First Reading Item #24 November 13, 1997 Second Reading Item 1118 December 11, 1997 ORDINANCE NO. 10028 AN ORDINANCE AMENDING ARTICLE ill OF CHAPTER 6 OF TIIB CODE OF ORDINANCES OF TIIB CITY OF LUBBOCK, TEXAS, WITH REGARD TO ADOPTING THE 1997EDITION OF THE INTERNATIONAL PLUMBING CODE AND PROVIDING FOR CERTAIN AMENDMENTS TO SUCH CODE IN ORDER TO MEET LOCAL CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, it is the opinion of the City Council that the best interests of the citizens of the City of Lubbock would be served by adopting the 1997 Edition of the International Plumbing Code for Lubbock with certain amendments to meet local conditions; NOW TIIBREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 6-81 of the Code of Ordinances of the City of Lubbock, Texas, is hereby amended to read as follows: Sec. 6-81. International Plumbing Code Adopted. The 1997 Edition of the International Plumbing Code published by Building Officials and Code Administrators International, Inc., as hereinafter amended is hereby adopted as the plumbing code of the City of Lubbock, Texas. A copy of said plumbing code is attached hereto and incorporated herein as though set out herein in detail. References to the Plumbing Code in this Chapter shall mean the 1997 Edition of the International Plumbing Code. One copy of the 1997 International Plumbing Code shall be filed with the city secretary and a copy shall be maintained in the office of City building official. All such copies, with the amendments thereto, shall be open to public inspection during the usual hours of business of the offices where they are maintained. SECTION 2. THAT Section 6-81.1 of the Code of Ordinances of the City of Lubbock, Texas,.is hereby amended to read as follows: Sec. 6-81.1. §103.1, 103.2 and 103.3. Administrative authority. (a) Section 103.1 of the International Plumbing Code is not adopted by the City of Lubbock. (b) Section 103.2 of the International Plumbing Code is not adopted by the City of Lubbock. (c) Section 103.3 of the International Plumbing Code is hereby amended to read as follows: 103.3. Administrative Authority. The administrative authority duly appointed to enforce this Code shall be the building official of the City of Lubbock. However, I . said building official is hereby authorized to designate qualified employees serving under his discretion and control to assist in the discharge of such duties. SECTION 3. THAT Section 6-81.2 of the Code of Ordinances of the City ofLubbock, Texas, be amended by replacing the reference therein to "Section 20.3 of the Uniform Plumbing Code" with a reference to "Section l 08 of the International Plumbing Code." SECTION 4. THAT Section 6-81.3 of the Code of Ordinances of the City ofLubbock, Texas, be amended to read as follows: Sec. 6-81.3. §106.3. Application for permit. Section 106.3 of the International Plumbing Code is hereby amended by adding the following language at the beginning of Section 106.3: Permits for any type of plumbing, including gas piping, shall be issued only to a master licensed plumber, or a homeowner doing work on a residence occupied as their homestead. All plumbing shall be performed by state licensed plumbers except when an exemption is granted by the State Plumbing License Law. SECTION 5. THAT Section 6-82 of the Code of Ordinances of the City of Lubbock, Texas, be amended to read as follows: Sec. 6-82. §106.5.2. Fee schedule. Section 106.5.2 of the International Plumbing Code is hereby amended by inserting the following fee schedule into such section at the place indicated therein. SCHEDULE OF FEES New Construction, excepting repair or replacement shall pay a fee of$.03 per square foot. Minimum permit fee Repair, replacement or new installation in existing buildings Water softener Yard sprinkler system Sewer replacement and/or top Gas service replacement Water service replacement Water heater replacement Gas grill or yard light (each) All reinspection fees, red tags (each) $25.00 $25.00 $25.00 $25.00 $25.00 $25.00 $25.00 $25.00 $25.00 $25.00 All alterations of or additions to existing systems shall pay a fee equivalent to $2.00 per $1,000.00 of valuation or twenty-five dollars ($25.00), whichever is greater. 2 Exception: Shell buildings and warehouses shall pay a fee of$.005 per square foot where minimal plumbing is installed. Additional permit and fee is required prior to completion of interior of shell buildings or warehouses of$. 025 per square foot if additional plumbing is required. However, up to six (6) fixtures may be installed for the minimum permit fee or at a rate of$2.00 per $1,000 valuation, whichever is greater. SECTION 6. THAT Section 6-82.1 of the Code of Ordinances of the City ofLubbock, Texas, be amended to read as follows: Sec. 6-82.1. § 106.6. Contractor's Responsibilities. Section 106.6 of the International Plumbing Code shall be amended to read as follows: It shall be the duty of the person doing the work authorized by the permit to notify the administrative authority that the work is ready for inspection. Such notification shall be given not less than four ( 4) hours before the work is to be inspected (inspections will be on City working days only). It shall be the duty of the person doing the work authorized by the permit to make sure that the work is inspected and will withstand the testing prescribed elsewhere in this code, before giving the above notification to inspect. SECTION 7. THAT Section 6-83 of the Code of Ordinances of the City of Lubbock, Texas, be amended by amending the references therein to "§20.14;" "Section 20.14 of the Uniform Plumbing Code," and "Uniform Plumbing Code to read as "§109;" "Section 109 of the International Plumbing Code," and" International Plumbing Code," respectively. SECTION 8. THAT Section 6-84 of the Code of Ordinances of the City of Lubbock, Texas, be amended to read as follows: Sec. 6-84. §106.7. Certificate of insurance; bond. A new §106.7 is hereby added to the International Plumbing Code, which shall read as follows: 106.7. Certificate of Insurance; bond. Any person, firm, corporation or association seeking to obtain any permit required under this chapter shall have in force the following insurance: 3 (a) One hundred thousand dollars ($100,000.00) of comprehensive general liability insurance, per occurrence, including coverage for bodily injury and property damage with products liability and completed operations coverage; and (b) Workman's compensation coverage as required by state law. ( c) A compliance surety bond in the amount of ten thousand dollars ($10,000.00) may be substituted for the above insurance. Prior to issuance of any permit, such applicant shall furnish the building official with a certificate of insurance evidencing the required insurance coverage or with a valid bond in the amount stated above, if applicable. These requirements shall not apply to a home owner seeking a permit to work on his own residence. The insurance coverage shall include a provision that in the event such insurance coverage or bond is canceled or reduced, the insurance carrier or bond surety shall notify the building official at least ten (10) days prior to such cancellation or reduction in coverage. An applicant's permit shall be automatically suspended during any period in which the applicant fails to maintain in effect the required insurance coverage or bond. SECTION 9. THAT Section 6-85 of the Code of Ordinances of the City ofLubbock, Texas, be deleted and the number reserved for future use. SECTION 10. THAT Section 6-85.1 ofthe Code of Ordinances of the City ofLubbock, Texas, be deleted and the number reserved for future use. SECTION 11. THAT Section 6-85.2 of the Code of Ordinances of the City ofLubbock, Texas, be deleted and the number reserved for future use. SECTION 12. THAT Section 6-85.3 of the Code of Ordinances of the City of Lubbock, Texas, be deleted and the number reserved for future use. SECTION 13. THAT Section 6-85.4 of the Code of Ordinances of the City ofLubbock, Texas, be amended to read as follows: Sec. 6-85.4. §402.4. Sheet lead. Section 402.4 of the International Plumbing Code shall read as follows: Sheet lead shall not be less than the following: For safe pans --not less than two and one half (2.5) pounds per square foot (192 Pa). 4 For flashings of vent terminals --not less than two and one half(2.5) pounds per square foot (144 Pa). For lead bends and traps --not less than one-eighth (1/8) inch (3.2 mm) wall thickness. SECTION 14. THAT Section 6-85.6 of the Code of Ordinances of the City of Lubbock, Texas, be amended to read as follows: Sec. 6-85.6. §107. Inspection and testing. Section 107 .1 of the International Plumbing Code shall be amended to add thereto a new subsection ( 4) to read as follows: (4) Advance Notice. It shall be the duty of the person doing the work authorized by the permit to notify the administrative authority orally or in writing that the work is ready for inspection. Such notice shall be giyen not less than four ( 4) hours before the work is to be inspected. SECTION 15. THAT Section 6-85.7 of the Code of Ordinances of the City of Lubbock, Texas, be amended to read as follows: Sec. 6-85. 7. §312.2. Drainage and vent water test. Section 312.2 of the International Plumbing Code shall be amended to read as follows: 312.2. Drainage and vent water test. A water test shall be applied to the drainage · system either in its entirety or in sections. If applied to the entire system, all openings in the piping shall be tightly closed, except the highest opening, and the system shall be filled with water to the point of overflow. If the system is tested in sections, each opening shall be tightly plugged except the highest openings of the section under test, and each section shall be filled with water, but no section shall be tested with less than a 5-foot head of water. In testing successive sections, at least the upper five (5) feet of the next preceding section shall be tested so that no joint or pipe in the building, except the uppennost five (5) feet of the system, shall have been submitted to a test of not less than a 5-foot head of water. The water shall be kept in the system, or in the portion under test, for at least 15 minutes before inspection starts. The system shall then be tight at all points. SECTION 16. THAT Section 6-85.9 of the Code of Ordinances of the City ofLubbock, Texas, be amended to read as follows: Sec.-85.9. Standpipes. 5 Section 802 of the International Plumbing Code shall be amended by adding thereto a new Subsection 802.5 to read as follows: 802.5. Standpipes. No trap for any clothes washer standpipe receptor shall be installed below the floor, but shall be roughed in not more than six ( 6) inches (152.4 mm) above the floor. SECTION 17. TIIAT Section 6-85.9.1 of the Code of Ordinances of the City ofLubbock, Texas, be deleted and the number reserved for future use. SECTION 18. TIIAT Section 6-85.10 of the Code of Ordinances of the City ofLubbock, Texas, be deleted and the number reserved for future use. SECTION 19. TIIAT Section 6-85.11 of the Code of Ordinances of the City of Lubbock, Texas, be deleted and the number reserved for future use. SECTION 20. TIIAT Section 6-85.12 of the Code of Ordinances of the City ofLubbock, Texas, be amended to read as follows: Sec. 6-85.12. §1002.1. Traps required. Section 1002.1 of the International Plumbing Code shall be amended by amending Exception 2 to read as follows: 2. Each compartment of a sink fixture shall be trapped individually or shall discharge through an indirect waste pipe by means of an air-gap. Each double compartment kitchen sink shall be served by two (2) traps and shall have a cleanout. If the kitchen sink is on the outside wall, then the cleanout shall be on the outside of the building. SECTION 21. TIIAT Section 6-85.13 of the Code of Ordinances of the City of Lubbock, Texas, be deleted and the number reserved for future use. SECTION 22. THAT Section 6-85.14 of the Code of Ordinances of the City ofLubbock, Texas, be deleted and the number reserved for future use. SECTION 23. TIIAT Section 6-85.15 of the Code of ordinances of the City of Lubbock,· Texas, be amended to read as follows: Sec. 6-85.15. Interceptors and separators. That Section 1003 of the International Building Code be amended by adding the following subsections thereto: 6 I . 1003 .14. Kitchens, food preparation areas. Each waste pipe from kitchen floor drains, kitchen sinks, dishwashers in hotels, restaurants, boarding houses or public cooking places shall be run into grease interceptors of a type in which separation is accomplished by differential gravity methods and which is approved by the city. 1003 .15. Location of grease interceptors. A grease interceptor, when required, shall be located as near as possible to the fixture or fixtures which it serves, and when these fixtures are separately trapped, provision shall be made for a local vent on the inlet side of the interceptor to open air, except when the fixture outlet is not more than five (5) feet from the interceptor, then in such case the trap and local vent may be omitted. 1003.16. Prohibition. Water jacket grease interceptors may not be installed. 1003 .17. Grease interceptor capacity. The grease retaining capacity of each grease interceptor, in pounds of grease, shall be equal to twice the rate of flow capacity in gallons per minute of waste water so that the interceptor shall remove and retain ninety percent (90%) of the grease discharged into it up to its required capacity of accumulated grease. Oil interceptors. Oil interceptors shall be installed where required by the city and shall meet the requirements of the city as to design and efficiency. SECTION 24. THAT Section 6-85.16 of the Code of Ordinances of the City of Lubbock, Texas, be deleted and the number reserved for future use. SECTION 25. THAT Section 6-85.17 of the Code of Ordinances of the City of Lubbock, Texas, be amended to read as follows: Sec. 6-85 .17. Sand traps for garages and service stations. 7 I Section 1003.7.2 of the International Plumbing Code is hereby amended to read as follows: 1003.7.1 Garages and service stations. Approved sand traps shall be installed in all service stations, public garages, steam cleaning plants and other commercial buildings where the washing or steam cleaning of automobiles, trucks, machinery, or similar items is done. Such sand traps shall be considered approved when constructed in accordance with the sand trap detail diagram, a copy of which shall be maintained in the building inspection office of the city. SECTION 26. THAT Section 16-85 .18 of the Code of Ordinances of the City of Lubbock, Texas, be deleted and the number reserved for future use. SECTION 27. THAT Section 6-85.19 of the Code of Ordinances of the City of Lubbock, Texas, be deleted and the number reserved for future use. SECTION 28. THAT Section 6-85.20 of the Code of Ordinances of the City of Lubbock be deleted and the number reserved for future use. SECTION 29. THAT Section 6-85.21 of the Code of Ordinances of the City of Lubbock, Texas, be deleted and the number reserved for future use. SECTION 30. THAT Section 6-85.23 of the Code of Ordinances of the City ofLubbock, Texas, be deleted and the number reserved for future use. SECTION 31. THAT Section 6-85.24 of the Code of Ordinances of the City of Lubbock, Texas, be deleted and the number reserved for future use. SECTION 32. THAT Section 6-85.25 of the Code of Ordinances of the City ofLubbock, Texas, be amended to read as follows: Sec. 6-85.25. §701.2.1. Sewer required. That Section 701.2 of the International Plumbing Code be amended by adding thereto the following sentence: A public sewer may be considered as not being available when the nearest public sewer is located more than one hundred (100) feet from the property. SECTION 33. THAT Section 6-45.26 of the Code of Ordinances of the City ofLubbock, Texas, is hereby deleted and the number reserved for future use. SECTION 34. THAT Section 6-45.27 of the Code of Ordinances of the City of Lubbock, Texas, is hereby deleted and the number reserved for future use. 8 SECTION 35. THAT Section 6-45.28 of the Code of Ordinances of the City of Lubbock, Texas, is hereby deleted and the number reseived for future use. SECTION 36. THAT Section 6-45.30 of the Code of Ordinances of the City of Lubbock, Texas, is hereby amended to read as follows: Sec. 6-45.30. Inspection of gas piping. Section G l 04 .18 of the International Plumbing Code is hereby amended to read as follows: G l 04 .18. Testing of gas piping. A final inspection shall be made after all piping authorized by the permit has been installed and after all portions thereof which are to be covered or concealed are so concealed and before any fixtures, appliances or shutoff valves have been attached thereto. This inspection shall include an air pressure test, at which time the gas piping shall stand a pressure of not less than fifteen (15) inches of mercury, measured with a manometer or slope gauge. Tests for pressure shall be held for a length of time satisfactory to the administrative authority, but in no case for less than fifteen (15) minutes with no perceptible drop in pressure. For welded piping, and for piping carrying gas at pressures in excess of fourteen (14) inches (.4 m) of water column pressure, the test pressure shall not be less than sixty (60) pounds per square inch (413.4 kPa) and shall be continued for a length of time satisfactory to the administrative authority, but in no case for less than thirty (30) minutes. These tests shall be made using air pressure only, and shall be made in the presence of a representative of the administrative authority. All necessary apparatus for conducting tests shall be furnished by the permit holder. SECTION 36. SECTION 6-85.31 of the Code of Ordinances of the City ofLubbock, Texas, be amended to,read as follows: Sec. 6-85.31. §Gl05.6. Exterior shutoff. Section Gl05.6 of the International Plumbing Code shall be amended by adding the following sentence thereto: On single structures on a lot, a union shall be installed at any penetration. SECTION 37. THAT Section 6-45.32 of the Code of Ordinances of the City ofLubbock, Texas, be amended to read as follows: Sec. 6-45.32. §G109. Appliance connectors. That a new Subsection G109.7 be added to the International Plumbing Code to shall read as follows: 9 I . 7. Aluminum alloy connectors may not be used for gas supply lines. SECTION 38. THAT Section 6-45.33 of the Code of Ordinances of the City ofLubbock:, Texas, be deleted and the number reserved for future use. SECTION 39. THAT Section 6-85.33.1 of the Code of Ordinances of the City of Lubbock, Texas, be deleted and the number reserved for future use. SECTION 40. THAT Section 6-85.33.2 of the Code of Ordinances of the City of Lubbock, Texas, be amended to read as follows: Sec. 6-85.33.2. Required drip leg trap. A new subsection 0104.18.2 shall be added to the International Plumbing Code to read as follows: 0104.18.2. Required drip leg trap. Gas fired water heaters and furnaces shall be provide with a drip leg trap on the supply line. SECTION 41. THAT Section 6-85.33.3 of the Code of Ordinances of the City of Lubbock, Texas, shall be deleted and the number reserved for future use. SECTION 42. THAT Section 6-85.34 of the Code of Ordinances of the City ofLubbock, Texas, be deleted and the number reserved for future use. SECTION 43. THAT Section 6-86 of the Code of Ordinances of the City of Lubbock, Texas, be amended to read as follows: Sec. 6-86. §G 112. Mobile homes, gas-fitting and gas-piping installation. A new Section Gl 12 shall be added to the International Plumbing Code to read as follows: SECTION Gl 12 MOBILE HOMES G 112. Gas-fitting and gas-piping installation. When gas-fitting and gas-piping installations associated with mobile homes are completed, the system shall be tested for leaks by means of a mercury gauge. The test shall be to the satisfaction of the city plumbing inspector. For purposes of this section, the system shall include all exposed gas-piping, the mobile home service line and all concealed gas- piping in the mobile home. The piping shall be tight and under a pressure of not less than ten {10) inches of mercury column maintained for a period of not less than ten (10) minutes. All gauges used in testing shall be in good condition with a 10 clear column of mercury with no air bubbles appearing. Except as otherwise provided in this section, the provision of this plumbing code shall apply to all gas- fitting and gas-piping installations associated with installation of a mobile home. SECTION 44. THAT violation of any provision of this ordinance shall be a misdemeanor punishable as provided by Section 1-4 of the Code of Ordinances of the City of Lubbock, Texas. Each day on which a violation shall occur or continue shall be deemed a separate and distinct offense. SECTION 45. THAT should any paragraph, section, sentence, phrase, clause or word of this Ordinance be declared uncom,1:itutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 46. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method of publication provided by law.
