed to obtain or does not then have such bond validly effective. Section 11A-38. Appeals. Any person whose license has been revoked or suspended b,y action of the Board of Electrical Examiners or any applicant for any class of electricians' license who feels that he has been aggrieved by the action of the Board of Electrical Examiners because of any arbitrary or capricious action of the Board of Electrical Examiners may appeal this decision to the City Council b,y filing a written notice of appeal with the City Secretary within ten (10) days after the written decision of the Board of Electrical Examiners has been filed in the Office of the Secretary of the Board and a copy has been served on the licensee or applicant for an examination. The filing of tbe notice of appeal b.y the licensee whose lioense bas been suspended or revoked shall operate to stay the suspension or revocation order until the City Council renders ita decision. The City Council, after notice has been filed, may consider the notice of appeal and if after review it is considered that a hearing before the City Council should be heard then appellant shall be notified of the date of such hearing. The City Council may affirm, modif.y or vacate any finding of the Board of Electrical Examiners or enter any order which it may deem necessary. On entry of suob order the Board shall within a reaeonable time comply with such order, not to exceed forty-five (45) days from the execution of such order b.Y the Mayoro Section 11A-39. Recommendation for Improvement of Eleotrioal Code. The Board of Electrical Examiners is hereby empowered and authorized to sub- mit to the City Council its written recommendations from time to time which it may have for the improvement of this Code. Article III. Licensing Section 11A-40. Electrical Licenses Classification. There is hereb,y created the following classification of electrical licenses which will be designated e.a follows: master electrician, master sign electrician, journeyman electrician, apprentice electrician, journeyman sign electrician, and maintenance electrician. Section 11A-41. Eligibility master electrician and master sign electrician. To be eligible to hold a license as a master electrician or a master sign electrician within the City of Lubbock each applicant for such license shall be a high school graduate or the equiyalent thereof and shall have had four years journeyman level experience or it~ equivalent or engineering or technical school degree with two years journeyman level experience or equivalent and shall demonstrate his professional competency by passing an examination with a minimum grade of 70% on the examination to be held and conducted by the Board of Electrical Examiners Section 11A-42. Eligibility for Journeyman electrician and Journeyman sige Electrician Licenses. To be eligible to hold a license as a journeyman el.eotrioian or journeyman -12- sign electrician within the City of Lubbock eaca applicant for such license shall be a high school graduate or the equivalent and shall have had four years experience as an apprentice in electrical constructi on or the equivalent and shall demonstrate his qualification by passing an examination with a~imum grade of 70% to be held and conducted by the Board of Electrical Examinerso Section 11A-43o Eligibility for Maintenance Electrician Licensee To be eligible for a license as a maintenance electrician within the City of Lubbock the applicant for such a license shall provide evidence of his ability to perform his work for a specific employer and demonstrate his qualifications by passing an examination b,y a minimum grade of 70% to be held and conducted by the Board of Electrical Examinerso Section 11A-~4~ Application for Electrical Licenseo Each applicant for any of the classes of electricians' license provided for herein shall make a written application designating the type of license which ap- plicant seeks upon forma prepared and furnished b,y the Board of Electrical Examiners and shall file same in the office of the Secretary oC said Board. All blanks pro- vided on said application forms shall be filled in b.y the applicant with the informa- tion sought, or with an explanation as to why applicant's circumstances justify omission of such informationo The Board shall review each application and after approval of the application the applicant shall be notified as to the time and place of such examination following the day his application is approvedo Section 11A-45. EXamination Feeso The following schedule of fees shall be charged each applicant for electrical license and said fee shall be paid to the Secretary of the Board of Electrical Exam- iners on or before taking the respective examination. The fees required to be paid herein are in addition to the license~ fees which are hereinafter requiredo The examination fees herein required shall not be returnable to the applicant for any reason and all sums collected b.y the Secretary of the Board shall be paid over to tbe General Fund of the City of Lubbock. Master electrician and master sign elec- trician the sum of $50o00o Journeyman electrician or journeyman sign electrician the sum of $5.00o Maintenance electrician the sum of $5o00o Section 11!-46. Examination Procedures. Each applicant for an electrician's license shall report at the time and place specified by the Board of Electrical Examiners for examination and each applicant shall take the examination prepared b.y the Board under such supervision as the Board may directo Section 11A-47. License feeo Each successful applicant for an electrician's license shall pay the follow- ing respective fees, master electrician or master sign electrician the sum of 1150.00, journeyman electrician or journeyman sign electrician the sum of 120.00, maintenance electrician the sum of S15oOO. The fees her.ein enumerated and required by this section shall be paid and delivered to the Secretar,y of the Board of Elec- trical Examiners within 30 ~s after the applicant is notified that he has passed the examination. Complete reapplication and re-examination will be required is such fee is not paid and such bond posted within the time herein specified. All -13- license's fees oolleoted b.f the Secretar,y of the Board shall be paid over to the General Fund of the City of Lubbock. Section 11!-48. Master Electrician or Master Sign Electrician Bond. In addition to the fee hereinabove enumerated all holders of master electrician or master sign eleatrician license as a condition precedent to the issuance of such license shall execute a bond as required by Section 11!-53 of this Code. ~ction 11A-49o Expiration and Renewal. Each license issued under the provisions of this Code shall expire at mid- night on December 31 of the year for which it is issued and application for the renewal thereof shall be made in such form as the Board of Electrical Examiners shall prescribe. Applications for renewal of said licenses may be made between the first day of October and the 31st day of Decembero Section 11A-50. Renewal Fees. The following fees for the renewal of any license issued under the provisions of the Code shall be paid to the City Electrical Inspector who shall duly pay all fees received into the General Fund of the City of Lubbock~ (a) Master electrician and master sign electrician a fee of 150.00. (b) Journeyman electrician. journeyman sign electrician and maintenance electrician a fee of $5.00. The fees to be paid under Paragraph (a) and (b) shall be charged for the re- newal of any licenses provided application for renewal of such license is made within the time provided and before expiration of applicant's license. Provided, however• that any license may be renewed during the succeeding twelve months from its expiration date upon approval of the renewal by the Board of Electrical Exam- iners and payment of the fee for the original license. Provided, further, that no license may be renewed after a period of twelve months from the expiration date of the original licenseo After the expiration of such twelve month period any person desiring ~ electrical license authorized to be issued under this Code shall be required to qualify by taking the examination for such class of license as may be desired, and pay the original fee for such licensee Section 11A-51o Possession of Licenseo The holder of ~ electrical license authorized to be issued under the pro- visions of this Code shall. when on the job site of any electrical installation, have in his immediate possession the wallet size license identification as furnish- ed by the Electrical Inspector at the time of the issuance of his license, and such license holder-shall upon request present same for identification to the Elec- trical Inspector or ·any of his deputieso In addition to the identification re- quirement in this section each master electrician and master sign electrician shall cause to be posted in a prominent place at their respective place of business the certificate of qualification which is issued by the Electrical Inspector at the time his license is issuedo Section 11!-52. Licenses -~ Not Transferrableo It shall be unlawful for any person holding an electrician's license auth- orized to be issued under the provisions of this Code to ·transfer the same or allow -14- the use of same directly or indirectly b,y any other person for the purpose of doing electrical work or for obtaining a permit to do electrical work. Section 11A-55o Licenses not transferable6 It shall be considered a violation of this section for a master electrician or a master sign electrician to engage in the performance of electrical work with a journeyman or apprentice other than in the usual employer-employee relationship. Section 11Ac56. Master electrici an or master sign electrician to supervise work. Each master electrician or master sign electrician shall be responsible for all electrical work installed under permits secured by him in the City, and shall .maintain supervision over all journeymen and apprentices working directly under him on any project. Section 11A-57. Callins for Inspections. It shall be the duty of the master electrician or master sign electrician or his authorized representative to make application for all permits herein requiredt and to call for all rough and final inspections necessary under this Code. Section 11A-58. Temper~ Li cense. The holder of any l i cense for a journeyman electrician or journeyman sign electrician or the equivalent of such license issued by another city with standards comparable to the City of Lubbock may upon presentation of evidence that he holds an equivalent license from such city be granted a temporar.y license by the City Electrical Inspector. Any temporary license issued under the provisions of this section may not exceed an accumulated total of 4 months and in not renewableo The applicant for a temporary license shall pay upon issuance of such license a fee of $5.00. -16- Section 11A-59~ Scope of Maintenance Eleotrioian License. The maintenance eleotrioian•s iioense shall not be construed in any way to allow the holder thereof to install any new circuit, outlet or additions, or to per~ form any eleotrical work for which a permit is required, or to perform any work re- quired by this Code to be performed by a master electrician, master sign electrician, journeyman electrician, or journeyman sign electrician. Section 11A-60e Location of work~ Eaoh license issued to a maintenance electrician shall specify the name and address of the person to whom the license is issued, and the location of the pre- mises in or on which the maintenance work is to be done, and the date the certificate was issued, and no work shall be done at ~ location exoept that named in the license. Section 11!-61. Renewal Required when Location Changedo Ever.y holder of a maintenance electrician's license shall notif.y the Electrical Inspector immediately when such holder makes any change in his employment, giving in such notice the name of his new employer and the l ocat ion of the premises in or on which he is to be employed to perform electrical mai ntenance work. Section 11A-62. Qaalifications and experience. Everyone desiring to do work as an apprentice electrician shall be able to read and write the English language. Section 11A-63o City apprentice work permito Ever.yone desiring to do work as an apprentice electrician within the City shall register with the City Electrical Inspector, and obtain from such office an apprentice work permit. A fee of one dollar shall be charged for issuance of such permit. Suoh permits shall expire on the thirty·first day of December of each calendar year, and may be renewed by applicati on therefor to the Electrical Inspector and payment of a one dollar renewal fee. Section 11A-64& Possession of work permi to Every apprentice electrician shall keep such permit in his possession and on .his person at all times when engaged in work on any electrical installation pro- ject site. Section 11A-65. Working under supervisiono Every apprentice shall undertake electrical work only when engaged under the direct supervision of a master electrician, master sign eleotrican, journeyman electrician or journeyman sign electriciano Article IV. Permits and Inspeotionso Division 1o Permits Required. Section 11A-66~ Reguired for electrical work seneral1zo It shall be unlawful for any person to begin any work of installing, erecting or altering material, wiring, fixtures, or other apparatus to be used for the utilization of electricity for light, heat or power in or on any building or pre- mises in the City without first securing a permit from the Electrical Inspectoro Section 11A-67o Application Blankso Application blanks for permits for electrical work shall be furnished by the Electrical Inspector, who shall approve and countersign theme Section 11A-68o Issuancet contentst effective on!z as to work and place described. When the fee required by this Article is paid, when all license and bond re- quirements of this Code have been complied with, and when the plans and specifications of the proposed electrical work have been approved, the Electrical Inspector shall issue a permit to the applicant which shall state the kind of work to be done and the address of the building where the work is to be done. Such permit shall be with- out effect as to any work not therein described or as to any place other than des- cribed. Section 11A-69o Approval of plans and specifications when plans must specity size of feederso The plans and specifications of the electrical work of all new buildings or buildings to be remodeled other than single family residences in which electrical wires are to be installed, must be submitted to the Electrical Inspector by the owner or architect for his approval before the permit will be issued. All plans shall specify the size of feeders and sub-feeders and their length when there are more than four branch circuitso When, according to suoh plans and specifications, the electrical work specified complies with t he provisions of this Code, the Electrical Inspector shall approve the plans and specification therefor in writing. If any changes are required by the Electrical Inspector, he shall attach a list of such requirements to the plans or specificati onso When such plans and specifica- tions have been correct ed, they shall be resubmitted for approval. ~action 11A-10o Permit s to be issued to Mast er Electricians onlz. Permits for electrical work shall be issued only to a master electrician and only upon an application signed by a master electrician. When electrical work is being performed under an assumed name, or trade name, permits will be issued only upon application of the master electrici an representing such firm or association bearing substantially the following notation: 11To (name of master electrician) for (name of co~p!BY) o" The master electrician whose name appears on the permit shall be responsible for supervi sion of the project, and shall be prima facie responsible for all viol ations of t he Code that occur on such project. Sect~on 11A-11• Permit for temporabl installations. When a permit to install work of a temporar.y character, for a time to be specified in such permit, and not i n any case to exoeed thirty days, shall have been issued b.y the Electrical Inspector, a strict compliance with the rules of permanent work will not be exacted, provided the character of the work is entirely safe for the period designated in the permit. No temporary work or alterations shall be allowed on live circuits unless protected by a proper switch and fuse. -18- Section 11A-72o Ready-built homeeo Where buildings are constructed in lumber yards or on premises other t han where t he building is on a permanent foundation, and where such building is to be moved i nto and located within the City limits, wiring installations ahall be made b.y a bonded and licensed master electrician, in conformity with this Code and per- mits shall be applied foro Section 11A-73o When permit not required 6enerall yo No permit shall be required for minor work such a repairing flush and snap switches, replacing fusee or changing lamp sockets and receptacles. This Code shall not be construed to require a permit for maintenance work on the premises of a per- eon regularly employing a maintenance electrician for that purpose. Seotion 11A-14o Changing or replacing fixtures. After the original inspection of fixtures, if fixtures are changed or replaced with other fixtures where circuit vires without change of size are run directly into the receptacle of the changed or replaced fixtures, no fixture permit or inspection shall be required, provided such work is done b.y persons licensed under this Code to do BO o However, if such changed or replaced fixtures require a change in the size of wire, a permit and inspection shal l be required. Section 11A-75o Emergency work necessitatins new wiripgo In case of emergency necessitating the immediate new wiring or repairs to electrical wiring, at a time when the office of the Electrical Inspector is closed, the work may be carried out without first obtaining a permit. Thereafter, a written application shall be submitted to the Electrical Inspector for a permit during the next day that such office is openo Before the permit shall be issued, all requirements for its issuance must be complied with. Division 2. Inspection and Fees A. Inspection procedure. Section 11A-z6. Rough-in Inspectiono Upon completion of rough-in installation, the master electrician or his auth- orized representative in charge of any specific project shall immediately request the Electrical Inspector's office for an inspection of the work completed. This preliminary or roughoin inspection shall be completed and approval obtained before such electrical work is covered or concealed. Section 11A-71o Final rnspeotiono Upon application of the master electrician or his authorized representative in charge of the project, the Electrical Inspector shall make a final inspection of the installation and if suoh work is found to comply with this Code, a certificate of inspection shall be issued stating that the work has been done according to the provisions of this Code and the rules governing the respective class to which it belongs. SUch certificate shall not relieve the master electrician of responsibility for ~ defective work that may have been concealed or es?aped the notice of the Electrical Inspector. -19- Section 11A~78.. Pur~ose of red, blue and ze!low t ags o At the completion of the initial or rough-in inspecti on, the Electrical Inspec- tor or hie deputy shall, if such installation is approved, cause a blue approval tag to be affixe.d to a visible and accessible point on the el ect rical work approved. If such inspector determines that such installation is not accept able, he shall affix to such electrical work a red "violation" tag which shall have printed thereon in substance a warning that the work or installation will not pass inspection, and that it is a violation of City ordinances to conceal or continue any of the el ectrical work until the installation is re-inspected and approved. If upon re-inepection, the violation has been satisfactorily corrected, the Electrical Inspector shall then cause the red violation tag to be removed and a blue approval tag to be affixed in its plaoe .. The same process shall be followed upon the final inspection with a red violation tag to be affixed if the installation is not approved., Approval on final inspection or final re-inspection, shall be denoted by placing of a yellow approval tag on the approved installation .. Whenever a red violation tag is affixed on the installation at either the rough-in or final inspection, the Electrical Inspector shall note on the back of such tag the precise violation involved and suoh other factual information as the Electrical Inspector may feel necessar.y to inform the master electrician of the specific item or items that need to be corrected .. No person9 firm or corporation engaged in any work at the building site shall ever cause, allow or suffer electrical work to be covered over unless same bears an inspection tag showing final approval, nor shall any red, blue or yellow in- spection tag be affixed to any electrical work by an10ne other than a City Elec- trical Inspector or his deputies .. It shall be unlawful for any person to remove destroy or deface a red, yellow or blue tag, or for ~ lather, carpenter or any other person to conceal ~ wiring or conduit whioh has not been approved as indicated by the presence of the inspection tag. The Electrical Inspector shall have the authority to require ~ person, firm or corporation to unoover any wiring or electrical equipment which has been con- cealed without the knowledge or permission of the Electrical Inspectoro Section 11A~J9. Time of making ins~eotions. Upon receipt of an application requesting inspection, the Electrical Inspector shall inspect or cause to be inspected such work within twenty-four working (24) hours after reoeiving such application. Section 11A-80. Clearnace from Electri cal Inspector before furnishing current by utility comP&nyJ reconnection or disconnected servicec It shall be unlawful for any utility company operating in the City to furnish current to any new building, tent, structure or outdoor wiring of any kind, nature or description without first obtaining a clearnace from the City Electrical Inspector, stating that such wiring is approved and a permit hae been issued for use of current. B. Permit and Inspection Feeso Section 11A-81. Deposit when number of fixtures, ~utlets2 etc .. , not shown. -20- If, at the time application is made for a permit, the number of outlets, fix- tures, etc., is not known, a deposit of ten dollars shall be made before any in- stallations are madeo On completion of such installations, if the deposit is more then the amount required, a refund of the balance shal: be made. If additional fees are due, such amount as is required shall be submitted to the Electrical Inspector before final inspection is made. Section 11A-82. Fees ~-New residential constructiono The following fees shall be charged by the City and must be paid before a permit for electrical work on a new residential construction is issued or work thereon is donal The permit fee shall be sum equal to one-half of one cent ( $0.0050) per square foot of floor space in the contruction as planned. When more than one re·inspection is required a re-inapection fee of $2o50 for each re- inspeotion will be chargedo If the owner is doing his own work, the inspection fee is payable in advance. Section 11A-83o Fees --All other types of construet\on. Section 11A-84. Same -For in!P~cticn of elevators and escalatoreo In addition to the stipulated fee for motors, there shall be an inspection fee of five dollars for each passenger elevator and escalator, and three dollars for each freight elevatoro Permits for elevator and escalator installation shall be taken out and paid £or by the master electrician. §!ction 11A-85o Same -Carnivals, circuses1 etc. Carnivals, circuses or other places of amusement using structures composed wholly or partially of canvas or similar materials shall be considered as tem- porary for a period not exceeding fifteen days. Any construction work shall be done b.y a bonded and licensed master electrician who shall take out a permit and pay the ten dollar fee. Section 11!-86. Same -Exemptio~s. The City, school districts, county, state and United States shall be exempt from paying any fee for any electrician installation required under this chapter, but a permit shall be applied for and issued for such work. Article v. Specifications Division I. In General Section 11!-87• General Requirements as to installation of wiring, fixtures a~ apparatus. In the installat ion of all wiring, fixtures and apparatus, the rules and requirements adopted by Section 11!-5 shall be complied with, together with the rules contained in this chapter, and such addi tional requirements as may £rom time to time be adopted. Section 11A-88. Requirements in fire zones --Wiring. All wiring in Fire Zones 1, 2, and 3 shall be rigid metallic conduit, metal tubes, approved metal raceways or approved multi-outlet assemblies, escept that in Fire Zone ;, single-family residences and out-buildings on same premises, duplexes and apartments of not more than four families, dormitories and rooming houses with not more than six roomsfor sleeping accomodations may be wired with knob and tube or non metallic sheathed cable as a minimum requirement. Provided, however, if ~ part of a residence or other building is converted to any commercial purposes not within the above exceptions, the entire building shall be classified as business premises, .and the entire building shall be rewired in accordance with the requirements for Fire Zone Nos~ 1 and 2. This sub-section is not to be construed as including self-generated control systems. (b) All central heating equipment shall be on a separate circuit with a means of disconnecting said equipment to be installed in the equipment room. Overload protection shall conform with the NEC, NBFU No. 70, and shall be closely coordinated with the motor ratingo All electrio wiring or cable shall clear all duct or ducts by a minimum of three inches. (c) All low voltage transformers such as may be used for door bells, floor furnanoes, etc., shall be on a circuit other than appliance oirouit and shall be installed in a convenient and readily accessible place. Section 11A-90. Same --Outlet in ironing board cabinet. No outlet will be allowed in an ironing board cabineto Section 11A-21• ~ cleaning plant requirements. All new dr,y cleaning plant installations in which flammable solvent are used shall be wired to comply with the requirements established for Class 1, Division 1, locations qy the edition of the National Electric Code herein adopted and Bulletin N.B.F.U. ~2, dated June, 1956o Section 11A-92e Chain pull or insulating link cords prohibited. No chain pull or insulating link cord shall be permitted in electrical in- stallations for bathrooms, washrooms or like locations. Section 11A·9~. Existing wiring to oomply with chapter. When additions to or alterations of existing wiring are made in either residences or commercial buildings, all such wiring shall have over-current pro- tective devices installed for the existing wire sizes in accordance with the requirements of this chapter and the National Electric Code herein adopted. Section 11A-94o Protective devices --Generaltyo A. Circuit protection shall consist of nontamperable S fuses, one-time fuses, time-del~ fuses, or circuit breakers. The amperage rating of the protective devioe shall not exceed. the ampaoity of the conductor on which it i s used. The Electrical Inspector shall require the installation of nontamperable type S over- current devices on existing circuits which are protected with plug fuses. B. Common ground shall be brought to an accessible point and connected to the water system on the cold water side or to other approved _ground. -23- Co Renewable link cartridge fuses shall not be usedo One-time and time- del~ fuses shall be the only type permitted. Motor circuits whioh require fuses shall have time-delay fuse for protectionso Do FUse panels, circuit breakers and the like shall not be placed in hot water closets, bathrooms, or clothes closetso They shall be located where they are readily accessible to the tenanto Control equipment and over-current devices shall not be installed in an area exceeding 140 degrees F or their maximum safe operating temperature. ~action 11A-95o ~oM.T. -Electrical Metallic Tubing Useo No electrical metallic tubing (E.M.T.) shall be permitted in any electrical installation where such tubing is in contact with the ground or dirt or in a con- crete slab in contaot with the ground. Section 11A-96o Service receptacles for trailer homes. Mobile homes or trailers used as such shall have a minimum of a 50 amp, four wire grounding receptacle for eaoh mobile home or trailer unit. These receptacles shall be installed and protected in accordance with the N.E.C. and the provisions of this chapter. Section 11A-27. Electric welders; must pear name of manufaoturest current ratiBS and approval o~ N.BoF.U. No electrical welder of the transformer reactance type shall be connected in the City, unless it bears the name plate of the manufacturer, its current rating and the stamp of approval of the National Board of Fire Underwriters. Section 11A-98. Meter Installation. Each meter socket installation shall be on the outside of the building, residence or other structure and shall be mounted not more than eight feet nor less than six feet above the level of the standing space except when the device or area for mounting the meter base is provided by the serving utility. Section 11A-29.~ Moved buildings4 When a residence or building is moved from one locatton to another within the City limits or into the City limits, the wiring of such building shall be made to comply with the provisions of this chaptero Section 11A-100. Point of Attachment. The point of attachment of overhead service drops on a residence or building shall be on the rear of the building (alley aide)o Section 11A-101. Meter Loops --Generally. Each meter loop shall consist of a meter socket, weatherhead, nec~ssary con- duit and wires, and shall be furnished and installed by the owner or contractor of the premises where the installation is being made. Meter sockets shall be of a standard type tor plug-in meters and must meet the approval of the Inspector. -24- Section 11!-102. Same--Installation by public utilill• {A) For service entrances where the electrical load to be connected requires a main panel, or main panels, with a rated capacity of 200 amperes or less~ or which has service entrance conductor rated 200 amperes or less; the load will be metered b,y a self-contained device, and the owner or contractor will furnish the meter base or meter trougho (B) For service entrances where the electrical load to be connected requires a main panel or main panels, rated over 200 amperes in capacity, and also requires conductor capable of carr.ying more than 200 amperes, the utility company will furnish all metering equipment. The owner or contractor in this ease will be required only to bring the service entrance conductors to the rear of the building in accord- ance with this chapter. In case of dispute the Electrical Inspector shall be the arbitrating authority. ~ection 11A-103o Same ~-Rewiring necessitating moving of meter. When an1 rewiring is done to ~ existing installation necessitating the moving of the meter, the meter socket and loop shall be reinstalled as provided by Sections 11A-98 and 11A-101. Sections 11A-104. Joints untaped until property soldered or spliced. Where joints are found, to be taped but not soldered, or spliced with an approved mechanical device, the Inspector may require all joints to be untaped and left untaped until soldered or spliced with an approved mechanical device. Section 11A-102• Li~htin& in closets. No light shall be approved in clothes closets except ceiling lights con- trolled by wall switches or approved ceiling switches. No drop cord lamp shall be approved in clothes cloeetso Section 11A-106. Si~al wire near lisht or power wire • • No bell wire or other signal wire shall be run so as to come in contact with or nearer than five inches to any light or power wire, unless such light or power wire is protected b.y procelain tubes, flexible tubing, non-metallic sheathed cable, metal armor or conduit. Section 11A-101. Conduits -~ Generalll• The National Electrical Code shall be used for a guide in conduit installa- tionso In conduits systems before all plastering and cement work has been oom• pleted, a means shall be provided to prevent foreign matter from entering conduit. Section 11!-108. Same --Inspec~ion Noticeo When, under the terms of this chapter, wiring is required to be protected by conduit, the inspection notice shall be filed with the Inspector as soon as the oonduit is installed, eo that it may be inspeoted before being concealed, except risers in WGI~v·.~~ Section 11A-102o Same •• Enameled conduit not approved when ~n contac] wi]h 5!0un4. Enameled conduit shall not be approved when laid underground or in a concrete floor or wall, in contact with the groundo ~~ction 11A-110. C~es in concealed wiriPH• When an electrical contractor or owner is notified of changes in wiring to be concealed, he must make such changes at once, and in all cases must notify the Inspector immediately upon making the changes and before concealing the wiring. Section 11A-111. Size of conductors. No conductor smaller than Noo 12 American Wire Guage size shall be used in electrical work as covered by this chapter, except the following as approved by the National Electrical Code: (e) (h) Pendant and portable cords. Fixture wire. No. 14 for individual fixture leads at outlet box. No. 14 for control circuits operating contactors, relays or size as approved b.y the manufacturers and the Electrical Inspection Department. Wiring for systems covered by Article 700 of the National Electrical Code. As specified under electrical signs. No. 14 may be used for switch loops only when protected as required by Art. 240-15, Exception #2, of the National Electrical Code. In residences No. 14 in circuits for lighting only, provided, no con- venience outlet is served by such oirouito Section 11A-112. Residence Circuits -General. Each dwelling occupancy, including each occupancy of a multiple-family apartment, shall have three or more twenty ampere circuits supplying all receptacles in the kitchen, breakfast room, dining room, and laundr,y room, which shall supply no other outlet and no fixed appliances. All remaining receptacles and lights must be equally divided on fifteen to twenty ampere circuits. General lighting shall be computed on a "watts per square footn basis and the unit load shall be four watts per square foot. The panel provided for eaoh dwelling occupancy shall include space and capacity for two additional circuitso Section 11A-11~. Startipg of motors. Any motor requiring over one hundred instantaneous KVA for starting shall not be started "across the line" without permission of the utility company. Section 11A-114. Service Wires --GenerallYo (a) Service wires from the utility company poles to the customer's entrance fitting shall be installed, owned, and maintained b,y the utility companyo Where underground service conductors are carried up a pole, rigid conduit shall be installed to the meter base. Rigid conduit, or E.M.T. with approved fit- tings, shall be used from the meter base to within 18 inches of seoondar,y. Written permission shall be obtained from the serving utility company before installing conduit and/or meter base on any utility company pole. . -26- (b) Overhead .Serviceso SUpport for overhead residential service cable will be at least eight (8) feet above finished grade. Support for overhead commercial service cable will be at least thirteen and one-half (13¥2) feet above finished grade. If a mast is used, the minimum requirement is two inoh rigid steel condui t. On mast installati ons, the point of attachment for the service cable will be twenty- four inches above the roof. Section 11A-115. ~Zame ·:Concealed wiriA& furnished2 installed, etco, by customers. If a~ customer prefers the service wires to be installed in conduit, or any other type of concealed wiring, all conduit, entrance fitting, meter sockets and wires placed in the conduit shall be furnished, installed and maintained b.Y the cus- tomer. Section 11A-116. Same ··Utility company not to install equipment beyond point of entranoeo The utility company shall furnish and maintain overhead exposed service wires up to the entrance of a~ concealed wiring. Section 11A-112• Permit for tempora;r installation of fixtureeo Where fixtures are installed. temporarily or for approval, a temporary permit must be secured from the Electrical Inspector, and the permit will expire at a stated time as shown on the permit. S!9~ion 11A-120e Wiring of recessed fixtureso Eaoh fluorescent fixture ballast not provided wi th internal thermal protection shall be fused at not more than 125% of primary current rating of the ballast. Section 11A-121. Flood lights on separate circuitso Flood lights shall be on separate circuits from sign circui ts, and no other outlets shall be served. Division 3. Signs, Requirements, Permits and Fees Section 11A-122. Permits r~~uiredo No person shall begin the work of installing, erecting or altering internally -27- lighted or neon signs in or on anT building or premises in the City of Lubbock with- out first securing a permit therefor from the Electrical Inspector. The repairing or replacing of movable parts of signs which are designed for changing, or the re- painting of displ~ matter or the repairing of damaged neon tubing while a sign is in place shall not be deemed to be installing, erecting or altering signso Applica- tion blanks for permits shall be furnished by the Electrical Inspector who shall approve and countersign them. Section 11!-123. Same -~ Fees. (1) All signs erected by the municipa4 state or federal government for the purpose of public instruction, street or highway designation, control of traffic and similar uses incidental to the public interest. (2) All signs of warning, directive, or instructional nature erected by a public utility or transportation organization which operates under a franchise from the City of Lubbock, permitting the use of public pro- perty for the display of such signs, provided such signs shall be deemed b,r the City Manager to be necessary for the successful operation of the utility, and provided that special permission for their erection is granted b.y the governing bo~. Section 11A-125. Si&gs must conform to zonina. No permit shall be issued for any neon or internally illuminated sign in a district where signs are prohibited by the zoning ordinances, nor shall any permit be issued for any sign which does not conform to the zoning requirements of the area in which the sign is to be placed. Whenever there is a conflict between the provisions of this Chapter governing signs and the provisions of the zoning ordinances of the City of Lubbock, the provisions of the zoning ordinances shall control. Section 11A-126o License R~quired for Manufacturi ng or Assemblz. No person other than the holder of a master s ign electrici an license and bond, or a journeyman in his employ -, shall repair, alter, manufacture or assemble any electrical internally illuminated or neon sign for either permanent or temporary use within the Oity of Lubbock. Section 11A-127. Definitions. For the purpose of this subdivision the foll owi ng definitions shall apply: (1) Signs. The term "sign" shall mean only those structures erected with neon tubing, structures which inolude interior lighting and structures incorporating incandescent or gaseous discharge lamps as a design feature. -28- (2) Ground Sign. Any sign which is erected on a vertical frame-work consisting of two or more uprights supported by the ground. (3) Parapet Wall Signo Any sign erected on the top surface of a parapet wall. {4) Pole Sign. Any sign supported b,y a single-standing pole9 and having no guys or braces to the ground on to any structure other than the pole. (5) Projecting Signo Any sign which projects from a building and which has one end attached to a building or other permanent etruotureo (6) Roof Signo Any sign erected on a vertical framework supported by and located immediately and entirely over the roof of a building. (7) Marquee Sign. Any sign erected on a marquee or fixed awning. {8) Wall Sign. ~ sign erected on a vertical framework supported by the wall and having the sign faoe parallel to and not more than fourteen inches from the wall surfaoeo (9) Window Signs and OUtline Lighting. Any neon or tubing installed on the inside of a window, other than interior merchandising signs of plug-in type. ~action 11!-128. General Requirements. The following requirements shall apply to all neon and interior illuminated signs installed within the City of Lubbock. (1) All signs shall bear the name of the oontraotor and manufacturer and date of erection, painted on, or otherwise attached to the lower margin of the sign. readily visible after the sign has been installed. All signs shall be marked with the input amperes at full load and the input voltage, and with its rated frequency. (2) All neon or interior illuminated signs shall be manufactured according to the specifications of this chapter and must also pass local inspection before being closed up or hung in plaoe. (;) No sign shall be attached in any manner to any fire escape or to the sup- porting members of any fire escape, nor shall it be guyed to or sUpported by any part of a fire escape. (4) All eigne shall be constructed so as to prevent the accumulation of rain water in the sign. (5) No sign shall be erected so as to affect the stability of any parapet wall. (6) Clearances of signs must conform to Uo So Bureau Standards Hand Book #81, from any telephone cable, power line, or any street light standard or circuit. The clearances provided b.y said Hand Book #81 are hereb,y adopted, attached hereto and made a part of this chapter. (7) No sign shall be eo erected as to block, partially block, or interfere in any way with a required means of exit from any building nor from any window. -29- (8) No sign shall be so erected as to interfere with any traffic signal, blinker light, or warning device or to confuse those persons governed by such signals o · (9) For purposes of design of structural members in signs, an assumed wind load in accordance with Chapter 46 of the Building Code will be used~ (10) If, for any reaaon, any sign now maintained or hereafter erected en, maintained over, along or across any public sidewalk, street or highway or locally where a building has been set back at some distance from the property line for the purpose of leaving parking space for automobiles between the original curb line and the building, shall become dangerous to like, limb or property, or be an obstruction to the proper use of the sidewalk, roadway or other public property or interfere with the efficient operation of the fire department, it shall be the duty of the Electrical Inspector to issue notice to the owner of such sign, or his agent, to remove same. (11) Inspection of all signs shall be made, and regulations for the method and time of such inspections shall be determined by the Electrical Inspectoro Each license holder shall be kept i nformed of and be governed by such regulationso (12) The limiting dimensions given in t he detailed requirements which follow shall include all ornamentation unless otherwise specifically statedo (13) On all outdoor electric signs, all wiring and other current-carrying parts, other than lampholder contacts, electric-discharge-lamp starters, and starter-holder contacts, shall be enclosed in metal or other material sufficiently noncombustible for the purposeo The enclosure shall have ample strength and rigidityo ( 14) The enclosure for an outdoor sign shall, as far as practical , be rain- tight. Doors shall effectively exclude raino Seams need not be soldered or otherwise treated, but shall be reasonably tight and where practicable, shall be so formed as to shed water. Openings in tops to accommodate electrodes, bushings, or tubing shall not be permitted unless made rain- tight. (15) 'Each compartment of an outdoor sign shall be provided with two or more holes to permit complete drainageo A drain hole shall not be less than '1/4 inch nor more than 1f2 inch in diameter, and shall be free of burrs so that stoppage will be unlikelyo (16) All sheet steel and other mechanical parts of iron or steel shall be galvanized, cadmium plated, or otherwise suitably protected against corrosion. Structural iron or steel parts shall be galvanized, cadmium plated, enameled, painted, or provided with equivalent protection against corrosion on all surfaces, prior to aesemblyo (17) Each sign or section of a sign forming a complete enclosure, other than the cord-connected type, shall be provided with means for attaching it to a building wall or to a support or hanging rig. (18) A sign designed for permanent installation shall have provision for the connection of a permanent wiring system. ~30- (19) Circuits shall be so arranged that in no oase will a load of more than 15 amperes be placed on a ·branch oirouit within a sign or to which the sign may be connected. (20) The high-voltage wiring of an outdoor sign shall employ gas-tube sign cable with a voltage rati ng not lese than the maximum secondary voltage rating of the transformer with which i t is used. (21) A bushing or recep•tacle of a recognized type shall be provided where electic-discharge tubing passes through a sheet-metal wall or partition of an outdoor eign or an indoor sign operating at a potential higher than 7500 volta, unless the tubing is supported so as to positively maintain a spacing of not lese than ¥4 inch between the tubing and the grounded metal where the tubing passes through the wall or partition. (22) Standard transformers designed for use in eleotrio-disoharge.tube signs or standard ballasts designed for use with eleetrio-disoharge lamps shall be used. A transformer used in an outdoor sign shall be of the weather- proof or outdoor-use type. A ballast used in an outdoor sign shall be of the weatherproof or outdoor-use type. An open core-and-coil trans- former or an open core-and-coil ballast shall not be used in other than a cord-connected signo Re-built transformers are not acceptable in new sign construotiono (23) A transformer or ballast, other than a through-cord ballast, shall be secured in place in a reliable mannerc A transformer or ballast shall not be mounted on a door nor hung so that the entire weight is suspended from a single sheetmetal side, face, or topo (24) Fuseholders, panelboards, flashers, switches, and similar devices, if on or within the body of the sign, shall be mounted in a separate, ac- cessible compartment., The compartment shall be of metal not thinner than that of the sign itself, and JL&y be formed in part by surfaces of the sign body. In an outdoor sign, such a compartment shall be reason- ably raintighto Section 11A-129. Detailed Requirements. (1) Parapet Walls Si gns. Parapet wall signs shall be constructed entirely of noncombustible materials. Invidivual letter si gns erected on a parapet wall shall be constructed of noncombustible material.. Attachment of such signs shall not damage or affect the stability of any parapet wall. (2) Pole Signs. (a) (b) (c) (d) (e) (f) Pole signs shall be const ructed of noncombustible materials. When the sign consists of a vertical section only and arms or brackets shall measure not more than twenty-four (24) inches from the pole to the sign. End arms or brackets for horizont al sections shall not exceed twenty- four (24) inches in length., G~s and braces for pole signs shall be attached only to the sup- porting pole and to no other structure., In no case shall any part of a pole sign be less than one (1 ) foot from the face of the street curb. When a pole sign is hung from a mast-a.rm ·the inner end of the sign shall not be more than twenty-four (24) inches from the paleo When a pole sign projects over the sidewalk, no part of the sign except the supporting pole shall be less than none (9) feet from • ' t .· .. t • the sidevalk immediately belowo When a pole sign projects over a driveway, parking space, or head-in parking, no part of the sign ex- cept the supporting pole shall be less than twelve (12) feet from the grade immediately belowc (3) Projecting signso (a) Projecting signs shall be constructed entirely of noncombustible materialso End arms or brackets shall measure not more than twenty- four (24) i nches from t he bu~lding face to the sign. When the sign is supported by a mast-arm, the inner end of the sign shall not be more than twenty-four (24) inches from the building face. (b) Every projecting sign shall be hung at a.n angle of ninety (90) degrees with the face of the building or structure to which it is attached except when placed at the corner of a building so as to be seen from two streets. And no part of any projecting sign shall be less than eight (8) feet above the sidewalk immediately below, nor more than 2/3 of the width of the sidewalk from the face of the building, nor less than twelve (12) feet above ~ driveway or head-in parking space below. (4) Roof Signs (a) (b) (o) (d) Roof signs shall be constructed of noncombustible materials except that working platforms lll8\Y be of woodo No roof sign shall exceed the height limit for buildings fixed by the zoning ordinance of the City of Lubbock. All roof signs of any height shall be designed to withstand an assumed wind load of thirty (30) pounds per square foot. The supporting structure of any roof sign shall be built entirely of noncombustible materials and so designed as to transfer the imposed load direct~ to the permanent frame or structure of the building on whioh it is erected. All metallic parts of ~ roof sign shall be provided with an adequate ground as protection against lightning. The roof of acy building upon which a sign is erected shall be covered with a fire-retardant roofing material. ( 5) Marquee Signs. (a) (b) Signs erected on the faces of a marquee and built as an integral part of the marquee shall be constructed entirely of noncombustible materials. Signs erected on the top or edge of existing marquees or fixed awnings shall follow the contour of the marquee and shall be constructed en- tirely of noncombustible materialso (6) W'all Signso (a) No part of ~wall sign shall be located within nine (9) feet of the grade immediately below, exoept when the sign is entirely over pri- vate property and not over a sidewalk used b,y the public. Neon tubing when placed directly on the face of an exterior wall shall be not lese than eight (8) feet above the grade i mmedia t ely bel ow. (7) Window Signs and Outline Lighting. The installation of any illuminated sign or neon tubing on the inside of any window shall oonform to N.E.C. Section 11A-130. Reserve this section for future use. Section 11A-131. Transformers Placed in Attics. Transformers (auxiliaries) shall not be placed in attics, unless in approved metal· cabinets and be aooeseible. Section 11A-132o Circuit and Transformer Limits. (a) (b) (c) (d) Primary circuit for neon transformer shall not have more than one thousand, three hundred and twenty watts connected load for No. 12 SWG wire. Primary circuit for neon transformer shall not have more than two neon transformers of fifteen thousand volt sixty milliampere rating connected to a twent.y ampere circuit. Primary circuit for neon transformer shall not have more than one neon transformer of fifteen thousand volt one hundred and twenty milliampere rating connected to a twenty ampere circuit. Flasher unit shall be placed in an accessible section of sign eo that sign will not need to be disassembled or glass or neon removed to service flasher. Section 11A-133. Reserve this section for future use. Section 11A-134· Permits --Issuance Procedures. Permits to install, erect, or alter signs as required by this Code shall only be issued to a licensed and bonded master sign electrician, and the form of permit, application, and all other procedures in relation thereto shall follow the proced- ures governing the issuance of other electrical permits as established in this Code. Provided, however, signs commonly referred to as a "packaged" sign, that is a sign which is not a part of a greater sign complex and which is a completely self-con- tained individual unit and assembled with the exception only of the installation of incandescent or gaseous discharge lamps and whioh bears an Underwriters Lab- orator.y label and which does not exoeed twenty-five (25) square feet on one side surface area and which does not consume more than fifteen hundred (1500) watts of power, may be erected by aey person upon aeouring a permit and complying with every other section and paragraph of this Code and all other ordinances relating to sign erection. Section 11A-139o Unlicensed electricianso It shall be unlawful for any licensed electrician to allow any unlicensed electrician or unregistered apprentice to work at a~ job site or electrical in- stallation project under his control or supervisiono Section 11A-140o General penaltyJ continuing violations. Whenever in this Code an act is prohibited or is made or declared to be un- lawful or an offense or a misdemeanor, or wherever in such Code the doing of any aot is required or the failure to do any act is hereby declared to be unlawful, the violator of any such provision of this Code shall be punished by a fine of not exceeding two hundred dollarso Each d~ any violation of this Code shall con- tinue shall constitute a separate offense. ARTICLE VII. GENERAL Section 11A·141o Present licenses and bonds to continue in effeoto All licenses, bonds and permits lawfully held at the time this ordinance goes into effeot shall continue in effect until their date of expiration as if they had been secured under the terms of this ordinanoed Such shall be governed by the terms of this ordinance from and after the date it becomes effective. Section 11A-142. Severability Clause. Should any section, paragraph, sentence, clause, phrase or work of this Ord- inance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. •. ,. . The Electrical Code as codified .under Chapter 11A of the Lubbock City Code is hereqy specifically repealed in its entirety. and the present Ordinance shall con- stitute the new Chapter 11A of the Lubbock Cide Code. All other ordinances or parts of ordinances inconsistent with or conflicting with the terms hereof are hereby re- pealed. Section 11A-144• Con~truction Against Implioi~ Repeal • This Ordinance being a general ordinance intended as a unified coverage ~£ its subject matter, no part of it shall be deemed to be impliedlT repealed qy subsequent ordinances if such construction can reasonably be avoided.
