Second Reading July 25, 1996 Item #7 VOL 5241PAGE .42 ORDINANCE NO. _.._99.....,1 ..... 6 __ _ AN ORDINANCE ABANDONING AND CLOSING PORTIONS OF A PUBLIC ROAD LOCATED IN SECTION 17, BLOCK E-2, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF nns ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the public road portions hereinafter described in the body of this Ordinance are no longer needed for public road purposes and for public use; and WHEREAS, the City Council finds it would be in the public interest to close, vacate and abandon the same for public road purposes and for public use; NOW THEREFORE: ' BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the public road portions as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for public road purposes and for public use, such road portions being more particularly described as follows: A 20-foot-wide public roadway accepted by the Lubbock County Commissioners on May 12, 1924, being further described as follows: FIELD NOTES on a 0.30 acre tract out of Section 17, Block E-2, Lubbock County, Texas, further described by metes and bounds as follows: BEGINNING at a found 1/2" rod with cap marked RPLS #4460 at the Northeast comer of Tract K, King's Gate Addition, as recorded in Volume 5110, Page 266, Lubbock County Real Property Records, which by plat bears S. 89°58'50" K, 985.18 feet from the Northwest comer of Section 17, Block E-2; THENCE S. 00°01 '10" W., 20.00 feet to the Southeast comer of this tract; THENCE N. 89°58'50" W., 650.16 feet to a point for the Southwest comer of this tract; THENCE N. 00°03'30" E., with the East line of Quaker, 20.00 feet to a found rod with yellow cap, for the Northwest comer of this tract; THENCE S. 89°58'50" E., along the South line of an alley, 650.15 feet to the PLACE OF BEGINNING. . SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the ()fficial maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. ..r VOL 5241PACE .43 SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
