Home My WebLink AboutOrdinance - 9928-1996 - Altering Prima Facie For School Zones. - 08/08/1996First Reading August 8, 1996 Item #19 Second Reading August 22, 1996 Item #7 ORDINANCE NO. 9928 AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMIT FOR THE SCHOOL ZONES IN THE CITY OF LUBBOCK AS HEREINAFTER MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; AUTHORIZING PLACEMENT OF SCHOOL SPEED LIMIT SIGNS BEACONS AND O1HER SIGNS AND MARKERS IN ACCORDANCE WITH CITY POLICIES; PRESCRIBING A PENALTY; PROVIDING FOR PUBLICATION; REPEALING ALL ORDINANCES IN CONFLICT · HEREWITH TO THE EXTENT SUCH CONFLICT EXISTS; PROVIDING THAT ALL lliGHWA YS OR STREETS NOT SPECIFICALLY MENTIONED HEREIN SHALL NOT BE AFFECTED BY THE PROVISIONS OF THIS ORDINANCE; PROVIDING THAT THE SCHOOL SPEED LIMIT WNES HEREBY ESTABLISHED SHALL BE CUMULATIVE EXCEPT WITH THOSE WITH WHICH IT SPECIFICALLY CONFLICTS; PROVIDING A PENAL TY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. 1 WHEREAS, the governing body of the City of Lubbock, finds that the safety of the ! citizens of the City of Lubbock and the preservation of the public health and safety requires, upon the basis of engineering and traffic investigations, that the maximum reasonable, prudent, and safe speed upon-the streets or highways, or portions thereof, of the City of Lubbock, during the periods designated below, is the number of miles per hour hereinafter set forth; NOW THEREFORE: : BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 16-175.2 of the Code of Ordinances, City of Lubbock, Texas, is hereby amended to read as follows: Section 16-175.2. THAT ~e City Engineer is hereby authorized and directed to mark the official maps of .•the City of Lubbock to reflect said installation or modification of said speed zones and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable in accordance with the provisions of Section 1-4 of the Code of Ordinances of the City of Lubbock. SECTION 4. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. -5 - SECTION 5. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
