ORDINANCE NO. 9939 -----
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE
OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES:
ZONE CASE NO. 2658-C; A ZONING CHANGE FROM C-3 TO A-2 ZONING ON A
TRACT OUT OF TRACT A, MONTEREY CENTER ADDITION, LUBBOCK, TEXAS;
SUBJECT TO CONDITIONS; PROVIDING A PENAL TY; PROVIDING A SAVINGS
CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, the proposed changes in zoning as hereinafter made have been duly
presented to the Planning and Zoning Commission for its recommendation which was received
by the City Council and, after due consideration, the City Council found that due to changed
conditions, it would be expedient and in the interest of the public health, safety and general
welfare to make those proposed changes in zoning; and
WHEREAS, all conditions precedent required by law for a valid amendment to the
Zoning Ordinance and Map have been fully complied with, including giving notices in
compliance with Section 29-29 of the Code of Ordinances, City of Lubbock, Texas, and the
notices provided by the Texas Local Government Code §211.007 (Vernon, 1990), and notice was
duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of
the public hearing before the City Council on such proposed amendment, and the public hearing
according to said notice, was held in the City Council Chamber of the Municipal Building,
Lubbock, Texas, at which time persons appeared in support of the proposal; and after said
hearing, it was by the City Council determined that it would be in the public interest, due to
changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner
hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced
prior to first reading hereof; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
ZONE CASE NO. 2658-C
SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map are amended as
follows:
A change of zoning under the provisions of Section 29-29 of the Code of
Ordinances of the City of Lubbock from C-3 to A-2 zoning district on a tract out
of Tract A, Monterey Center Addition, City of Lubbock, Lubbock County, Texas,
located North of 54th Street and East of Gary A venue, subject to conditions and
being more particularly described as follows:
BEGINNING at a 1/2" iron rod with cap set in the East right-of-way line of Gary
Avenue for the Northwest comer of this tract, which bears N. 89°58'50" W. a
distance of 1242.41 feet and South a distance of 760.79 feet from the Northeast
comer of the Northwest Quarter of Section 7, Block E-2, Lubbock, Lubbock
County, Texas;
THENCE S. 86°29'15" E., a distance of 668.39 feet to a 1/2" iron rod with cap
found at the Northeast comer of this tract;
THENCE South, at 240.10 feet pass a 1/2" iron rod found at the Northwest comer
of Tract "B", Monterey Center Addition, continuing along the West line of said
Tract "B" for a total distance of 505.14 feet to a 1/2" iron rod with cap found at
the most Southerly Southeast comer of Tract "A";
THENCE N. 86°29'15" W., along the North right-of-way line of 54th Street, a
distance of 629.90 feet to a point of curvature;
THENCE Northwesterly around a curve to the right, said curve having a radius of
15.94 feet, a central angle of 86°29'16", tangent lengths of 14.99 feet and a chord
distance of 21.84 feet to a point of tangency in the East right-of-way line of Gary
Avenue;
THENCE North, along the East right-of-way line of Gary Avenue, a distance of
34.22 feet to a 3/4" iron piep found at a point of curvature;
THENCE Northwesterly, continuing along the said East right-of-way line of Gary
Avenue, around a curve to the left, said curve having a radius of 3049.41 feet, a
central angle of 03°45'20", tangent lengths of99.98 feet, and a chord distance of
199 .84 feet to a 1 /2" iron rod with cap found at a point of tangency;
THENCE N. 03°45'20" W., continuing along the said East right-of-way line of
Gary Avenue, a distance of259.19 feet to the POINT OF BEGINNING.
SUBJECT TO THE FOLLOWING CONDITION:
a. That the use shall be limited to a retirement community.
b. That it be tied to site plan 2658-C as presented to the Planning and Zoning
Commission and signed by the Chairmk on August 1, 1996.
c. That should a shortage of parking be verified by the Planning Department
or Environmental Inspection Services Department, the owner shall be
notified in ,writing to install an adequate additional number of parking
spaces.
SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a
misdemeanor punishable by a fine not to exceed Two Thousand and Noll 00 Dollars ($2,000.00)
as provided in Section 29-31 of the Zoning Ordinance of the City of Lubbock.
SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this
Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance
shall not be affected thereby.

SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the
descriptive caption of this Ordinance as an alternative method provided by law.
