AN ORDINANCE AMENDING ZONING ORDINANCE NO. 169 5 AND THE OFF! IA
MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGE:
ZONE CASE No~· 1129-A: CHANGE A TRACT OF LAND OUT OF THE NE 1/4,
SEC'illON 44~ BLOCK A~ LUBBOCK COUNTY~ TEXAS~ FROM AN "R-1" TO AN
''R-3" ZONING DISTRICT;" SUBJECT TO CONDITIONS:
WHEREAS .. the proposed change in zoning districts as hereinafter made has
been duly presented to the Zoning and Planning Commission for its recommendatio ~
which was received by the City Council and after due consideration~ the City Counc
finds that making the proposed change as hereinafter set out will be in the public
interest; and,
WHEREAS~ all conditions precedent required by law for a valid amendment
to the Zoning Ordinance and Map have been fully complied with, as well as giving
notices in compliance with Section 20 of Ordinance No. 1695 as well as notices pro
vided by Article 1011f~ Vernonts Annotated Civil Statutes, amended in 1961, and
notice was duly published in the Lubbock Morning Avalanche Journal more than
fifteen (15) days prior to the date of the public hea.ring before the City Council on
such proposed amendment, and the public hearing according to said notice was dul
held in the City Council Room on the second floor of the City Hall, Lubbock, Texas
at which time persons appeared in support of the proposal; and, after said hearing,
it was by the City Council determined that it would be in the public interest, due to
changed conditions, that the Zoning Ordinance and the Zoning Map be amended in
the manner hereinafter set forth in the body of this Ordinance and this Ordinance
having been introduced in final written form prior to first reading hereof; NOW,.
THEREFORE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and
the same are hereby amended as follows, to-wit:
ZONE CASE NO. 1129-A
Change a tract of land out of the NE 1 I 4, Section 44, Block AK, Lubbock
County~ Texas, from an "R-1" to an 11R-3" Zoning District. Property is fur
described by metes and bounds to wit:
BEGINNING at a point in the East line of Section 44, Block AK, 1694 feet
South of the NE Corner of said Section 44, for the NE and beginning corner
of this tract; from which a 3/ 4" galvanized iron pipe bears West 20 feet;
THENCE West 990 feet parallel with the North line of Section 44~ to a 211 x 2'
pine stake with tack set for the NW Corner of this tract;
THENCE South 242 feet parallel with the East line of Section 44 to a 211 x 211
pine stake with tack set for SW Corner of this tract;
THENCE East parallel with North line of tract at 970 feet past 2" x 2" pine
stake with tack~ 990 feet in all to a point in East line of Section 44, the SE
Corner of this tract;
THENCE North with the East line of Section 44 and along center of a public
road 242 feet to the PLACE OF BEGINNING. CONTAINING 5. 5 acres of land
SUBJECT TO THE FOLLOWING CONDITIONS:
1. That development of the property be limited to apartments only with
maximum of two stories.
2. That a minimum of 1500 square feet of lot area be provided for each
apartment unit. ·
3. That 1 1/2 paved off-street parking areas be provided for each apartme
unit.
SECTION 2. THAT from and after passage and effective date of this Or-
dinance, said lots, tracts and parcels of land described in Section 1 hereof shall
be changed to the zoning district indicated and the Official Map is amended in
accordance herewith.
AND IT IS SO ORDERED
