Pedestrian Crossing - 01/11/1996I I I First Reading January 11, 1996 l Item 1128 Second Reading January 25, 1996 Item 118 ORDINANCE NO. 9874 AN ORDINANCE AMENDING CHAPTER 16 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO THE PROHIBITION OF PEDESTRIAN CROSSINGS ON FREEWAYS; PROVIDING FOR THE ERECTION OF SIGNS; PROVIDING A PENALTY; AND PROVIDING FOR PUBLICATION. WHEREAS, numerous pedestrians have been involved in serious accidents while crossing freeway vehicular traffic lanes within the City of Lubbock; and WHEREAS, the City Council of the City of Lubbock deems it to be in the best interest of the health, safety, and welfare of the citizens of the City of Lubbock to amend the Code of Ordinances of the City of Lubbock to protect pedestrians and automobile drivers from such freeway-related accidents; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 16-1 of the Code of Ordinances, City of Lubbock, Texas, is hereby amended by adding a section, to be inserted in alphabetical order, which said section reads as follows: Freeway: A divided arterial through highway with full control of access and with grade separations at intersections. SECTION 2. THAT Section 16-107 of the Code of Ordinances, City of Lubbock, Texas, is hereby amended by adding a section, to be numbered 16-107(e), which said section reads as follows: ( e) No pedestrian shall cross or use the vehicular traffic lanes of any freeway. This provision shall not apply to an employee of a governmental unit, agency, or subdivision, nor a contractor of such governmental unit, agency, or subdivision, who is engaged in the discharge of official duties. Nor shall this provision apply in emergency situations or to persons lawfully participating in parades, demonstrations, or recreational street uses that are duly permitted under this chapter. SECTION 3. Violation of any provision of this Ordinance shall be deemed a misdemeanor punishable as provided in Section 1-4 of the Code of Ordinances of the City of Lubbock, Texas. SECTION 4. THAT should any paragraph, section, sentence, phrase, clause or word of ithis Ordinance be declared unconstitutional or invalid for any reason, the remainder of this ; Ordinance shall not be affected thereby. SECTION 5. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method of publication provided by law.
