HomeMy WebLinkAboutOrdinance - 9893-1996 - Zone Case 1996-G Change A-1 To R-1 And R-1 Specific Garden Homes - 04/18/1996First Reading April 18, 1996 Item #19 Second Reading May 9, 1996 Item #26 ORDINANCE NO. ___...9 ..... 89.....,3 __ _ AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 1996-G; A ZONING CHANGE FROM A-1 TO R-1 AND R-1 SPECIFIC USE ZONING FOR GARDEN HOMES ON TWO TRACTS OUT OF SECTION 27, BLOCK E-2, AND ON LOTS 15-26, 35-46, AND 55-60, REMINGTON PARK ADDITION, LUBBOCK, TEXAS; PROVIDING A PENALTY; PROVIDING A SA VINOS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council finds that due to changed conditions, it would be expedient and in the interest of the public health, safety and general welfare to make those proposed changes in zoning; and WHEREAS, the 1986 Comprehensive Land Use Plan is a guide to help the Lubbock Planning and Zoning Commission and City Council determine the physical development of the community; however, planning is a continuous process and change is inevitable; and WHEREAS, the Lubbock Planning and Zoning Commission and City Council recognize that the zone change on is a minor deviation from the 1986 Comprehensive Land Use Plan and attempt to protect public and private commitments that have been previously based on the Plan; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, including giving notices in compliance with Section 29-29 of the Code of Ordinances, City of Lubbock, Texas, and the notices provided by the Texas Local Government Code §211.007 (Vernon, 1990), and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on the proposed amendment, and the public hearing according to said notice, was duly held in the City Council Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was determined by the City Council that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 1996-G SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map are amended as • follows: 'I A change of zoning under the provisions of Section 29-24(c)(2) of the Code of Ordinances of the City of Lubbock from A-1 to R-1 and R-1 Specific Use for garden homes on two tracts out of Section 27, Block E-2 and on Lots 15-26, 35-46, and 55-60, Remington Park Addition, City of Lubbock, Lubbock County, Texas, located South of 66th Street between Brentwood and Bangor, South of 66th Street and East of Bangor, and 68th Street to 69th Street between Bangor and Albany, and being further described as follows: TRACT I METES AND BOUNDS DESCRIPTION of a 12.40 acre tract located in Section 27, Block E-2, Lubbock County, Texas, being further described as follows: BEGINNING at a point for the Southernmost corner of this tract which bears N. 89°54' W., a distance of 1320.67 feet, and S. 00°01'30" W., a distance of 1040.52 feet from the Northeast corner of Section 27, Block E-2; THENCE N. 32°0812911 W., a distance of 10.67 feet to a point for a corner of this tract; THENCE N. 89°54' W., a distance of 815.16 feet to a point for the Southwest corner of this tract; THENCE N. 00°06' E., a distance of 659.00 feet to a point for the Northwest corner of this tract; THENCE S. 44°54' E., a distance of 14.14 feet to a point for a corner of this tract; THENCE S. 89°54' E., a distance of 751.92 feet to a point for a corner of this tract; THENCE N. 35°43'03" E., a distance of 11.65 feet to a point for the Northeast comer of this tract; THENCE Southeasterly around a curve to the right, said curve having a radius of 477.30 feet, a central angle of 11 °16'36", tangent lengths of 47.12 feet, and a chord distance of 93. 79 feet to a point of tangency; THENCE S. 07°59'19" E., a distance of219.18 feet to a point of curvature; THENCE Southeasterly around a curve to the left, said curve having a radius of 541.30 feet, a central angle of 25°51 '52", tangent lengths of 124.29 feet, and a chord distance of 242.28 feet to a point of reverse curvature; THENCE Southwesterly around a curve to the right, said curve having a radius of 15.00 feet, a central angle of 83°05'5211, tangent lengths of 13.29 feet, and a chord distance of 19 .90 feet to a point of reverse curvature; THENCE Southwesterly around a curve to the left, said curve having a radius of 334.70 feet, a central angle of 24°29', tangent lengths of 72.62 feet, and a chord distance of 141.94 feet to the POINT OF BEGINNING. ZONECASENO. 1996-G -PAGE 2-· TRACT2 METES AND BOUNDS DESCRIPTION of a 0.95 acre tract located in Section 27, Block E-2, Lubbock County, Texas, being further described as follows: BEGINNING at a point for the Northernmost Northwest comer of this tract which bears S. 89°54' E., a distance of 3163.04 feet, and S. 00°06' W., a distance of 32.00 feet from the Northwest comer of Section 27, Block E-2; THENCE Southeasterly around a curve to the right, said curve having a radius of 455.72 feet, a central angle of 11 °28'54", tangent lengths of 45.81 feet, and a chord distance of 91.17 feet to a point for the Northernmost Northeast comer of this tract; THENCE S. 38°57'24" E., a distance of 15.53 feet to a point for the Easternmost Northeast comer of this tract; THENCE S. 00°06' W., a distance of 319.32 feet to a point for the Easternmost Southeast comer of this tract; THENCE S. 45°06' W., a distance of 14.14 feet to a point for the Southernmost Southeast comer of this tract; THENCE N. 89°54' W., a distance of 100.00 feet to a point for the Southernmost Southwest comer of this tract; THENCE N. 44°54' W., a distance of 14.14 feet to a point for the Westernmost Southwest comer of this tract; THENCE N. 00°06' E., a distance of321.00 feet to a point of curvature; THENCE Northeasterly around a curve to the right, said curve having a radius of 15.00 feet, a central angle of 90°, tangent lengths of 15.00 feet, and a chord distance of21.21 feet to the POINT OF BEGINNING. SECTION 2. THAT the granting of this specific use zoning is hereby made subject to compliance to all provisions of Zoning Ordinance No. 7084, as amended, including particularly, but not limited to, Section 29-24 of the Codified Zoning Ordinance, which provides that a Building Permit shall be applied for and secured within thirty (30) months of the effective date of the zone change or all undeveloped property shall automatically revert back to the previous zoning classification, which in this case is the A-1 zone district; and if such reversion occurs, the Director of Planning is directed to remove from the Zoning Map the legend indicating such specific use. The Specific Use authorized by this Ordinance is permitted under provision of Section 29-24(c)(2) of Codified Zoning Ordinance No. 7084 on the property described as on two tracts out of Section 27, Block E-2 and Lots 15-26, 35-46, and 55-60, Remington Park Addition, City of Lubbock, Lubbock County, Texas. SECTION 3. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fme not to exceed Two Thousand and No/100 Dollars ($2,000.00) as provided in Section 29-31 of the Zoning Ordinance of the City of Lubbock. I SECTION 4. THAT should any paragraph, sentence, clause, phrase or word of this 1 Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance I shall not be affected thereby.
