HomeMy WebLinkAboutOrdinance - 9915-1996 - Closing Portion Strormwater Storage And Drianage Easement. - 07/11/1996First Reading July 11, 1996 Item 119 fie And Return To Id Bucy R-O-W 23667 Second Reading July 25, 1996 Item #6 VOL 5241PACE .44 ORDINANCE NO. 9915 ----- AN ORDINANCE ABANDONING AND CLOSING A PORTION OF A STORMWATER STORAGE AND DRAINAGE EASEMENT LOCATED IN SECTION 15, BLOCK E-2, LUBBOCK, LUBBOCK COUNTY, TEXAS, A 6,550 SQUARE FOOT PORTION OF AN UNDERGROUND UTILITY EASEMENT LOCATED IN SECTION 15, BLOCK E-2, LUBBOCK, LUBBOCK COUNTY, TEXAS; AND A 1400 SQUARE FOOT PORTION OF AN UNDERGROUND UTILITY EASEMENT LOCATED IN SECTION 15, BLOCK E-2, LUBBOCK, LUBBOCK COUNTY, TEXAS; EACH OF WHICH IS MORE l'I PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE !1 CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ' ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that portions of the stormwater storage and drainage easement and underground utility easements as hereinafter described in the body of this Ordinance are no longer needed for easement purposes; and WHEREAS, the City Council finds it would be in the public interest to close, vacate and abandon the same for easement purposes; NOW THEREFORE: j BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: I SECTION 1. THAT the those portions of the easements as hereinafter described shall ! BE and the same are hereby closed, vacated and abandoned for easement purposes, and such ! , easement portions being more particularly described as follows: I I TRACT ONE METES AND BOUNDS DESCRIPTION on a 0.92 acre tract out of Section 15, Block E-2, Lubbock, Lubbock County, Texas, being a part of the tract dedicated as stormwater storage and drainage easement in Volume 1556, Page 647 of the Deed Records of Lubbock County, Texas and further described as follows: BEGINNING at a set 1/211 rod at the Northwest comer of the proposed plat limits of Lots 951-985, Lakeridge Country Club Estates, from whence the Northwest comer of Section 15, Block E-2 bears N. 00°01'30" E., a distance of2438.50 feet and N. 89°58'30" W., a distance of 155.00 feet; THENCE S. 89°58'30" E., a distance of261.17 feet to a set 1/211 rod; THENCE S. 78°55'15" E., a distance of 6.94 feet to a set 1/2" rod; THENCE S. 04 °07'36" E., a distance of 67 .98 feet to a set 1/2" rod; THENCE S. 12°45'5 l" E., a distance of 62.92 feet to a set 1/2" rod; VOL 5241,Acr ,45 THENCE S. 13°24'42" E., a distance of99.71 feet to a set 1/2" rod; THENCE S. 00°01 '30" W., a distance of 52.53 feet to a set 1/2" rod; THENCE S. 40°45' E., a distance of26.58 feet to a set 1/2" rod; THENCE S. TRACTTWO METES AND BOUNDS DESCRIPTION on a 6,550 square foot tract out of Section 15, Block E-2, Lubbock, Lubbock County, Texas, being a portion of the easement described in Volume 1971, Page 307 of the Deed Records of Lubbock County, Texas, and further described as follows: BEGINNING at the Northwest comer of the easement described in Volume 1. 1971, Page 307, which by easement calls bears S. 00°01'30" W., a distance of 2459.33 feet and S. 89°58'30" E., a distance of 55.00 feet from the Northeast comer of Section 15, Block E-2; THENCE S. 89°58'30" E., at 60.00 feet pass the proposed plat limits of Lots 951-985, Lakeridge Country Club Estates, in all 320.00 feet; THENCE S. 00°01'30" W., a distance of 15.00 feet; THENCE S. 88°46'04" E., at 10.50 feet pass the East plat limits line of the proposed plat of Lots 951-985, Lakeridge Country Club Estates, in all 30.59 feet to a point in the East line of a proposed 20 foot underground utility easement; I THENCE S. 04°07'36" E., a distance of 5.01 feet; -2- .. TRACT THREE METES AND BOUNDS DESCRIPTION on a 1400 square foot tract out of Section 15, Block E-2, Lubbock, Lubbock County, Texas, being the North 5.00 feet of a portion of the easement described in Volume 1699, Page 269 of the Deed Records of Lubbock County, Texas, and further described as follows: BEGINNING at the Northeast corner of the easement described in Volume 1699, Page 269, which by easement calls bears East, a distance of 463.37 feet and North a distance of 1982.42 feet from the Southwest corner of Section 15, Block E-2, a found iron rod at the Southeast corner of the proposed plat limits of Lots 951-985, Lakeridge Country Club Estates, bears S. 04° W., a distance of 20.12 feet; THENCE Westerly, a distance of 20.00 feet North of the North line of 92nd Street, around a curve to the right, having a central angle of 02°21 13911, a radius of 2063.46 feet, a chord of 85.02 on a bearing of S.88°50'46" W., to a point of tangency; THENCE N. 89°58'30" W., a distance of 20.00 feet North of the North line of 92nd Street, a distance of 72.14 feet; THENCE N. 87°52'30" W., a distance of 20.00 feet North of the North line of 92nd Street, a distance of 124.66 feet to a point in the East line of a proposed alley; THENCE S. 00°01 '3011 W., with said proposed alley line 5.00 feet to the Southwest comer of this tract; THENCE S. 87°52'30" E., a distance of 15.00 feet North of the North line of 92nd Street, a distance of 124.57 feet; THENCE S. 89°58'30" E., a distance of 15.00 feet North of the North line of 92nd Street, a distance of 72.24 feet; THENCE Easterly, a distance of 15.00 feet North of the North line of 92nd Street, around a curve to the left, having a central angle of 02°20'48", a radius of2068.46 feet, a chord of 84.72 on a bearing ofN. 88°51'1 l" E., to a point in the West line of an alley, for the Southeast comer of this tract; THENCE N. 04° E., a distance of 5.03 feet to the PLACE OF BEGINNING. -3- VoL 5241PACE 47 . SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and , directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
