WIT-: A 40 MPH SPEED ZONE ON THE EAST SIDE OF NORTH QUIRT AVENUE BEGINNING AT THE INTERSECTION OF PAR-KWAY DRIVE AND EXTENDING NORTH TO LOOP 289; A 40 MPH SPEED ZONE ON TH WEST SIDE OF NORTH QUIRT AVENUE BEGINNING AT LOOP 289 AND EX ... TENDING SOUTH TO EAST 2ND STREET; A 35 MPH S_PEED ZONE ON THE WE SIDE OF NORTH QUffi.T AVENUE BEGINNING AT EAST 2ND STREET AND EX• TENDING SOUTH TO PARKWAY DRIVE; A 40 MPH SPEED ZONE ON THE EAST SIDE OF NORTH ASH AVENUE BEGINNING AT MUNICIPAL DRIVE AND EX.., TENDING NORTH TO LOOP 289; A 35 MPH SPEED ZONE ON BOTH SIDES OF NORTH ASH AVENUE BEGINNING AT LOOP 289 AND EXTENDING NORTH TO EAST URSULINE STREET; A 40 .MPH SPEED ZONE ON BOTH SIDES OF NORTH ASH AVENUE BEGINNING AT EAST URSULINE STREET AND EX.TENDING NORTH TO THE AMARILLO HIGHWAY (NORTH U.S.' 87); A 40 MPH SPEED ZONE ON THE WEST SIDE OF NORTH ASH AVENUE BEGINNING AT LOOP 289 AND EXTENDING TO ERSKINE STREET; AND A 35 MPH SPEED ZONE ON THE WEST SIDE OF NORTH ASH A VENUE BEGINNING AT ERSKINE STREET AND EXTENDING SOUTH TO MUNICIPAL DRIVE; AUTHORIZING THE PLACING OF SPEED LThUT SIGNS; PRESCRIBING A PENALTY; PROVIDING FOR. PUBLICA"' TION; R.E PEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING THAT STREETS OR. HIGHWAYS NOT SPECIFICALLY SET FORTH HEREIN SHALL NOT BE AFFECTED BY THE PROVISIONS HEREOF AND THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL OTHER PRIMA FACIE SPEED LIMIT ORDINANCES EXCEPT THOSE WITH WHICH IT SPECIFICALLY CON~ FLICTS; PROVIDING A SAVINGS CLAUSE; DECLARING AN EMERGENCY; AND PROVIDING FOR. THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the governing body of the City of Lubbock, as authorized by Article 6701d, Section 169 {b) Vernon1s Texas Civil Statutes, finds fuat certain prima facie speed limits on certain highways are diffeit'ent from what is reason ... able or safe and should be altered and the immediate preservation of public health and safety requires immediate alteration of said prima facie speed limits as hereafter set forth~ which creates an emergency, NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. The prima facie speed limit established by Article 6701d, Section 166a(l) Vernont-s Texas Civil Statutes is altered and changed for all vehicl s to forty ( 40) miles per hour on the following designated highway or street in the corporate limits of the City of Lubbock, Lubbock Cowrty, Texas .. to.,wit: On the east side of North Quirt Avenue beginning at the inter ... section of Parkway DriV.e and extending north to Loop 289. SECTION 2. The prima facie speed limit established by Article 670ld, Section 166a(l) Vernonts Texas Civil Statutes is altered and changed for all vehicles to forty {40) miles per hour on the following designated highway or street in the corporate limits of the City of Lubbock, Lubbock County, Texas, to.,.wit: On the west side of North Quirt Avenue beginning at Loop 289 and extending south to East 2nd Street. SECTION 3. The prima facie speed limit established by Article 670 ld, Section 166a(l) Vernonts Texas Civil Statutes is alte~ed and changed for all vehicles to thirty ... five (35) miles per hour on the following designated highway or street in the corporate limits of the City of Lubbock, Lubbock County, Texas, to•wit: On the west side of North Quirt Avenue beginning at East 2nd Street and extending south to Parkway Drive. SECTION 4. The prima facie speed limit established by Article 670ld., Section 166a(l) Vernonts Texas Civil Statutes is altered and changed for all vehicles to forty (40) miles per hour on the following designated highway or street in the corporate limits of the City of Lubbock, Lubbock County, Texas., to ... wit: On the east side of North Ash Avenue beginning at Municipal Drive and extending north to Loop 289. SECTION 5. The prima facie speed limit established by Article 670 ld,, Section 166a.{l) Vernon1s Texas Civil Statutes is altered and changed for all vehicles to thirty.,five (35) miles per hour on the following designated highw~y or street in the corporate limits of the City of Lubbock, Lubbock CoWlty, Texas, tO""Wit: On both sides of North Ash Avenue beginning at Loop 289 and extending north to East Ursuline Street. SECTION 6. The prima facie speed limit established by Article 670ld., Section 166e(l) Vernon!s Texas Civil Statutes is altered and changed for all vehicles to forty (40) miles per hour on the following designated highway or street in the corporate limits of the City of Lubbock, Lubbock County, Texas, to.,wit: On both sides of North Ash Avenue beginb.ing at East Ursuline Street and extending north to the Amarillo Highway (North u~s~· 87). SECTION 7. The prima facie speed limit established by Article 6701d, Section 166a(l) Vernonts Texas Civil Statutes is altered and changed for all vehicles to forty (40) miles per h.our on the following designated highway or street in the corporate limits of the City of Lubbock, Lubbock County, Texas, to~ it: On the west side of North Ash Avenue beginning at Loop 289 and extending south to Erskine Street. SECTION 8. The prima facie speed limit established by Article 670ld, Section 166a(l) Vernon1s Texas Civil Statutes is altered and changed for all vehicles to thirty"five (35) miles per hour on the following designated highwf.y or street in the corporate limits of the City of Lubbock, Lubbock County, Texas, tOt!'Wit: On the west side of North Ash Avenue beginning at Erskine Street and extending south to MunicipaL Drive. SECTION 9. The City Manager is authorized and directed to cause the placing of signs so as to clearly define the limits of the prima facie areas set out in this Ordinance. SECTION 10. Any person, firm or corporation violating the prim facie speed limit established by this Ordinance shall upon conviction be fined any sum not to exceed TWO HUNDRED ($200. 00) DOLLARS. SECTION 11. The City Secretary is authorized and directed to cause the publication of the descriptive caption of this Ordinance together with the penalty provision as an alternative method of publication as provided by law. SECTION 12. That all ordinances or parts of ordinances conflicting with any of the provisions hereof are hereby repealed insofar as such conflict exists. SECTION 13. That all highways <r streets not specifically set forth in the preceding sections hereof shall not be affected by the provisions hereof~ and this Ordinance shall be cumulative of all other prima facie speed limit ordinances except those with which it specifically conflicts. SECTION 14. Should any section~ paragraph., sentence, clause., phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 15. The fact that public necessity and convenience requires that this Ordinance be passed as an emergency measure for reasons set forth in the preamble hereof, the rule requiring that no ordinance shall be finally passed on the day of its introduction be suspended, and this Ordinance is declared to be an emergency measure to take effect from and after its passage. -AND IT IS SO ORDERED~- Passed by the City Council this 22nd day of __ --.;.1;;.;u..,.t.y ______ , 1965.
