ORDINANCE NO. 9907 ------
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE
OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES:
ZONE CASE NO. 2772; A ZONING CHANGE FROM R-1 TO A-2 ZONING ON A TRACT
OUT OF SECTION 16, BLOCK E-2, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS;
PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR
PUBLICATION.
WHEREAS, the proposed changes in z.oning as hereinafter made have been duly
i presented to the Planning and Zoning Commission for its recommendation which was received l by the City Council and, after due consideration, the City Council found that due to changed
1 conditions, it would be expedient and in the interest of the public health, safety and general
\ welfare to make those proposed changes in zoning; and
' WHEREAS, all conditions precedent required by law for a valid amendment to the
!Zoning Ordinance and Map have been fully complied with, including giving notices in
icompliance with Section 29-29 of the Code of Ordinances, City of Lubbock, Texas, and the
!notices provided by the Texas Local Government Code §211.007 (Vernon, 1990), and notice was
!duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of
!the public hearing before the City Council on such proposed amendment, and the public hearing
:according to said notice, was held in the City Council Chamber of the Municipal Building,
\Lubbock, Texas, at which time persons appeared in support of the proposal; and after said
hearing, it was by the City Council determined that it would be in the public interest, due to
:changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner
hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced
prior to first reading hereof; NOW THEREFORE:

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
ZONE CASE NO. 2772
SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map are amended as
follows:
A change of zoning under the provisions of Section 29-29 of the Code of .
Ordinances of the City of Lubbock from R-1 to A-2 z.oning district, limited to a
personal care facility, on a tract out of Section 16, Block E-2, City of Lubbock,
Lubbock County, Texas, located South of 98th Street and West of Vicksburg
A venue, subject to conditions and being more particularly described as follows:
METES AND BOUNDS DESCRIPTION of a 6.853 acre tract located in Section
16, Block E-2, Lubbock, Lubbock County, Texas, being further described as
follows:
BEGINNING at a 5/811 iron rod with cap found in the South right-of-way line of
98th Street at the Northwest corner of this tract which bears S. 89°59'17" E., a
distance of 889.90 feet and S. 00°01 '37" E., a distance of 55.00 feet from the
Northwest corner of Section 16, Block E-2, Lubbock, Lubbock County, Texas;
THENCE S. 89°59'17" E., along the South right-of-way line of 98th Street, a
distance of 483.18 feet to a 1/2" iron rod with cap found at a corner of this tract;
THENCE S. 45°02'18" E., a distance of 14.15 feet to a 1/211 iron rod with cap
found at a corner of this tract;
THENCE S. 00°05'19" E., at 175.00 feet pass a set 1/2" iron rod with cap,
continuing for a total distance of 595.00 feet to a 1/2" iron rod with cap found at
the Southeast corner of this tract;
THENCE N. 89°59'17" W., a distance of 493.83 feet to a 5/8" iron rod with cap
found at the Southwest corner of this tract;
THENCE N. 00°01 '37" W., at 420.00 feet pass a set 1/211 iron rod with cap,
continuing for a total distance of605.00 feet to the POINT OF BEGINNING.
SUBJECT TO THE FOLLOWING CONDITIONS:
a. That all development on the tract shall be limited to a personal
care/retirement facility.
b. That adequate parking spaces shall be provided. Should a shortage be
verified by the Planning Department, the owner shall be notified by
certified mail to add a sufficient number of spaces.
c. That it be tied to site plan 2772 for the setback on the South and East and
for the screening fences, as presented to the Planning and Zoning
Commission and signed by the Chairman on May 2, 1996.
SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a
misdemeanor punishable by a fine not to exceed Two Thousand and No/100 Dollars ($2,000.00) as provided in Section 29-31 of the Zoning Ordinance of the City of Lubbock.
SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this
Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance
shall not be affected thereby.

SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the ·
descriptive caption of this Ordinance as an alternative method provided by law.
