ORDINANCE NO. 9913 -----
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE
OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES:
ZONE CASE NO. 2538-A; A ZONING CHANGE FROM R-1 TO R-1 SPECIFIC USE
ZONING FOR A GOLF DRIVING RANGE, TO C-4 SPECIFIC USE ZONING FOR A
MINIATURE GOLF COURSE, BATTING CAGE, PRO-SHOP AND ADMINISTRATIVE
OFFICES, AND TO C-4 ON A TRACT OUT OF SECTION 41, BLOCK AK, LUBBOCK,
TEXAS; SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PROVIDING A
SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION.
WHEREAS, ithe proposed changes in zoning as hereinafter made have been duly
presented to the Planning and Zoning Commission for its recommendation which was received
by the City Council • and, after due consideration, the City Council finds that due to changed
conditions, it would be expedient and in the interest of the public health, safety and general
welfare to make those proposed changes in zoning; and
WHEREAS, ~11 conditions precedent required by law for a valid amendment to the
, Zoning Ordinance and Map have been fully complied with, including giving notices in
I compliance with Section 29-29 of the Code of Ordinances, City of Lubbock, Texas, and the
\notices provided by the Texas Local Government Code §211.007 (Vernon, 1990), and notice was
i duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of I the public hearing before the City Council on the proposed amendment, and the public hearing
11according to said notice, was duly held in the City Council Chamber of the Municipal Building,
,Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said
!hearing, it was determined by the City Council that it would be in the public interest, due to
\changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner
:hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced
\prior to first reading hereof; NOW THEREFORE:

THAT Ordinance No. 7084 and the Official Zoning Map are amended as
i ! A change of zoning under the provisions of Section 29-24(c)(24) of the Code
of Ordinances of the City of Lubbock from R-1 to R-1 Specific Use zoning for
a golf driving range, to C-4 Specific Use zoning for a miniature golf course,
batting cage, pro-shop and administration offices, and to C-4 zoning on a tract
out of Section 41, Block AK, City of Lubbock, Lubbock County, Texas,
located South of J 9th Street and East of Inler A venue, subject to conditions
and being more particularly described as follows:
TRACT 1
METES AND BOUNDS DESCRIPTION of a tract of land located in the
Northwest Quarter of Section 41, Block AK, Lubbock, Lubbock County, Texas,
said tract containing approximately 20.31 acres, and being further described as
follows:
BEGINNING at a point for the Northwest comer of this tract, which bears
South, an approximate distance of 276.00 feet, and East an approximate distance
of 300.00 feet from the Northwest comer of said Section 41, Block AK,
Lubbock, Lubbock County, Texas;
THENCE East, an approximate distance of745.00 feet;
THENCE South, an approximate distance of 149.00 feet;
TIIENCE S. 45° E., an approximate distance of 150.00 feet;
THENCE East, an approximate distance of 110.00 feet;
THENCE South, an approximate distance of 565.00 feet;
THENCE Southwesterly around a curve to the left, said curve having a radius of
approximately 1227 .00 feet, and a chord distance of approximately I 090.00 feet;
THENCE North, along a line parallel to the East right-of-way line of Inler
Avenue (FM 179), an approximate distance of 1315.00 feet to the POINT OF
BEGINNING,
TRACT2
METES AND, BOUNDS DESCRIPTION of a tract of land located in the
Northwest Quarter of Section 41, Block AK, Lubbock, Lubbock County,
Texas, said tract containing approximately 2.99 acres, and being further
described as follows:
BEGINNING at a point in the South right-of-way line of 19th Street for the
Northwest comer of this tract, said point bearing East an approximate distance
of 428.00 feet and South an approximate distance of 65.00 feet from the
Northwest comer of said Section 41, Block AK, Lubbock, Lubbock County,
Texas;
THENCE East, along the South right-of-way line of 19th Street, an
approximate di~ce of 617 .00 feet;

METES AND BOUNDS DESCRIPTION of a tract of land located in the
Northwest Quarter of Section 41, Block AK, Lubbock, Lubbock County,
Texas, said tract containing approximately 4.06 acres, and further described as
follows:
BEGINNlNO at a point in the East right-of-way line of Inler A venue (FM 179)
for the Northwest comer of this tract, said point bearing South an approximate
distance of276.00 feet and East an approximate distance of 40.00 feet from the
Northwest corner of said Section 41, Block AK, Lubbock, Lubbock County,
Texas;
TIIENCE East, an approximate distance of 260.00 feet;
TIIENCE South, an approximate distance of 680.00 feet;
THENCE West, an approximate distance of 260.00 feet;
THENCE North, along the East right-of-way line of Inler A venue (FM 179), a
distance of 680.00 feet to the POINT OF BEGINNING.
1SUBJECT TO TIIE FOLLOWING CONDITIONS:

a. That the zoning of Tract 1 is changed from R-1 to R-1 Specific Use.
b. That the zoning of Tract 2 is changed from R-1 to C-4 Specific Use.
c. That the zoning of Tract 3 is changed from R-1 to C-4, subject to the
additional conditions ind. and e. below.
d. That on Tract 3, a site plan, including building elevations showing
materials, color, texture, a detailed landscape plan and an irrigation
plan, shall be submitted to the Planning and Zoning Commission for
approval prior to the issuance of a building permit.
e. That the C-4 zoning on Tract 3 shall prohibit the following uses:
I. Ambulance Service;

3. Bus Station;
4. Commercial private clubs and teenage clubs;
5. Dance hall;
6. Furniture store, used;
7. Game room, pool, billiard and/or domino parlor;
8. Nightclub, bar or lounge;
9. Portable building sales;
10. Rental stores, heavy equipment and trailers only;
l l. Road machinery sales and service;
12. Secondhand goods store or pawnshop;
13. · Secondhand or used car sales lot, not including wrecking and
repairing, but including minor tuning; and
14. Trailer and truck sales, rental or service.
SECTION.2. THAT the granting of this specific use zoning is hereby made subject to
\compliance to all provisions of Zoning Ordinance No. 7084, as amended, including particularly,
but not limited to, Section 29-24 of the Codified Zoning Ordinance, which provides that a
Building Permit shall be applied for and secured within thirty (30) months of the effective date of
the zone change or all undeveloped property shall automatically revert back to the previous
zoning classification, which in this case is the R-1 zone district; and if such reversion occurs, the
Director of Planning is directed to remove from the Zoning Map the legend indicating such
specific use. The Specific Use authorized by this Ordinance is permitted under provision of
Section 29-24(c)(24) of Codified Zoning Ordinance No. 7084 on the property described as a tract
out of Section 41, Block AK, City of Lubbock, Lubbock County, Texas.
, SECTION 3. THAT violation of any provisions of this Ordinance shall be deemed a
misdemeanor punishable by a fine not to exceed Two Thousand and No/100 Dollars ($2,000.00)
as provided in Section 29-31 of the Zoning Ordinance of the City of Lubbock.
SECTION 4. THAT should any paragraph, sentence, clause, phrase or word of this
Ordinance be declared ;unconstitutional or invalid for any reason, the remainder of this Ordinance
shall not be affected thereby.

SECTION 5; THAT the City Secretary is hereby authorized to cause publication of the
descriptive caption Qfthis Ordinance as an alternative method provided by law.
