HomeMy WebLinkAboutOrdinance - 9927-1996 - Amending Chapter 24 Adding New Section 24-38 Procedures Changing Street Names - 08/08/1996First Reading August 8, 1996 Item #18 Second Reading August 22, 1996 Item #24 ORDINANCE NO. 99 27 ----- AN ORDINANCE AMENDING CHAPTER 24 OF Tiffi CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, BY ADDING TIIERETO A NEW SECTION 24-38 :\ ESTABLISHING PROCEDURES FOR CHANGING STREET NAMES; PROVIDING A PROVISION EXEMPTING A PRIOR REQUEST TO CHANGE THE NAME OF AVENUE H '\• FROM MUNICIPAL DRIVE TO 24TH STREET TO "BUDDY HOLLY AVENUE" FROM APPLICATION OF THIS ORDINANCE; PROVIDING A SAVINGS CLAUSE AND \ PROVIDING FOR PUBLICATION. \ WHEREAS, the City Council of the City of Lubbock deems it to be in the best interest of the citizens of the City of Lubbock to establish a policy with regard to changing street names; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: \ SECTION 1. THAT Chapter 24 of the Code of Ordinances· of the City of Lubbock, : Texas, is amended by adding a Section 24-38 to read as follows: I . "Sec. 24-38. Changing street names. (1) Pmpose. The purpose of this Section is to establish uniform criteria and procedures, applicable to all persons, groups, firms, and agencies, for the permanent change of city street names. (2) Application for nrune change. An application to change a street name may be filed with the City Engineer when it is accompanied by a petition approving the proposed name change signed by more than fifty percent (50%) of the owners of land abutting the street for which a name change is proposed. Application and petition forms shall be provided by the City Engineer's office. The application shall contain the following information: (a) the current official street name; (b) the proposed street name, which shall meet the policy guidelines of this chapter; (c) the name, address and telephone number of the• person, persons, corporation, association, group or entity proposing the name change; (d) (e) the name, address and telephone number of one person with authority to represent binding commitments and take official action relative to such street name change on behalf of the proponents. an application fee of Two Hundred and Noll 00 Dollars ($200.00) and Ten and No/100 Dollars ($10.00) for each property requiring an address·change will be deposited with the City Engineer for the administrative costs of processing the application; and ( f) reason(s) for the requested street name change. (3) Review of proposed name change. Following receipt of a completed application, the Plats Committee will review the application and forward a recommendation to the Planning and Zoning Commission. The Planning and Zoning Commission shall conduct a public hearing to receive public comment on the proposed change, which hearing shall be held not more than forty-five ( 45) days from the date of filing of the application. The City Engineer's office shall notify all abutting property owners, as ownership appears on the ad valorem tax rolls, of the time and date of such public hearing. Written notices of such public hearing shall be given not less than ten (10) days before the day set for such hearing. Prior to the hearing, the City Traffic Engineer shall compute the costs of changing street name signs and such costs shall be paid by the proponents. Following the public hearing, the Planning and Zoning Commission shall make a recommendation with regard to the proposed change to the City Council. If the Planning and Zoning Commission recommends denial of a street name change, the action of the Planning and Zoning Commission is final unless the applicant files a request for appeal to the City Council within ten (10) days of the hearing at which the action was taken. The request for appeal must be in writing and must be submitted to the Managing Director of Strategic Planning. The Managing Director of Strategic Planning shall schedule a City Council hearing on all applications for street name change in which the Commission recommends approval, and in all applications in which the Commission recommends denial if an appeal is requested in accordance with this Section. ( 4) Consideration by City Council. The City Council of the City of Lubbock shall consider the recommendation of the Planning and Zoning Commission and a public hearing shall be required. A notice of the time and place of such hearing shall be published once in a newspaper of general circulation in the City of Lubbock at least fifteen (15) days prior to the hearing. The favorable vote of seventy percent (70%) of all members of the City Council is required for approval if the Planning and Zoning Commission has recommended denial or if the owners of twenty percent (20%) of the property abutting the street oppose the name change. (5) Implementation of approved change. In the event that the City Council approves the change to the street name, the City Traffic Engineer shall install new street name signs, the City Engineer shall revise the official street name map, and the Building Official shall notify abutting property owners, Lubbock County, Lubbock Central Appraisal District and the U.S. Post Office of the effective date of the new name for the street. In the event that the City Council denies the name change, the Ten and Noll 00 Dollars ($10.00) per property application fee and the payment for the proposed change of street name signs shall be refunded to the proponents. ( 6) Correction of errors. Changing street names to correct errors or omission or to make necessary changes to bring street names into compliance with the current method of street naming is exempt from the provisions of this Section. -2- SECTION 2. THAT this Ordinance shall not apply to a pending request to change the name of A venue H from Municipal Drive to 24th Street to "Buddy Holly Avenue" with regard to the application of the fees contained herein to this requested name change; and SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance · shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the · descriptive caption as an alternative method provided by law. AND IT IS SO ORDERED.
