AN ORDINANCE AMENDI~G ZONING ORDINANCE NO,. 169 5 AND THE
OFFICIAL MAP OF THE CITY 9F LUBBOCK SO AS TO MAKE THE FOLLOW-
lNG CHANGE: ZONE CASE NO. 834-A: CHANGE A TRACT OF LAND OUT OF
SECTION 17, BLOCK B.., LUBBOCK COUNTY, TEXAS~ FROM AN "R-1" TO A
"C-411 ZONING DISTRICT,. AND CHANGE ANOTHER PORTION OF SECTION 17,.
BLOCK B~ LUBBOCK COUNTY, TEXAS~ FROM AN "R-111 TO A '!C-211 ZONING
DISTRICT; SUBJECT TO CONDITIONS.
WHEREAS~ the proposed change in zoning districts as hereinafter made ha
been duly presented to the Zoning and Planning Commission for its recommendatio ,
which was received by the City Council and after due consideration, the City Coun
finds that making the proposed change as hereinafter set out will be in the public
interest; and,
WHEREAS~ all conditions precedent required by law for a valid amendment
to the Zoning Ordinance and Map have been fully complied with, as well as giving
notices i n compliance with Section 20 of Ordinance No. 169 5 as well as notices pro
vided by Article 10llf, Vernonts Annotated Civil Statutes, amended in 1961, and
notice was duly published in the Lubbock Morning Avalanche Journal more than
fifteen ( 15) days prior to the date of the public hearing before the City Council on
such proposed amendment, and the public hearing according to said notice was dul
held in the City Council Room on the second floor of the City Hall, Lubbock .. Texa
at which time persons appeared in support of the proposal;)and, after said hearing
it was by the City Council determined that it would be in the public interest,. due to
changed conditions, that the Zoning Ordinance and the Zoning Map be amended in t e
manner hereinafter set forth in the body of this Ordinance and this Ordinance hav·
been introduced in final written form prior to first reading hereof; NOW THERE-
FORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE an
the same are hereby amended as follows, to-wit:
ZONE CASE NO. 834-A
Change a tract of land out of Section 17, Block B,. Lubbock County,
Texas,. from an "R-1" to a "C-4" Zoning District, and change an-
other portion of Section 17, Block B., Lubbock County, Texas, from
an "R-1" to a "C-211 Zoning District.
TRACT 1.
Change a tract of land out of Section 17.. Block B., Lubbock County,
Texas from an "R-1" to a 11C-211 Zoning District. Property is
further described by metes and bounds to wit:
BEGINNING at a point 2500. 07t North 0° OP 2011 East and 1353. 51 t
South 89° 59t 10" West of the Southeast Corner Section 17, Block B;
THENCE West along the North line of an alley :t" 19 3t to a point even
with the lot line between Lots 138 and 139., Bender Terrace Addition;
THENCE North 138. 82t to a point in the South line of Lot 6.t Bullard
Addition;
THENCE East along said lot line to a point in the West ROW of Salem
Avenue;
THENCE South 36° 061 5011 East 171. 8l.t to the PLACE OF BEGINNING.
TRACT 2.
Change a tract of land out of Section 17,. Block B, Lubbock County,
Texas from an "R-1" to a 11C-411 Zoning District. Property is
further described by metes and bounds to wit:
BEGINNING at a point in the North line of the alley North of Lots
138 and 139.t Bender Terrace, City of Lubbock,. Lubbock CountY,,
Texas and even with the property lines between said lots;
THENCE West :t" 542t to a point in ROW line of Brownfield Road;
THENCE North 53° 52t 52" East 235. 701 along the Brownfield Road
ROW line to a point which is the SW Corner of Lot 1, Bullard
Addition;
THENCE North 89° 59t 49" East to a point in the South line of Lot
6., Bullard .Addition and even with the lot line between Lots 138 and
139., Bender Terrace Addition;
THENCE South 138. 82t to the PLACE OF BEGINNING.
SUBJECT TO THE FOLLOWING CONDITIONS:
1. That a 6f solid permanent type screening fence be erected and
permanently maintained along the South property line. Said
fence to be slanted or stepped down starting 25t from each end
to a height of 2 1/2t, so as to prevent obstruction to view.
Said fence to be constructed prior to, or concurrently with
the first unit of any building constructed on the property.
2. All buildings shall be set back a minimum of 201 North of
the alley along the South property line.
SECTION 2. THAT from and after passage and effective date of this Or-
inance said lots" tracts and parc.els of land described in Section 1 hereof shall be
hanged to the zoning district indicated and the Official Map is amended in accord-
ce herewith.
AND IT IS SO ORDERED.
