ORDINANCE NOo ~692 ,. /3-~~ ~ , AN ORDINANCE AUTHORIZING THE ALTERING AND CHANGING OF THE PRIMA FACIE
SPEED LIMIT FROM 30 MILES PER HOUR TO 40 MILES PER HOUR ON THAT PORTION OF
THE STREETS DESCRIBED AS FOLLOWS: On both sides of Indiana Avenue beginning
at 58th Street and extending south to 62nd Street.
AUTHORIZING THE PLACING OF SPEED LIMIT SIGNS: PRESCRIBING A PENALTY: PROVIDING
FOR PUBLICATION: AND DECLARING AN EMERGENCY: AND PROVIDING FOR THE EFFECTIVE
DATE OF THIS ORDINANCEo·
WHEREAS, the governing body, as authorized by Article 827a, Seco 8,
Vernon's Annotated Penal Code, finds that certain prima facie speed limits on
certain highwayR are different from what is reasonable or safe an~ should be
altered and the immediate preservation of public health and safety requires
immediate alteration of said prima facie-speed limits as hereafter set forth,
which creates an emergency; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF lUBBOCK:
SECTION lo The prima facie speed limit established by Article 827a,
Seco 8, Subsection l (b), Vernon's Annotated Penal Code is altered and changed
for all vehicles to 40 miles per hour on the following designated highways
or streets in th~ corporate limits of.the City of Lubbock, Lubbock County ,
Texas, to-wit: On both sides of Indiana Avenue beginning at 58th Street
and extending south to 62nd Street.
SECTION 2o The City Manager is authorized and directed to cause the
placing of signs so as to clearly define the limits of the prima facie areas
set out in this Ordinanceo
SECTION ·)o Any person? firm or corporation violating the prima facie
speed limit established by this Ordinance shall upon conviction be fined in
any sum not to exceed TWO HUNDRED DOLLARS ($200o00) and for subsequent viola-
tions within one year thereafter .shall be pro~ecuted as prescribed for such
violations by Seco 15 of Article 827a , Vernon's Annotated Penal Codeo
SECTION 4o The City Secretary is authorized and directed to cause
the publication of the descriptive caption of tms Ordinance together with
the penalty provision as an alternative method of publication as provided
by law. ·
SECTION 5o The fact that public necessity and convenience requires
that this Ordinance be passed as an emergency measure for reasons set forth
in the preamble hereof , the rule requiring that no Ordinance shall be finally
passed on the day of its introduction be suspended , and this Ordinance is de-
clared to be an emergency measure to take effect for and after its passageo
