ORDINANCE NO. ----"98..._.8...,4 ____ _ AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND TilE OFFICIAL MAP OF TilE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 2769; A ZONING CHANGE FROM R-1 TO C-4 ZONING ON A TRACT OUT OF SECTION 5, BLOCK D-6, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council found that due to changed conditions, it would be expedient and in the interest of the public health, safety and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, including· giving notices in compliance with Section 29-29 of the Code of Ordinances, City of Lubbock, Texas, and the notices provided by the Texas Local Government Code §211.007 (Vernon, 1990), and notice was duly published in the Lubbock Avalanche-Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice, was held in the City Council Chamber of the Municipal Building, . Lubbock, Texas, at which time persons appeared in support of the proposal; and after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF TilE CITY OF LUBBOCK: ZONE CASE NO. 2769 SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map are amended as follows: A change of zoning under the provisions of Section 29~29 of the Code of Ordinances of the City of Lubbock from R-1 to C-4 zoning district on a tract out of Section 5, Block D-6, City of Lubbock, Lubbock County, Texas, located South of 19th Street and West of Quitsna Avenue, subject to conditons and being further described as follows: METES AND BOUNDS DESCRIPTION on a tract of land out of the Northeast part of a 49.9 acre tract out of Section 5, Block D-6, Lubbock, Lubbock County, Texas, and more particularly described as follows: BEGINNING at a 3/4" pipe set 250.00 feet West and 50.00 feet South of the Northeast comer of Section 5, Block D-6, for the Northeast comer of this survey. Said pipe being set in the West R.O.W. line of Santa Fe Spur Tract and the South R.O.W. line of Highway (24) now No. 290; THENCE West, a distance of 250.00 feet along the South R.O.W. line of Highway 290 to a set 3/411 pipe for the Northwest comer of this survey; THENCE South, a distance of 355.50 feet parallel to the East line of Section 5, Block D-6, to a set 3/4" pipe in field for the Southwest comer of this survey; THENCE East, a distance of 229.20 feet parallel to the North line of this survey set 3/4" pipe in the West R.O. W. line of Santa Fe RR Spur Tract for the Southeast comer of this survey; THENCE Northeast, a distance of 197.20 feet following a curve to the left, with radius of 892.30 feet with the West R.O.W. line of said Railroad to a point, end of curve; THENCE North, a distance of 160.00 feet along the West R.O.W. line of said Santa Fe RR Spur Tract to the PLACE OF BEGINNING. SUBJECT TO THE FOLLOWING CONDITIONS: a. That the C-4 zoning shall prohibit the following C-4 uses: 1. Automobile Body Shops; 2. Billboards; 3. Commercial Private Clubs and Teenage Clubs; 4. Dancehall; 5, Feed Store; 6. Used Furniture Store; 7. Gameroom (except as an incidental use in a restaurant), pool, Billiard and/or Domino Parlor; 8. Motorcycle Shop; 9. Public Kennel; 10. Second-hand Goods Store or Pawn Shop; 11. Used Car Lot; and 12. Nightclubs. ZONE CASE NO. 2769 --PAGE 2- SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed Two Thousand and No/100 Dollars ($2,000.00) as provided in Section 29-31 of the Zoning Ordinance of the City of Lubbock. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
