HomeMy WebLinkAboutOrdinance - 4745-1965 - Amending Section 18-2.1 Of The City Traffic Code. - 07/22/1965(;jl \___J l' PL,J: GAS:bw ORDINANCE NO~· 4745 AN ORDINANCE AMENDING SECTION 18-2.1 OF THE CITY TRAFFIC CODE TO DEFINE AREAS WITHIN WHICH VARYING LOADING ZONE RATES APPLY; PROVIDING A SAVINGS CLAUSE; DECLARING AN EMERGENCY; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS~ Section 18-2. 1 of the Code of Ordinances., City of Lubbock, Texas., provides for loading zones with rates depending on whether the zone is in a parking meter area; and, WHEREAS# there are no longer any parking meters within such area, the governing body of the City of Lubbock finds that an amendment is necessary to provide clarity and the pressing need for such amendment creates an emergency, NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section !.8f'2;-1 of the Code of Ordinances, City of Lubbock, Texas is hereby amended to read as follows: "Sec. 18-..2.1 Loading Zones ...... Charges for use; duties of city manager. 11The city manager shall, upon the advice and recommendation of the director of planning and traffic., determine the location of loading zones in the city, and shall place and maintain adequate signs indicating the same, which shall be operative from seven a.m. to six p.m. unless otherwise specially authorized or per ... mitted. "For the purpose of regulating and supervising loading zones and to provide a fund to cover all cost involved for installing adequate signs and the painting and periodical repainting of curbs and streets designating and identifying loading zones, there is hereby imposed an annual charge far all freight, passenger., and taxicab curb.,.loading zones except bus curb loading zones, as follows: (1) The sum of two dollars per lineal foot for loading zones within an area described as follows: An area consisting of the following blocks and portions thereof of the Original City of Lubbock: The east 1 I 2 of the south side and the south 1 I 3 of the east side of block 55; the south 1/2 of the west side and all of the south and east sides of block 71; the west and south sides of block 72; the south and east sides of block 86; all of blocks 87 and 88; the west side of block 89; the south 112 of the west side of block 100; the south sides of blocks 100 and 101; the east side of block 10 1; all of blocks 10 2, 10 3, 10 4, 10 5; the west and south sides of block 106; the north and east sides of block·115; all of blocks 116, 117, 118, 119, the courthouse block; the west and south sides of block 120; all of blocks 130, 131, 132, 133, 134, 135; the west and north sides of block 136; the north side of block 137; the east side of block 145; the north, west, and east sides of block 146; all of blocks 147, 148, 149 and 150; the west side of block 151; the north and east sides of block 163; all of blocks 164 and 165; the north side of block 181. . (2) The sum of one dollar per lineal foot for loading zones not within the preceding described area. "Such charges shall be agains~. and be paid by, the applicant for such loading zone as hereinafter provided. "Charges for such applicable loading zones shall be payable annually in advance for the calendar year on or before the first day of January of each such year, and charges for all loading zones designated subsequent to the last day of any quarter of a calendar year shall be prorated for the remainder of such year on a quarterly basis, provided, however, the minimum charge for any portion remaining in a calendar year shall be for at least one full quarter. All money due and payable here ... under shall be deposited with the city auditor. 11 SECTION 2. Should any section, paragraph, sentence, clause, phrase, or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 3. The fact that public necessity and convenience requires that this Ordinance be passed as an emergency measure for reasons set forth in the preamble hereof, the rule requiring that no ordinance shall be finally passed on the day of its introduction be suspended, and this ordinance is declared to be an emergency measure to take effect from and after its passage.
