HomeMy WebLinkAboutOrdinance - 4628-1965 - Amending Zoning Ordinance No. 1695, Zone Case No. 1268. - 02/11/1965Amended by Ordinance No. 4666 ----oz-\ \ -l q(o 5 ORDINANCE NO. 4628 -----:,..-----::-02.-Zs~\qtos AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1895 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOW- ING CHANGE: ZONE CASE NO. 1268: CHANGE A TRACT OF LAND OUT OF SECTION 17~ BLOCK B., LUBBOCK COUNTY~ TEXASa FROM AN ''R-111 TO A "R-311 ZONING DISTRICT; SUBJECT TO CONDITIONS. I WHEREAS, the proposed change in zoning districts as hereinafter made has been duly presented to the Zoning and Planning Commission for its recom- mendation, which was received by the City Council and after due consideration, the City Council finds that making the proposed change as hereinafter set out will be in the public interest; and, WHEREAS, all conditions precedent required by law for a valid amend- ment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 20 of Ordinance No. 1695 as well as notices provided by Article lOllf, Vernon:s Annotated Civil Statutes, amended in 1961, and notice was duly published in the Lubbock Morning Avalanche Journ more than fifteen ( 15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice was duly peld~in .the City Council Room on the second floor of the City Hall .. Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing,. it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordi- nance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordina nce and this Ordinance having been introduced in final written form prior to first reading hereof; NOW,.. THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: ZONE CASE NO. 12 6 8 Change a tract of land out of Section 17 ~ Block B, Lubbock County., T exas, from an 11R-1" to an "R-3" Zoning District. Property is further described by metes and bounds to-wit: BEGINNING at a point in the East line of Raleigh Avenue~ said point being 630 feet West and 416 feet South of the Northeast Corner of Section 17, Block B .. Lubbock C ounty, Texas; THENCE South along the East line of Raleigh Avenue a distance of 1044. 52 feet to a point in the North Right of Way of the P &SF Railroad;.. ~ ~ _._; u_ _ **• THENCE N. 53° 51 1 E. along the North Right of Way line of the P & SF Railroad a distance of 61 o. 00 feet; THENCE N. 2° 28 1 1911 W. a distance of 685. 32 feet; THENCE West a distance of 463. 00 feet to the PLACE OF BEGINNING. The above described tract contains 9. 544 acres more or less. SUBJECT TO THE FOLLOWING CONDITIONS: 1. That the development be tied to the plan submitted at the hearing, said plan being on file on the Office of the Secretary, Planning and Zoning Commission. 2. That approval is subject to solving the drainage problems to the satisfaction of the City Director of Public Works. 3. Make following revisions to the plot plan which was submitted: a. Turn the alley, adjacent and parallel to the east line of Raleigh Avenue, into the Zlnd Place cul-de-sac. b. Turn that portion of the easement.. adjacent and parallel to the Panhandle and Santa Fe R~lroad from tl;le East property line to the 21st Street cul-de-sac, into the cul-de-sac and erect a fence or barricade to prevent vehicular use of the remaining portion of the easement next to the Railroad. SECTION 2.. THAT from and after passage and effective date of this Ordinance said lots, tracts and parcels of land described in Section 1 hereof shall be changed to the zoning district indicated and the official map is amended in accordance herewith. AND IT IS SO ORDERED. Passed by the City Council on first reading this llthday of February 1 1965.
