First Reading February 8, 1996 Item H28 Fila And Return To Ed Bucy R-O-W 8605 Second i!·a~JJ6rm182 February 22, 1996 Item #7 ORDINANCE NO. 9880 PROJECT NO. 2035-94 AN ORDINANCE CORRECTING A MIST AKE IN THE CALCULATION OF A PAVING ASSESSMENT LEVIED FOR PART OF THE COST OF IMPROVING FRANKFORD;\ VENUE, AND AUTHORIZING THE ISSUANCE OF A NEW CERTIFICATE OF ASSESSMENT. , WHEREAS, on April 13, 1995, the City Council of the City of Lubbock, Texas, passed j Ordinance No. 9730 which, among other things, levied assessments for part of the cost of improving portions of designated streets, avenues and alleys in the City, and provided for the issuance of assignable certificates in evidence thereof; and WHEREAS, the parcels of property which were assessed for the cost of improving portions of designated streets, avenues and alleys were described in an Exhibit attached to Ordinance No. 9730; and WHEREAS, the sums assessed against such parcels of property and against the real and true owners thereof, together with interest thereon and attorney's fees and costs of collection, if incurred, were therein declared to be and made a lien upon the parcels of property assessed; and l J WHEREAS, after passage by the Council, Ordinance No. 9730 was filed in Vol. 4851, 1 Pages 145-177 of the Real Property Records of Lubbock County, Texas; and II I' l I I I WHEREAS, during the assessment process, the zoning classification for one of the parcels of property subject to the assessment was changed from A-2 to R-1, but such change was not reflected in Ordinance No. 9730; and WHEREAS, as a result of this omission, there was a mistake in the calculation of the assessment for the parcel of property whose zoning classification was changed, and the property was inadvertently assessed at a higher rate than similarly-zoned property; and WHEREAS, the City Council has determined that it would be inequitable to not correct this mistake; NOW THEREFORE: I BE IT ORDAINED BY THE CITY COUNCIL OF TIIE CITY OF LUBBOCK: 11 SECTION 1. THAT the zoning classification, rate of assessment and total assessment for I' Parcel #3 of Unit 2035-94 in Ordinance No. 9730 shall hereby be modified and changed as I follows: l1 (a) !I I The zoning classification expressed in the Ordinance for such property shall be changed from A-2 to R-1. VOL 51.16PAGE183 (b) The rate of assessment for paving shall be changed from $55.64 per front foot of property to $12.86 per front foot of property. The rate of assessment for curb and gutter shall remain at $6. 78 per front foot of property. ( c) The total assessment against such property, and the true and correct owners thereof, shall be changed from $35,669.13 to $8,244.16 for paving and remain at $4,346.45 for curb and gutter. SECTION 2. IBA Ta new assignable certificate shall be issued by the City of Lubbock in lieu of the certificate that was previously issued for Parcel #3 of Unit 2035-94 and such substituted certificate shall be executed by the Mayor in the name of the City, attested by the City Secretary with the corporate seal, and shall indicate the amount of the assessment as herein modified. Such previously issued certificate is hereby rescinded. SECTION 3. THAT Ordinance No. 9730 shall in all other respects remain unchanged and all portions of such Ordinance other than those herein expressly modified are hereby ratified and confirmed.
