VOL 5351PACE 56 ORDINANCE NO. 9948 ----- AN ORDINANCE ABANDONING AND CLOSING PORTIONS OF A RIGHT-OF- WAY EASEMENf LOCATED IN SECTION 25, BLOCK A, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARL y DESCRIBED IN THE BODY OF nns ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the easement portions hereinafter described in the body of this Ordinance are no longer needed for easement purposes and for public use; and WHEREAS, the City Council finds it would be in the public interest to close, vacate and abandon the same for easement purposes and for public use; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the easement portions as hereinafter descn"bed shall BE and the same are hereby closed, vacated and abandoned for easement purposes and for public use, such easement portions being more particularly described as follows: A 30 foot public right-of-way easement recorded in Volume 977, Page 585, Deed Records of Lubbock County, Texas, being further descn"bed as follows: BEGINNING at a 1/2" iron pipe found at the Northwest comer of this easement which bears S. 0°25'15" W. a distance of2323.78 feet, and N. 89°35'44" W. a distance of 3282.84 feet from the Northeast comer of Section 25, Block A; THENCE N. 45°50' E. a distance of 480.90 feet to a 1/2" iron pipe found at the Northeast comer of this easement; THENCE S. 0°25'1S" W. a distance of 42.12 feet to a point for the Southeast comer of this easement; THENCE S. 45°50' W. a distance of 480.90 feet to a point for the Southwest comer of this easement; THENCE N. 0°2S'lS" E. a distance of 42.12 feet to the Point of Beginning. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City ofLubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. , J VOL 5351PAGE 5 7 SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
