First Reading May 23, 1996 Item #29 Second Reading June 24, 1996 Item fl26 ORDINANCE NO ...... 9-"'-'90"""'4....__ __ AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 2771; A ZONING CHANGE FROM A-1 TO C-2 AND R-1 ZONING ON TWO TRACTS OUT OF SECTION 27, BLOCK E-2, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PROVIDING A SA VINOS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly · presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council found that due to changed conditions, it would be expedient and in the interest of the public health, safety an9 general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, including giving notices in compliance with Section 29-29 of the Code of Ordinances, City of Lubbock, Texas, and the notices provided by the Texas Local Government Code §211.007 (Vernon, 1990), and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice, was held in the City Council Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in support of the proposal; and after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 2771 SECTION I. THAT Ordinance No. 7084 and the Official Zoning Map are amended as follows: A change of zoning under the provisions of Section 29-29 of the Code of Ordinances of the City of Lubbock from A-1 to C-2 and R-1 zoning district on two tracts out of Section 27, Block E-2, City of Lubbock, Lubbock County, Texas, located North of 68th Street and West of Albany, South of 68th Street and East of Albany, subject to conditions and being more particularly described as follows: TRACT! METES AND BOUNDS DESCRIPTION of a portion of that tract of land conveyed to Lubbock Land Co. Three Ltd. in Volume 4281, Page 248 of the Real Property Records of Lubbock County, Texas, located in Section 27, Block E-2, Lubbock, Lubbock County, Texas, and being further described as follows: II I I'. i BEGINNING at a 1/2" iron rod with cap set in the East line of1that tract conveyed to Lubbock Land Co. Three Ltd. in Volume 4281, Page 248 of the Real Property Records of Lubbock County, Texas, which bears N. 89°57'50" W., a distance of 1321.38 feet and S. 00°02'20" E., a distance of 115.29 feet from the Northeast comer of Section 27, Block E-2, Lubbock, Lubbock County, Texas; THENCE S. 00°0212011 E., along the East line of said Lubbock Land Co. Tract, a distance of210.56 feet to a set 1/211 iron rod with cap; THENCE Northwesterly around a curve to the left, said curve having a radius of 541.30 feet, a central angle of 14°22'12", tangent lengths of 68.24 feet, and a chord distance of 135.40 feet to a 1/2" iron rod with cap set for a point of reverse curvature; THENCE Northeasterly around a curve to the right, said curve having a radius of 15.00 feet, a central angle of 85°21'37", tangent lengths of 13.83 feet, and a chord distance of20.34 feet to a 1/2" iron rod with cap set for a point of tangency; THENCE N. 48°43114" E., a distance of 22.74 feet to a 1/2" iron rod with cap set for a point of curvature; THENCE Northeasterly around a curve to the left, said curve having a radius of 230.00 feet, a central angle of 18°3610911, tangent lengths of 37.67 feet, and a chord distance of 74.35 feet to the POINT OF BEGINNING. TRACT2 METES AND BOUNDS DESCRIPTION of a portion of that tract of land conveyed to The Texas Project in Volume 1635, Page 497 of the Deed Records of Lubbock County, Texas, located in Section 27, Block E-2, Lubbock, Lubbock County, Texas, and being further described as follows: BEGINNING at a 1/2" iron rod with cap set in the West line of that tract conveyed to The Texas Project in Volume 1635, Page 497 of the Deed Records of Lubbock County, Texas, which bears N. 89°57'50" W., a distance of 1321.38 feet and S. 00°02'20" E., a distance of 666.01 feet from the Northeast comer of Section 27, Block E-2, Lubbock, Lubbock County, Texas; THENCE S. 08°03'09" E., a distance of 15.29 feet to a 1/2" iron rod with cap set for a point of curvature; THENCE Southeasterly around a curve to the left, said curve having a radius of 541.30 feet, a central angle of 25°51 '52", tangent lengths of 124.29 feet, and a chord distance of 242.28 feet to a 1/211 iron rod with cap set for a point of reverse curvature; THENCE Southwesterly around a curve to the right, said curve having a radius of 15.00 feet, a central angle of 83°05'52", tangent lengths of 13.29 feet, and a chord distance of 19.90 feet to a 1/2" iron rod with cap set for a point of reverse curvature; ZONE CASE NO. 2771 --PAGE2-· 11 I' .I THENCE Southwesterly around a curve to the left, said curve having a radius of 334.70 feet, a central angle of 24°46'33", tangent lengths of 73.51 feet, and a chord distance of 143.61 feet to a 1/2" iron rod with cap set for the Northwest comer of that tract conveyed to William T. Stadley and Delmar W. Stone in Volume 3281, Page 63 of the Real Property Records of Lubbock County, Texas, same being in the West line of said Texas Project Tract; THENCE N. 00°02'20" W., along the West line of said Texas Project Tract, a distance of 376.07 feet to the POINT OF BEGINNING. SUBJECT TO THE FOLLOWING CONDITIONS: a. That the zoning on Tract l is changed from A-1 to C-2. b. That the zoning on Tract 2 is changed from A-1 to R-1. SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed Two Thousand and Noll 00 Dollars ($2,000.00) as provided in Section 29-31 of the Zoning Ordinance of the City of Lubbock. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
