PERTY BETWEEN WEST LINE OF AVENUE HAND EAST LINE OF TEXAS A VENUE FROM AN "R•l tt TO A 11C.,..311 ZONING DISTRICT AND CHANGE THE REMAINDER (FROM EAST LINE OF TEXAS AVENUE TO THE EAST LINE OF AVENUE J) FROM AN 11R ... l 11 TO A ttC.,.411 ZONING DISTRICT WITH 11C•3" ZONING DISTRICT USES ALLOWED, PLUS A WAREHOUSE; SUBJECT TO CONDITIONS •. WHEREAS, the proposed change in zoning districts as hereinafter made has been duly presented to the Zoning and Planning Commission for its recommend ..- tion, which was received by the City Council and after due consideration, the City Council finds that making the proposed change as hereinafter set out will be in the public interest; and, WHEREAS~ all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 20 of Ordinance 1695 as well as notices pro ... vided by Article 1011f, Vernonts Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly held in the City Council Room on the second floor of the City Hall, Lubbock., Texas, at which time persons appeared in support of the proposal; and, after said hearing .. it was by the City Council determined that it would be in the public interest., due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced in final written form prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 1695 a~d the Official Zoning Map BE and the same are hereby amended as follows, to ... wit: ZONE CASE NO. 1303 Change the East 275. 15t of the property (Between West line of Avenue H and East line of Texas Avenue) from an uR ... l" to a 11C.,.3" Zoning District and change the remainder (from East line of Texas Avenue to the East line of Avenue J) from an ttR.,.ltt to a "C .... 411 Zoning District restricted to those uses permitted in a "C.,.311 Zoning District provided further that such uses may include a warehouse; SUBJECT TO THE FOLLOWING CONDITIONS: 1. That all the area South and West of the warehouse improvement be landscaped and permanently maintained. · .._). 2. All buildings shall be set back a minimum of 35t from Avenue J and from 52nd Street. 3. Areas unoccupied by buildings shall be fenced with a solid 6t permanent type screening fence which is to be permanently maintained and in the event said area is fenced the fence shall be set back a minimum of 35t from Avenue J and from 52nd Street. 4. No street access shall be permitted from 52nd Street or Avenue J abutting said premises. 5. No entrance shall be constructed on the South and West sides of any building placed on such areas provided~ however, that an entrance may be provided on the West side of the building if it opens within an area enclosed by a fence. SECTION 2. THAT from and after passage and effective date of the Ordinance, said lots~ tracts and parcels of land described in Section 1 hereof shall be changed to the zoning district indicated and the Official Map is amended in accordance herewith.
