HomeMy WebLinkAboutOrdinance - 10015-1997 - Nominating An Area As Defense Economic Readjustment Zone - 08/28/1997I First Reading Item #42 Second Reading Item 1122 September 11, 1997 August 28, 1997 ORDINANCE NO._1 __ no .... 1._.5,_ ____ _ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LUBBOCK, TEXAS NOMINATING AN AREA AS A DEFENSE ECONOMIC READJUSTMENT ZONE PURSUANT TO THE TEXAS DEFENSE ECONOMIC READJUSTMENT ZONE ACT (TEXAS GOVERNMENT CODE, CHAPTER 2310); PROVIDING TAX INCENTIVES; WHEREAS, the City Council of the City of Lubbock, Texas desires to encourage the Lubbock Reese Redevelopment Authority hereinafter called the "LRRA" to create the proper economic and social environment to induce the investment of private resources in productive business enterprises located at Reese Air Force Base, slated for closure on September 3 0, 1997, and to provide employment to residents of the area; and WHEREAS, certain conditions exist in such area which represent a threat to the health, safety, and welfare of the people of such area; and WHEREAS, it is necessary and in the best interest of the City to nominate such area as a defense economic readjustment zone pursuant to the Texas Defense Economic Readjustment Zone Act (Texas Government Code, Chapter 2310, the "Act"); and WHEREAS, the LRRA was created pursuant to the terms of Chapter 2311 of the Government Code to redevelop the area known as Reese Air Force Base; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK, TEXAS: Section 1. THAT the City of Lubbock hereby nominates the area indicated on the maps attached hereto as Exhibit A and further described below as a defense economic readjustment zone in accordance with the Act: The Reese Readjustment Zone, whether or not specifically described below, includes all real property AS OF AUGUST 1, 1997 owned and/or occupied by the United States Government, known as Reese Air Force Base, located in Lubbock County, Texas, including, without limitation, the lands specifically described below; LESS AND EXCEPT lands owned and/or occupied by the United States Government, known as Reese Air Force Base (i) located south of State Highway 114 ( commonly known as Hurlwood); (ii) located east of Quitsna Avenue (commonly known as Reese Village); (iii) located IN THE west HALF of SECTION 26 OF BLOCK D-6 (commonly known as Reese Landfill); AND (IV) EASEMENTS AND/OR RIGHTS-OF-WAY, TO THE EXTENT SAME ARE NOT INCLUDED WITHIN THE LANDS SPECIFICALLY DESCRIBED BELOW. The Reese Readjustment Zone is more specifically described as follows: BEGINNING AT A POINT WIIlCH IS THE SOUTHEAST CORNER OF SECTION 4, BLOCK D-6, LUBBOCK COUNTY, TEXAS WIIlCH IS ALSO THE INTERSECTION OF STATE HIGHWAY 114 AND QUITSNA AVENUE; THENCE NORTH ALONG ,QUITSNA A VENUE AND THE EAST SECTION LINE OF SECTION 4 BLOCK D-6 FOR 5,280 FEET AND THEN CONTINUING NORTHWARD ALONG THE EAST SECTION LINE OF SECTION 25 BLOCK D-6 FOR 2,640 FEET TO A POINT, POINT ALSO BEING ON THE EAST-WEST HALF SECTION LINE OF SECTION 25, BLOCK D-6; THENCE WEST 813.3 FEET TO A POINT; THENCE NORTH 659.6 FEET TO A POINT; THENCE WEST 1,479.5 FEET TO A POINT: THENCE NORTH 47 DEGREES WEST APPROXIMATELY 488 FEET TOA POINT; THENCE NORTH 1,677.1 FEET TO A POINT IN THE NORTH LINE OF SECTION 25 BLOCK D-6 AND THE SOUTH LINE OF SECTION 20 BLOCK JS AND THEN CONTINUING NORTHWARD 3,840 FEET IN SECTION 20 BLOCK JS TO A POINT FOR THE MOST NORTH- EASTERLY CORNER OF THIS TRACT; THENCE WEST 2,636.3 FEET TO A POINT, POINT BEING LOCATED IN THE WEST LINE OF SECTION 20 BLOCK JS AND THE EAST LINE OF SECTION 45 BLOCK P AND THEN CONTINUING WESTWARD IN SECTION 45 BLOCK P 2,708.9 FEET TO A POINT FOR THE NORTHWEST CORNER OF THIS TRACT, POINT ALSO LOCATED ON THE NORTH-SOUTH HALF SECTION LINE OF SAID SECTION 45; THENCE SOUTH ALONG THE NORTH-SOUTH HALF SECTION LINES OF SECTION 45 BLOCK P, SECTION 48 BLOCK P, AND SECTION 26 BLOCK D-6 AN APPROXIMATE DISTANCE OF 13,254.9 FEET TO A POINT IN THE NORTH LINE OF STATE HIGHWAY 114 FOR THE SOUTHWEST CORNER OF THIS TRACT; THENCE GENERALLY EASTWARD ALONG THE NORTH RIGHT- OF-WAY LINE OF STATE HIGHWAY 114 ACROSS SECTION 26 BLOCK D-6 AND SECTION 4 BLOCK D-6 TO THE POINT OF BEGINNING. That the City Council finds the zone area meets the qualifications of the Act. That at the election of the City Council, certain incentives applicable to business enterprises in the zone which are not applicable throughout the City as indicated on Exhibit B attached hereto and made a part hereof for all purposes may be provided. That the area described in this ordinance is nominated as a defense readjustment zone, and a reinvestment zone, subject to the approval of the Texas Department of Commerce. That a public hearing to consider this ordinance was held by the City Council on August 28, 1997. That this ordinance shall take effect from and after its passage as the law and charter in such case provides. Passed by the City Council on first reading this 28th day of August • 1997. Burgess, City Attorney ALW:dk/ccdoca/drz.ordl.doc EXHIBIT "B" DEFENSE READJUSTMENT ZONES INCENTIVES City and County Platting Fee Rebates The City and County of Lubbock will refund platting fees paid by businesses that locate within the Reese Defense Readjustment Zone, and create and retain at least ten (10) jobs for a period of one year. This fee will be in the amount of the fee originally paid by the business to the City and/or County for platting property within the designated Defense Readjustment Zone. This refund would be made upon the business' attainment of the job requirement, and submittal of an application and necessary documentation within a three-year period of the business' start of operation in the Defense Readjustment Zone. County Property Tax Abatement County Ad Valorem taxes on improvements, by new construction or modernization of industrial projects will be eligible to be abated for a period of ten { 10) years up to 100% per year. Abatement will be considered if the individual project meets criteria and guidelines, established for this use by the affected jurisdiction. Fair Market Rental Value (EMRY) Fair Market Rental Values are discounted rents used by both the Air Force and the Lubbock Reese Redevelopment Authority {LRRA) based on the job creation potential of a lease, including the number and quality of jobs that will be created.
