HomeMy WebLinkAboutOrdinance - 10009-1997 - Closing A 10 Ft Utility And Switch Enclosure Easement - 08/28/1997First Reading Item /121 August 28, 1997 27985 file And hh1rn To £d l11ty R-O•W Second Reading Item i/16 September 11, 1997 , vot 5590PAcc167 ORDINANCE NO .. ___,,1=00=0=9 ___ _ AN ORDINANCE ABANDONING AND CLOSING A TEN-FOOT UNDERGROUND UTILITY AND SWITCH ENCLOSURE EASEMENT LOCATED IN TRACT F-1, SHADOW HILLS ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, 1EXAS, AS MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SA VINOS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that those portions of an easement hereinafter described in the body of this Ordinance are no longer needed for easement purposes and public use; and WHEREAS, the City Council finds it would be in the public interest to close, vacate and abandon the same for easement purposes and for public use; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION l. THAT those portions of the easement as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for easement purposes and public use, such easement being more particularly described as follows: A l 0-foot underground utility and switch enclosure easement located in Tract "F- l", Shadow Hills, an Addition to the City of Lubbock, Lubbock County, Texas, being further described as follows: BEGINNING at a½" rod found in the North right-of-way line of 4th Street which is the original Southwest comer of Tract "F -1 ", Shadow Hills, an Addition to the City of Lubbock, Lubbock County, Texas; THENCE North, along the West line of said Tract "F-1 ", a distance of256.69 feet to a ½" rod found; THENCE North 30° West, along the Northwesterly line of said Tract "F-1 ", a distance of294.92 feet to a½" rod with cap found in the South right-of-way line of 3rd Street at the original Northwest comer of said Tract "F-1 "; THENCE Northeasterly along said South right-of-way line around a curve to the left, said curve having a radius of 623.81 feet, a central angle of 00°59'42", a chord bearing of North 82°37'44" East and a chord distance of 10.83 feet; THENCE South 30° East a distance of293.43 feet to a point; • . ' THENCE South a distance of259.69 feet to a point in the South line of said Tract "F-1" and the North right-of-way line of 4th Street; THENCE South 89°58'21" West, along the South line of Tract "F-1" and said North right-of-way line a distance of 10.00 feet to the Point of Beginning. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
