HomeMy WebLinkAboutOrdinance - 4661-1965 - Creating The Dept Of Electrical Utilities, Electric Utility Board. - 03/25/1965;, ~ • ~F=O~S~·b=w===----------=-=-==---=----=-----==------===----===-~----+-== ~ o~-2.s-(.9lP5 ORDINANCE NO. __ 4.:..:6:..:::.6=-1 ____ _ AN ORDINANCE CREATING THE DEPARTMENT OF ELECTRICAL UTILI- TIES; CREATING AN ELECTRIC UTILITY BOARD; DEFINING THE DUTIES OF THE BOARD; PROVIDING FOR THE ORGANIZATION OF THE BOARD; CREATIN THE OFFICE OF DIRECTOR OF THE ELECTRICAL UTILITIES AND DEFINING HIS DUTIES; REPEALING ALL ORDINANCES IN CONFLICT WITH THIS ORDINANCE; AND DECLARING AN EMERGENCY. WHEREAS .. it appears that the business and daily operation of the Electric Utilities Department of the City of Lubbock is in need of a director with specific authority to supervise and control the production and distribution of electricity, and that there is a need for a Board to formulate rules and policy for solicitation, promotion and advertising the use of electricity produced by this department, and without which the business and daily operation of this department is seriously hampered which creates an emergency and an imperative public necessity that requires that this Ordinance be passed on the day it is first read and introduced before the City Council. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. DEPARTMENT OF ELECTRICAL UTILITIES There is hereby created the Department of Electrical Utilities of the City of Lubbock, designated as Lubbock Power and Light, which shall be responsible for the development, production and distribution of all electric utility service by the City. SECTION 2. ELECTRIC UTILITY BOARD There is hereby created and established a Board to be known as the Electric Utility Board of the City of Lubbock. SECTION 3. DUTIES OF THE BOARD (a} Except as otherwise provided in this Section the Electric Utility Board shall be responsible for recommendations to the City Council in the areas of research, expansion, operational policies, and all other acts that are in its opinion necessary, convenient or desirable in order to operate, maintain, en- large, extend, preserve and promote an orderly, economic and businesslike administration of the Department of Electrical Utilities of the City of Lubbock. No policy action within these areas shall hereafter be taken by the City Council or any administrative personnel of the City of Lubbock without first being referred to the Electric Utility Board for its study and recommendation. (b) The Electric Utility Board shall have in addition to the above responsi- bilities, absolute and complete authority and power which is hereby delegated wi reference to formulating rules and policy for solicitation, promotion and advertis ing, and authorizing reasonable expenditures from funds within the annual budget appropriated by the City Council to advertise and otherwise promote the use of services of the Department and to acquaint the public with the operations. pro- grams, and planned expansion of the Department. / ~-=~~--------~-=-----------=====3K~---------============---------=====-=====---~--- SECTION 4. ORGANIZATION OF BOARD (a) Number: The Board shall consist of seven (7) members to be appointed by the City Council. The City Manager and the Director of Electrical Utilities or their respective authorized representatives shall serve as ex officio members without vote. (b) Salary: No salary or compensation of any sort shall be paid to the members of said Electric Utility Board. (c) Tenure: The first membership of the Electric Utility Board shall be constituted from the five members of the present "Advisory Board of Directors of Municipal Utilities" whose terms are unexpired who are hereby appointed to serve their present unexpired terms, and two members who shall be appointed for a term of six years. All successive appointive members shall serve until their successors are appointed and qualified., unless removed from the Board as provided in Subsection (e) of this Section. (d) Vacancies: Upon the death., resignation .. removal by disqualification or expiration of the term of office of any member or members of said Electric Utility Board, the City Council shall appoint a member of said Electric Utility Board who shall hold his membership on said Board for the unexpired term to which he is appointed in the event of vacancy created before a full term has expired; otherwise .. he shall serve the full term of six years in the event he is succeeding a member whose term has fully expired. (e) Qualifications: No person shall be a member of the Board unless he shall have been for at least six years next preceeding his appointment a resident elector of the City, and unless he shall believe in the desirability of a competi- tive operation of electric production and distribution, and shall have no sub- stantial ownership, interest in or income derived from any electrical contractor or supply or electrical utility business located or doing business in Lubbock County. Any member who fails to attend four consecutive regular Board meetings for any reason other than sickness or absence from the City or who shall fail to attend at least 50o/o of the regular meetings in any one year shall become disqualified to serve on the Board., and upon certification of such absences from the Secretary of the Board, the City Council shall thereupon appoint a successor to complete the unexpired term. (f) Conduct of Meetings: The Board by majority vote shall annually during the month of February elect from among its members a chairman who shall pre- side over the meetings of the Board and a vice-chairman who shall act for the chairman during his absence .. and the chairman shall not be eligible to succeed himself more than one term. An election of officers of the Board shall be held at the first regular meeting at which all members are present and thereafter as herein provided. The Board shall adopt rules for the conduct of its meetings which shall provide for not less than one meeting each month. No action shall be taken by the Board except by the affirmative vote of at least four ( 4) members. Four ( 4) members shall constitute a quorum. SECTION 5. DIRECTOR OF ELECTRICAL UTILITIES There is hereby created the office of Director of Electrical Utilities who shall be appointed by and directly responsible to the City Manager. The Director of Electrical Utilities shall be and is hereby charged with the general management of the production~ sales and collections and distribution of electrical services to and for the City of Lubbock. The Director is hereby authorized~ directed, and empowered to supervise and control all operations for production~ sales and collections. and distribution of electricity and facilities now or hereafter owned, controlled and operated by the City of Lubbock. To this end the Director shall conserve the value of all properties and equipment by utilizing a continuous preventative maintenance program. The Director shall be responsible for all electrical properties in his custody and all monies and accounts received, collected and disbursed making full account to the City Manager and the City Council of each and every item. SECTION 6. THAT all Ordinances or parts of Ordinances inconsistent with or conflicting with the terms hereof are hereby repealed. SECTION 7. SINCE this Ordinance is an emergency measure for the rea- sons set forth in the preamble hereof, the rule requiring two readings before final passage is hereby suspended, and this Ordinance shall take effect immediately after its passage.
