HomeMy WebLinkAboutOrdinance - 10029-1997 - Adopting 1996 International Mechanical Code - 11/13/1997First Reading Item 1125 November 13, 1997 Second Reading Item /119 December 11, 1997 ORDINANCE NO. 10029 ------ AN ORDINANCE AMENDING ARTICLE IV OF CHAPTER 6 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO ADOPTING THE 1996 EDITION OF THE INTERNATIONAL :MECHANICAL CODE; ESTABLISHING FEES; PROVIDING FOR CERTAIN AMEND:MENTS TO SUCH CODE IN ORDER TO :MEET LOCAL CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, it is the opinion of the City Council that the best interests of the citizens of the City of Lubbock would be served by adopting the 1996 Edition of the International Mechanical Code for Lubbock with certain amendments to meet local conditions; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION I. THAT Section 6-101 of the Code of Ordinances of the City ofLubbock, Texas, is hereby amended to read as follows: Sec. 6-101. International Mechanical Code adopted. The 1996 Edition of the International Mechanical Code, as copyrighted in 1996 by the International Code Council, Inc.; Building Officials and Code Administrators International, Inc.; International Conference of Building Officials; and the Southern Building Code Congress International, Inc., along with any appendices thereto, as amended in this Article, is specifically adopted as the mechanical code of the City, and a copy is attached to the ordinance adopting said code and said code is incorporated herein as if set out herein in detail. References in this Article to the mechanical code shall mean the 1996 Edition of the International Mechanical Code. A copy of said International Mechanical Code shall be filed with the city secretary and a copy shall be maintained in the office of the building official. All such copies shall be open to public inspection during business hours of the offices where they are maintained, along with the amendments to such code provided in this Article. SECTION 2. THAT Section 6-102 of the Code of Ordinances of the City ofLubbock, Texas, be amended to read as follows: Sec. 6-102. Existing installations. Section 102.2 of the International Mechanical Code be amended to read as follows: 102.2 Existing installations. Mechanical installation systems lawfully in existence at the time of the adoption of this code may have their use, maintenance or repair continued if the use, maintenance or repair is in accordance with the original design and location ptbvided an:d that n:o hazard to life, health or property is created by such mechanical system. SECTION 3. THAT Section 6;.103 of the Code of Ordinances of the City ofLubbock, Texas, be amended to read as follows: Sec. 6 .. 103. Moved buildings. Section 102. 7 of the Intetiiitti.cnal Mechanical. Code is hereby amended to read as follows: 102. 7 Moved b1iildings. J\fe'chanical systems that are part of buildings or structures moved into or within the jurisdiction shall comply with the provisions of this code for new instatla:tions. SECTION 4. THAT Section 6"-103.1 of the Code of ordinances of the City of Lubbock, Texas, be deleted and the number reserved for future use. SECTION 5. THAT Section 6-103.2 of the Code of Ordinances of the City ofLubbock, Texas, be deleted and the number reserved for future use. SECTION 6. THAT Section 6 ... JQ4 of the Code of Ordinances of the City of Lubbock, Texas, be amended to read as follows: Section 106.4 of the International l\fochanical Code pertaining to extensions of permits shall be deleted and of no force and effect. SECTION 7. TH.AT Section 6-105 of the Code of Ordinances of the City of Lubbock, Texas, be amended to: reatl as follows: Section 106.5 of the International Building Code shall be amended to read as foflows: 106.5. Fees. Every application for a mechanical permit shall be accompanied by the payment therefor in accordance with the mechanica] permit fee as adopted by the City Council and periodically adjusted pursuant to City Ordinance No. 8248. (a) New construction shaU be J)'ermitted at a rate of $.03 per squared foot of the building or structure being served by the mechanical equipment. The minimum fee shall be $25.00. Exception: In ,varehouses and storage type oc~upancies only, if only four ( 4) or fewer mechanical units without branch ducts are to be installed, the fee shall be the mfriimum Jee plus the fee per unit required by this anicle for repair or replacement mechanical equipment. 2 (b) Repairs or replacements of mechanical equipment in existing buildings or structures shall be as set out hereafter in the unit fee schedule. SECTION 8. THAT Section 6-106 of the Code of Ordinances of the City ofLubbock, Texas, be amended to read as follows: Sec. 6-103.2. Fee schedule. Section 106.5.2 of the International Mechanical Code is hereby amended to read as follows: Sec. 106.5.2. Fee schedule. The fees for mechanical work on new construction, not including repair or replacement, shall be $.03 per square foot. The minimum mechanical permit fee shall be $25.00. Repair, replacement or new installation in existing buildings shall be as set forth hereafter in the unit fee schedule. The minimum mechanical permit fee for repair, replacement or new installation in an existing building shall be $25.00. Where work is commenced prior to obtaining the required permits, the fee shall be twice the original cost plus a $25.00 red tag fee. Unit Fee Schedule: (Note: the following does not include the permit issuance fee.) 1) Furnaces: For the installation or relocation of each forced-air or gravity-type furnace or burner, including ducts and vents attached to such appliance up to 100,000 Btu/h (29.3 kW) $13.25 For the installation or relocation of each forced-air or gravity-type furnace or burner, including ducts and vents attached to such appliance over 100,000 Btu/h (29.3 kW) $16.25 For the installation or relocation of each floor furnace, including vent $13.25 For the installation or relocation of each suspended heater, recessed wall heater or floor-mounted unit heater $13.25 2. Appliance vents: For the installation, relocation or replacement of each appliance vent installed and not included in the an appliance permit $6.50 3. Repairs or additions: 3 For the repair of, alteration of or addition to each heating appliance, refrigeration unit, cooling unit, absorption unit, or each heating, cooling, absorption or evaporative cooling system, including installation of controls regulated by the Mechanical Code $12.25 4. Boilers, compressors and absorption systems: For installation or relocation of each boiler or compressor to and including three (3) horsepower (10.6 kW) or for each absorption system to and including 100,000 Btu/h (29.3 kW) $13.15 For installation or reallocations of each boiler or compressor over three (3) horsepower (10.6 kW), to and including fifteen (15) horsepower (57.2 kW) or for each absorption system over 100,000 Btu/h (29.3 kW) to and including 500,000 Btu/h (146.6 kW) $24.25 For the installation or relocation of each boiler or compressor over fifteen (15) horsepower (52.7 kW) to and including thirty (30) horsepower (105.5 kW) or for each absorption system over 500,000 Btu/h (146.6 kW) to and including 1,000,000 Btu/h (293.1 kW) $33.25 For the installation or relocation of each boiler or compressor over thirty (30) horsepower (105.5 kW) to and including fifty (50) horsepower (176 kW) or for each absorption system over 500,000 Btu/h (293.1 kW) to and including 1,750,000 Btu/h (512.9 kW) $49.50 For the installation or relocation of each boiler or compressor over fifty (50) horsepower (176 kW) or for each absorption[ system over 1,750,000 Btu/h (512.9 kW) $82. 75 5. Air Handlers: For each air-handling unit to and including 10,000 cubic feet per minute (4720 Us) including ducts attached thereto $9.50 Note: This fee does not apply to an air handling unit which is a portion ofa factoiy-assembled appliance, cooling unit, evaporative cooler or absorption unit for a permit is required elsewhere in the Mechanical Code. For each air handling unit exceeding 10,000 cfin (4720 Us) $16.15 6. Evaporative coolers: For each evaporative cooler other than portable type $9.50 4 7. Ventilation and exhaust: For each ventilation fan connected to a single duct $6.50 For each ventilation system which is not a portion of the heating or air- conditioning system authorized by a permit $9.50 For the installation of each hood which is served by mechanical exhaust, including the ducts for such hood $9.50 8. Incinerators: For the installation or relocation of each domestic-type incinerator $16.25 For the installation or relocations of each commercial or industrial-type incinerator $66.50 SECTION 9. THAT Section 6-107 of the Code of Ordinances of the City ofLubbock, Texas, be amended to read as follows: Section 106.5.3 of the International Mechanical Code shall be amended by deleting therefrom subsections 2 and 3, which subsections shall be of no force and effect. SECTION 10. THAT Section 6-108 of the Code or Ordinances of the City of Lubbock, Texas, be amended to read as follows: Section 107 .1 of the International Mechanical Code shall be amended by amending the first paragraph of said section to read as follows and by deleting subsections 1, 2 and 3 and the last paragraph from said section.: 107 .1 Required inspections and testing. The code official, upon notification from the permit holder or the permit holder's agent, shall make such inspections as necessary, and shall either release that portion of the construction or shall notify the permit holder or the permit holder's agent of violations that must be corrected. The holder of the permit shall be responsible for requesting such inspections. The following inspections shall be requested and approved prior to work continuing on any type of permit: 1) Rough duct. 2) Underground duct. 3) Return air. 4) Temporary heating inspection 5 5) Final. SECTION 11. THAT Section 6-109 of the Code of Ordinances of the City ofLubbock, Texas, be amended to read as follows: Sec. 6-108. Overhead Radiant Heaters. Section 926 of the International Mechanical Code is amended to read as follows: 926.1. General. Unvented fuel-burning appliances used for comfort heating shall not be installed, used, maintained or permitted to exist in Group I, R, A, or E Occupancies nor shall an unvented heater be installed in any building, whether as a new or replacement installation, except as follows: 926.2. Overhead radiant heaters. Listed or approved unvented overhead room heaters may be installed in Group A, Division 2, 2.1, 3 or 4; Group B, H, Division 4, Division 5; or Group U occupancies, provided the installation conforms to all of the following requirements: 1) All portions of the heater are located at least 8 feet (2,438 mm) above the floor. 2} At least two unobstructed permanent openings are provided to the room or space containing such heaters. These openings shall open directly to the outside of the building through the floor, roof, or wall. The minimum combined total area of these openings shall be at least one (1) square inch for each 1,000 Btu/h (2.2 sq. mm/W) input of the heater or heaters, with a minimum total area of 100 square inches (0.645 sq. m). One half of the required openings shall be above the heater or heaters and one half shall be located below the heater or heaters. Exceptions: When approved by the building official, provisions may be made to exhaust the products of combustion to the exterior by mechanical means. 3) Heaters shall be safely and securely supported with hangers and brackets of noncombustable material and installed with clearances from combustible materials as specified on the required manufacturer's label. 926.3. Unvented decorative appliances. Unvented decorative appliances may be installed in recessed decorative fireplaces in new construction only, except in locations prohibited by Section 303.3, if the unit is provide with an oxygen depletion sensitive safety shutoff system. Such system shall shut off the gas supply to the main and pilot burners when the oxygen in the surrounding atmosphere is depleted to the percent concentration specified by the manufacturer, but no lower than 18 percent. The system shall not incorporate field adjustment means capable 6 of changing the set point at which the system acts to shut off the gas supply to the appliance. 926.4. Kerosene and oil stoves. Kerosene and oil-fired stoves shall comply with NFPA31. SECTION 12. THAT Section 6-110 of the Code of Ordinances of the City ofLubbock, Texas, is hereby amended to read as follows: Sec. 6-110. §108.4. Violations and penalties. Section 108.4 of the International Mechanical Code is hereby amended to read as follows: Any person, firm, or corporation violating any provision of this code shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any provision of this code is committed, continued or permitted, and upon conviction of any such violation such person shall be punished by a fine of not more than two hundred dollars ($200.00). SECTION 13. THAT violation of any provision of this ordinance shall be a misdemeanor punishable as provided by Section 1-4 of the Code of Ordinances of the City ofLubbock, Texas. Each day on which a violation shall occur or continue shall be deemed a separate and distinct offense. SECTION 14. THAT should any paragraph, section, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 15. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method of publication provided by law. 7 AND IT IS SO ORDERED.
